HomeMy WebLinkAboutRES NO 210-07 RESOLUTION NO. 2 1 0 - 0 7 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ANNOUNCING ITS INTENTION TO FILE A NOTICE OF INTENT AND A NOTICE OF CONTINUATION REGARDING A POTENTIAL QUIET ZONE WHEREAS, the Federal Government has issued the Train Horn Rule which requires trains to blow their horns as they approach street crossings; and WHEREAS, the Rule allows for the establishment of "Quiet Zones" which would reduce the requirement of train horn whistles unless there is a reason to do so; and WHEREAS, the City Council created the Railroad Ad-Hoc Committee to investigate the Rule and the "Quiet Zone" process; and WHEREAS, the Railroad Ad-Hoc Committee has recommended that the City Council vote to submit both a Notice of Continuation and a Notice of Intent with regards to establishing a Quiet Zone on the crossings from Sumner/Miller St. to "L" St; and WHEREAS, the Notice of Continuation may stop the train horns from being blown while the City works on permanent establishment of the Quiet Zone; and WHEREAS, the Notice of Intent will elicit written comments from BNSF, the Federal Railroad Administration, and the California Public Utilities Commission; and WHEREAS, the City Council has not yet determined whether to incur the financial burden associated with creation of Quiet Zones; and WHEREAS, the City Council has not yet determined whether to incur the liability associated with the creation of Quiet Zones; and WHEREAS, submission of the above-mentioned notices and receipt of comments will help the City better estimate the costs involved with the Quiet Zone process and therefore allow the City Council to make an informed decision on whether to implement Quiet Zones. NOW, THEREFORE, RESOLVED by the Council of the City of Bakersfield as follows: 1 . That the above recitals are true and correct and are incorporated herein by reference. 2.
