The City has received a written application request from the developer that the
improvements referenced on the attachment are complete and have been accepted by the
City. Documents included contracts, change orders, paid invoices and other documentation
establishing the actual amount paid by the developer, thus establishing the Acquisition
Price at actual cost. In Addition, the developer has provided the City a Mechanics lien free
endorsement as per the requirements of the Acquisition Agreement. Therefor, please find
attached the Application for Payment of improvements for Assessment District No. 03-3,
the remaining portion of the fees in White Lane Improvements in the Seven Oaks West III
Area.
Wilson and Associates was retained by the City Public Works Department to review those
applications for payment from bond proceeds for this Assessment District.
Completed Items as per Exhibit "A" of the Acquisition Agreement: (See attached
request). $133,801.83

Dear John and Marian:
As you already know, Wilson & Associates has finished our review process of the three payment requests for
the Improvements completed in the Seven Oaks West III Area of Assessment District No. 03-3 ("AD 03-3"),
based on Volumes II, III, and IV of the payment requests dated, respectively, August 1,2007, August 21,
2007, and September 6, 2007, submitted by McIntosh & Associates on behalf of Castle & Cooke (the
"Applicant"), and the updates received through September 24,2007 (respectively, the "Application No.1,"
"Application No.2," and "Application No.3"). This letter and recommendation for payment (Payment No.
. I-A) pertain to onlv the additional pavment for the White Lane improvements in the Seven Oaks West III
) Area. The original payment request for the White Lane improvements in the Seven Oaks West III Area
(described in Exhibit B, Table B-II-B, Item A of the Final Engineer's Report for AD 03-3) has been processed
by Wilson & Associates as Payment No.1 pursuant to Application No. I (see our transmittal dated August
29,2007), the payment request for the Allen Road improvements in the Seven Oaks West III Area (described
in Exhibit B, Table B-II-B, Item B) has been processed by Wilson & Associates as Payment No.2 pursuant
to Application No.2 (see our transmittal dated September 11,2007), and the payment request for the Chamber
Boulevard improvements in the Seven Oaks West III Area (described in Exhibit B, Table B-II-B, Items C and
D) has been processed by Wilson & Associates as Payment No.3 pursuant to Application No.3 (see our
transmittal dated September 24, 2007) .
As described on page 3 of the above-referenced September 24 transmittal pertaining to Payment No.3, "The
total amount of "savings" in the Chamber Boulevard scope of improvements (both Items C and D in Table
B-II-B) is $250,531.94. Together with the total amount of "savings" in the Allen Road scope of
improvements of $23,495.79 (processed on September 11, 2007), it amounts to a grand total of savings of
$274,027.73 in the Seven Oaks West III Area of AD 03-3. Once... Payment No.3 is processed, all of the
Seven Oaks West III Area improvements eligiblefor payment pursuant to the Final Engineer's Reportfor
AD 03-3 will have been acquired by the City and paid to the Applicant. Therefore. the above-referenced
$274.027.73 is now eligible for use in covering all of the $133.801.83 "overrun" in the costs of the White
Lane scope of improvements (processed on August 29. 2007)..." This additional payment is for the items
already found eligible for payment at the time Payment No.1 for the Seven Oaks West III Area was processed
on August 29,2007. However, at that time they were either not approved for payment or were approved for
) payment at a lesser amount than requested, since payments for other improvements (Items B, C, and D) had
. not been previously processed. Now, based on the savings in the total amount paid for all improvements in
the Seven Oaks West III Area (pursuant to Payments No.1, No.2, and No.3), this additional Payment No.
I-A (in the amount of$133,80 1.83) is approved at this time (for the items already found eligible for payment
pursuant to Payment No.1).

Enclosed with this letter is a table entitled "Table 1, Itemized Improvements and Acquisition Costs Approved
for Payment No. I-A in Seven Oaks West III Area, City of Bakersfield Assessment District No. 03-3" ("Table
I ") that presents an itemized comparison of the cost of improvements to be acquired as they were estimated
and shown on said Exhibit B, Table B-II-B of the AD 03-3 Engineer's Report (which is the acquisition
amount funded by the AD 03-3 proceedings) to the itemized amount paid by the Applicant for each item of
work shown in the Application No.1 and requested for payment by the Applicant. Table 1 also shows in its
column entitled "Approved for Payment No. I-A" the amount for each item of work we recommend for
payment to the Applicant as the AD 03-3 Acquisition Price under Payment No. I-A for the Seven Oaks West
III Area. Since the below-described documents were included with our August 29,2007 transmittal, we are
not enclosing the following: (i) a copy of the Applicant's "Application and Certificate for Payment" form, (ii)
a copy of Tic or Title "Mechanic's Lien Guarantee," (iii) copies ofthe Applicant's Notices of Completion for
all AD 03-3 funded improvements in Tract No. 6223, and (iv) copies of City-issued Notices of Completion
, for the AD 03-3 funded improvements in Tract No. 6223 Units 1 through 7. The following is a recapitulation

Oaks West III Area of AD 03-3. As suggested by the Applicant, in order to properly direct the payment,
