AN ORDINANCE OF THE COUNCIL OF THE CITY
OF BAKERSFIELD ADDING CHAPTER 10.60 TO
THE MUNICIPAL CODE CONCERNING CONDUCT
PROHIBITED UPON WATER CANALS.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
That Chapter 10.60 is hereby added to Title 10 of the
Municipal Code of the City of Bakersfield as follows:

10.60.010 Swimming and Other Conduct Prohibited Upon Water Canals.
It is unlawful for any person to swim, bathe, dive or wade in, or to
boat, float, or water ski over or through, or to travel by other
device or vehicle on or under the surface of, the water in a water
canal, within the City of Bakersfield, for purposes of amusement or
recreation.
10.60.020 Definition of Water Canal. As used in this chapter
'~ater canal" means a channel or conduit used to divert or convey
water; the term includes canals, laterals, ditches, drains and siphons.
10.60.030 Penalty For Violations. Any person who violates any of
the provisions of this chapter, shall be guilty of an infraction and
upon conviction thereof shall be punishable by (1) a fine not exceed-
ing fifty dollars ($50) for a first violation; (2) a fine not exceed-
ing one hundred dollars ($100) for a second violation of the same
section of the same chapter within one year; (3) a fine not exceed-
ing two hundred fifty dollars ($250) for each additional violation
of the same section of the same chapter within one year.
SECTION 2.
This ordinance shall become effective thirty days from and
after the date of its passage.

I HEREBY CERTIFY that the foregoing ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 9th day of May , 1977, by the
