HomeMy WebLinkAboutORD NO 2338ORDINANCE NO. 2338 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD COMMONLY KNOWN AS 2223 WHITE LANE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield commonly known as 2223 White Lane; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries from a C-2 (Commercial) Zone to an M-1 (Light Manufactur- ing) Zone, of that certain property in the City of Bakersfield con~nonly known as 2223 White Lane, being more particularly described as follows: That portion of the southeast quarter of Section 13, Township 30 South, Range 27 East, M.D.B.& M., in the City of Bakersfield, County of Kern, State of California, lying northwesterly of the north- westerly right-of-way line of the Southern Pacific Railroad through said Section 13 described as follows: Commencing at the intersection of the northwesterly right-of-way line of the Southern Pacific Railroad with the northerly line of the southeast 1/4 of said Section 13; Thence west along said north line 254.75 feet; Thence south 08°29'49" west 55.60 feet to a point in the southerly right-of-way line of White Lane (110 feet wide) said point being the True Point of Beginning for this description; Thence (1) Thence (2) Thence (3) Thence (4) Thence (5) south 08029'49" west 49.53 feet; south 44o17'49" west 335.17 feet; south 45°42'11" east 10.00 feet; south 44o17'49" west 256.19 feet; south 45°42'11" east 165.80 feet; to a point in the northwesterly right-of-way line of the Southern Pacific Railroad, said point being in a curve concave northwesterly having a radius of 5679.65 feet and from which point the radius point bears north 48o07'02" west 5679.65 feet therefrom; Thence (6) southwesterly alon~ said curve through a central angle of 05 54'59" an arc distance of 586.48 feet to a point in said curve from which the radius point bears north 42o12'03" west 5679.65 feet therefrom; Thence (7) north 00o05'05" west parallel with the west line of the southeast 1/4 of said Section 13, 1010.69 feet to a point in the southerly right-of-way line of White Lane; Thence (8) east, parallel with and 55 feet southerly of as measured at right angles to the north line of the southeast 1/4 of said Section 13, 709.35 feet to the True Point of Beginning for this description. EXCEPTING THEREFROM that portion which lies in the unincorporated area of the County of Kern; also excepting the north 150 feet~ .......... o0o ..........
