HomeMy WebLinkAboutORD NO 2341ORDINANCE NO. 2341 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADDING CHAPTER 11.20 TO THE MUNICIPAL CODE CONCERNING REGULATIONS FOR KERN RIVER BICYCLE TRAIL. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Chapter 11.20 is hereby added to Title 11 of the Municipal Code of the City of Bakersfield as follows: Chapter 11.20 KERN RIVER BICYCLE TRAIL BETWEEN BEACH PARK ANDMANOR STREET Sections: 11.20. 11.20. 11.20. 11.20. 11.20. 11.20. 11.20. 11.20 11.20 010 "Kern River Bicycle Trail Between Beach Park and Manor Street" defined 020 "Bicycle" defined 030 Purpose of Bicycle Trail 040 Motor Vehicles Prohibited .," 050 Other Motorized Vehicles Prohibil~, 060 Horseback Riding and Certain Other Uses by Animals Prohibited 070 Pedestrian Uses Prohibited or Restricted .080 Exceptions .090 Unlawful Acts Declared Infractions 11.20.010 "Kern River Bicycle Trail Between Beach Park and Manor Street" Defined. For the purposes of this chapter, the term '~ern River Bicycle Trail between Beach Park and Manor Street" refers to that area in the City of Bakersfield, State of California, more particularly delineated and described as a bicycle trail in the Alignment Plat dated April 10, 1975, identified as 6-11a Cal.St.- Bak. Col. M-i, Field Book 1004, Page 1, on file in the office of the County Surveyor of Kern County, California. 11.20.020 "Bicycle" Defined. For the purposes of this chapter, the term "bicycle" shall mean a device upon which any person may ride, propelled exclusively by human power through a belt, chain or gears and having either two or three rubber-clad wheels. in a tandem or tricycle arrangement. 11.20.030 Purpose of Bicycle Trail. That portion of the Kern River Bicycle Trail between Beach Park and Manor Street shall be used exclusively by those members of the public riding bicycles, except as otherwise provided in this chapter. 11.20.040 Motor Vehicles Prohibited. It is unlawful for any per- son to operate a motor vehicle or motorcycle on the Kern River Bicycle Trail between Beach Park and Manor Street. 11.20.050 Other Motorized Vehicles Prohibited. It is unlawful for any person to operate any motorized vehicle, off-highway motor vehicle, motor-driven cycle, or motorized bicycle on the Kern River Bicycle Trail between Beach Park and Manor Street. 11.20.060 Horseback Riding and Certain Other Uses by Animals Prohibited. It is unlawful for any person to ride any horse or other animal, or to drive, lead or release any horse or any other equine animal or any bovine animal, or to operate any vehicle or equipment drawn or propelled by an animal, on the Kern River Bicycle Trail between Beach Park and Manor Street. 11.20.070 Pedestrian Uses Prohibited or Restricted. It is unlaw- ful for any person to ride or operate roller skates, skateboards, scooters, or other similar non-motorized equipment on said Bicycle Trail. Every pedestrian walking, jogging or running upon said Bicycle Trail shall yield the right-of-way to all bicycles upon said Bicycle Trail so near as to constitute an i~ediate hazard. 11.20.080 Exceptions. There shall be excepted from the prohibi- tions in this chapter any of the persons, vehicles or uses described in the following subsections: A. Any public emergency vehicle while operated by a public officer or public employee in the performance of his duties, is excepted. B. Any motor vehicle or motorized vehicle, while operated by a public officer or public employee for purposes of maintenance, policing or law enforcement, is excepted. C. Any public officer or public employee, while engaged in maintenance, policing or law enforcement, is excepted. o D. Any officer, employee, or agent of the owner of the land on which such Bicycle Trail is located, while engaged in the business of such owner, is excepted. 11.20.090 Unlawful Acts Declared Infractions. Any person who violates any of the provisions of this chapter, shall be guilty of an infraction and upon conviction thereof shall be punishable by (1) a fine not exceeding Fifty Dollars ($50) for a first violation; (2) a fine not exceeding One Hundred Dollars ($100) for a second violation within one year; (3) a fine not exceeding Two Hundred Fifty Dollars ($250) for each additional violation within one year. SECTION 2.
