V James aples County Recorder, County of Kern, California 3 ENGINEER'S REPORT THE CITY OF BAKERSFIELD ASSESSMENT DISTRICT N0.96-2 (Allen Road Trunk Sewer) BOYLE ENGINEERING CORPORATION, Assessment Engineer for the City of Bakersfield Assessment District No. 96-2 (Allen Road Trunk Sewer), Kern County, California, makes this report, as directed by the City, pursuant to Sections 10203 and 10204 of the Streets and Highways Code (The Municipal Improvement Act of 1913). LOCATION: Assessment District No. 96-2 (Allen Road Trunk Sewer), is located in Section 36, Township 29 South, Range 26 East, Section 6, Township 30 South, Range 27 East, and Sections 1 and 12, Township 30 South, Range 26 East, Mount Diablo Base and Meridian, City of Bakersfield, County of Kern, State of California. The District is generally bounded by Brimhall Road on the north, White Lane on the south, Buena Vista Road on the east and Allen Road on the west. Only a portion of the lands included in these boundaries are participating in the assessment district. Assessment District No. 96-2 include the following: • Lots 1, 2, and 3 of Lot Line Adjustment No. P96-0876 per Certificate of Compliance recorded as Document No. 197-003145, and re-recorded as Document No. 197-008499; • Parcel 3 of Parcel Map 10263 which is bounded on the north and east by Stockdale Highway, on the south by the Cross Valley Canal and on the west by Allen Road; • That portion of Section 1 located south of the Kern River and Stockdale Highway, • That portion of Section 6 located west of Buena Vista Road and South of Stockdale Highway; • All of Section 12. ENGINEER'S REPORT SUBMITTAL STATEMENT I, Raul M. Rojas, Public Works Director and Superintendent of Streets of the City of Bakersfield, having been appointed the Engineer of Work for AD 96-2 by adoption of City Council Resolution No. 29-98 (herein "Engineer of Work") to do and perform all services in making preliminary surveys, preparing plans, estimates of costs, and diagram and assessment, and pursuant to the provision of the Municipal Improvement Act of 1913, as amended (herein "1913 Act"), being Division 12 of the Streets and Highways Code of the State of California (herein "Street and Highways Code"), and pursuant to the Charter and Municipal Code of the City of Bakersfield (herein "Municipal Code") and to Section 10204 contained in the Streets and Highways Code, and in accordance with City Council Resolution No. 1157 being a Resolution Delcaring Intention to Order Construction of Certain Improvements Together with Appurtenances Pursuant to the Provisions of the Municipal Improvement Act of 1913; Declaring the Work to be of More than Local or Ordinary Benefit; Describing the District to be Assessed to Pay the Cost and Expenses thereof; and Providing for the Issuance of Bonds in the matter of the City of Bakersfield Assessment District No. 96-2 (herein "Resolution of Intention"), herewith submit the "Engineer's Report" for AD 96-2 consisting of the following attached exhibits: NOTICE IS HEREBY GIVEN that serial bonds to represent unpaid assessments and bearing interest at a rate not to exceed 12 percent (12%) per annum, shall be issued in the manner and form provided in Part 6, Division 10, of the Streets and Highways Code of the State of California (Improvement Bond Act of 1915) and the last installment of such bonds shall mature not to exceed twenty-four (24) years from the second day of September, 1998 next succeeding 12 months from their date. GENERAL DESCRIPTION OF WORK: A General Description of Work to be completed pursuant to the AD 96-2 proceedings is included in this Engineer's Report. Exhibit "C" describes the improvements to be constructed. EXHIBIT "A" -STATEMENT REGARDING PLANS AND SPECIFICATIONS A statement regarding plans and specifications for improvements to be constructed is included in Exhibit "A". EXHIBIT "B" -ENGINEER'S ESTIMATE OF TOTAL COSTS An estimate of total assessment district costs that consists of an itemized breakdown of the total improvement and incidental costs and expenses including the estimated cost of preparing, J printing, registering, servicing and collecting bonds issued pursuant to these proceedings is included in Exhibit "B". EXHIBIT "C" -IMPROVEMENTS A description, including the costs, of the improvements to be made under these proceedings is included in Exhibit "C". EXHIBIT D -ASSESSMENT SPREAD METHOD A statement of the method by which the undersigned determined the amount proposed to be assessed against each parcel is included in Exhibit "D". It includes a Description of the Assessment Spread Method used to apportion the total estimated cost of the improvements and incidental costs to the several subdivisions of land in AD 96-2. EXHIBIT E -ASSESSMENT ROLL The assessment roll shows the name and addresses of the owners and the amount to be assessed against each parcel of real property within the City of Bakersfield Assessment District No. 96-2 (Allen Road Trunk Sewer). Each parcel is described and assigned a separate "assessment number" for the purposes of this proceeding. The assessment numbers that appear on the Assessment Roll correspond to the diagram numbers shown on the Assessment Diagram. EXHIBIT F -ASSESSMENT DIAGRAM A diagram showing all of the parcels of real property within The City of Bakersfield Assessment District No. 96-2 (Allen Road Trunk Sewer) is included in this exhibit. The diagram is keyed to Exhibit "E" by assessment number. The AD 96-2 Assessment Diagram illustrates the boundaries of AD 96-2 and• the lines and dimensions of each separate lot, parcel and subdivision of land within AD 96-2 as they existed at the time of Preliminary Approval of this Engineer's Report by the City Council, each lot, parcel and subdivision of land having been assigned a separate assessment number upon the Assessment Diagram. The assessment numbers assigned to each separate lot, parcel and subdivision of land and shown on the AD 96-2 Assessment diagram, correspond with the numbers shown on the Assessment roll as contained herein. Maximum Annual Assessment for Assessment District Administration Costs: The Report Requirements section in this Engineer's Report also includes a statement of the proposed maximum annual assessment upon each of the several parcels of land in AD 96-2, to pay the costs incurred by the City of Bakersfield and not otherwise reimbursed, which result from the administration and collection of assessments or registration of any associated bonds and reserve or other related funds. This maximum annual assessment is levied pursuant to Subdivision (f) of Section 10204 of the Streets and Highways Code. R JAS, PUBLIC WORKS DIRECTOR AND ENGINEER OF WORK ASSESSMENT DISTRICT NO. 96-2 CITY OF BAKERSFIELD ENGINEER'S REPORT CITY OF BAKERSFIELD, ASSESSMENT DISTRICT N0.96-2 (ALLEN ROAD TRUNK SEWER) ASSESSMENT REPORT REQUIREMENTS• WHEREAS, on March 25, 1998, the City Council, pursuant to the provisions of the City Charter and Municipal Code and to the provisions of the Municipal Improvement Act of 1913, adopted its Resolution of Intention No. 1157, for the construction of improvements more particularly described therein and did further declare its intention to levy a maximum annual assessment pursuant to Subdivision (f) of Section 10204 of the Streets and Highways Code to recover costs incurred from the administration and collection of assessments and from the administration or registration of any associated reserve or other related funds, in an assessment district known and designated as CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 96-2 (ALLEN ROAD TRUNK SEWER) (herein "AD 96-2"); and, WHEREAS, said Resolution directed the appointed engineer of work for AD 96-2 to make and file a report presenting a general description of any works and appurtenances already installed and any other property necessary or convenient for the operation of the improvements, plans and specifications for the proposed construction, estimate of costs, maps and descriptions of lands and easements to be acquired, and diagram and assessment of and upon the subdivision of land within the assessment district, to which Resolution and the description of said proposed improvements therein contained reference is hereby made for further particulars. PROPOSED ASSESSMENT OF ESTIMATED IMPROVEMENT COSTS AND EXPENSES NOW, THEREFORE, I, Raul Rojas, Public Works Director for the City of Bakersfield and duly appointed Engineer of Work for AD 96-2, by virtue of the power vested in me under the Charter and Municipal Code and under the 1913 Act and the order of the City Council of the City of Bakersfield, hereby make the following assessment to cover the portion of the estimated cost of the work and improvements and the costs and expenses incidental thereto to be paid by AD 96-2. 1. Pursuant to the provisions of law and of the Resolution of Intention, I have assessed the total amount of the costs and expenses of the work and improvements, and expenses incidental thereto upon the several lots, pieces, parcels or portions of lots or subdivisions of land liable therefor and benefited thereby and hereinafter numbered to correspond with the numbers upon the attached Assessment Diagram, equally upon each, respectively, from the improvements, all as is more particularly set forth in the Assessment Roll, attached hereto as Exhibit "E" and incorporated herein by reference as though set forth in full. The numbers on the Assessment Roll correspond with the numbers assigned to each respective parcel and shown on the Assessment Diagram. Each subdivision of land assessed is described in the Assessment Diagram. Each subdivision of land assessed is described in the within Assessment Roll County of Kern for the fiscal year 1997-1998 or by reference to maps and deeds of record. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County. For a more particular description of the manner in which the Estimated Total Improvement Cost and Incidental expenses have been assessed upon the several subdivisions of land in AD 96-2, reference is made to the Assessment Spread Method, attached hereto as Exhibit "D" and incorporated herein by reference as though set forth in full. 9 3. As required by law, the assessment diagram entitled "ASSESSMENT DIAGRAM OF CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 96-2, COUNTY OF KERN, STATE OF CALIFORNIA," consisting of two (2) sheets, is on file in the office of the City Clerk. The Assessment Diagram for AD 96-2 being too bulky to be bound with this Engineer's Report, a reduced, not to scale copy is attached hereto as Exhibit "F" and incorporated herein by reference as though set forth in full. For a more particular description of the AD 96-2 exterior boundaries reference is made to the AD 96-2 Boundary Map on file in the office of the City Clerk, attached hereto in reduced, not to scale form as Exhibit "F" and incorporated herein by reference as though set forth in full. STATEMENT OF MAXIMUM ANNUAL PARCEL ASSESSMENT FOR RECOVERY OF ASSESSMENT DISTRICT ADMINISTRATION COSTS AND EXPENSES Pursuant to Subdivision (f) of Section 10204 of the Streets and Highways Code, I present the following statement of a proposed maximum annual assessment upon each parcel and subdivision of land in AD 96-2, in the amount of fifty dollars ($50.00). Said annual assessment shall be levied by the City Council to cover all administrative costs of AD 96-2 incurred by the City of Bakersfield, and not otherwise reimbursed, which result from the administration and collection of assessments or from the administration or registration of any associated bonds and reserve or other related funds. The City Council shall determine, by resolution, the amount of the annual assessment for this purpose, which shall not exceed the maximum assessment stated above and shall not exceed a reasonable estimate of costs anticipated. The above stated maximum annual assessment amount shall be separate from and in addition to any fee charged to property owners in AD 96-2 by the City of Bakersfield, pursuant to Sections 8682 and 8682.1 of the Streets and Highways Code. 10 BOND DECLARATION NOTICE IS HEREBY GIVEN, that serial bonds to represent the unpaid assessments and to bear interest at the rate not to exceed twelve percent (12%) per annum will be issued in the manner provided by the Improvement Bond Act of 1915 (being Division 10 of the Streets and Highways Code); the last installment of such bonds shall mature not to exceed twenty-four (24) years from the second day of September, 1998, next succeeding twelve (12) months from their date. The provisions of Part 11.1 of the Improvement Bond Act of 1915, providing an alternative procedure for the advance payment of assessments and the calling of bonds, shall apply and the principal amount of the bonds maturing in each year shall be other than an amount equal to an even annual proposition of the aggregate principal of the bonds. The total amount assessed pursuant to the AD 96-2 proceedings includes an incidental expense to cover the estimated cost of preparing, printing, registering, servicing and collecting the improvement bonds proposed to be issued to represent the assessments. ROJAS, PU IC WORKS DIRECTOR AND ENGINEER OF WORK ASSESSMENT DISTRICT NO. 96-2 CITY OF BAKERSFIELD 11 EXHIBIT "A" STATEMENT REGARDING THE PLANS AND SPECIFICATIONS Plans and specifications for the proposed improvements will be filed with the City and are made apart hereof by reference. 12 EXHIBIT "B" ENGINEER'S ESTIMATE OF TOTAL COSTS The "COST ESTIMATE" includes those items defined below and where appropriate summarized in Exhibit "B". "IMPROVEMENTS" are to be made under the proceedings. The improvements involve gravity sewer pipelines including manholes, canal and river crossings, and tie-in to existing sewer. The improvement costs were assessed against the parcels benefiting from the improvements. A more detailed description and statement of estimated construction cost of the facilities are included in Exhibit "C" of this report. "INCIDENTAL EXPENSES", including engineering, legal, financial and consulting fees are part of the project cost. A "CONTINGENCIES" allowance to cover unexpected costs that may arise during the course of the project has been included.- An "UNDERWRITER'S BOND DISCOUNT" of 1.465% of the estimated bond amount has been included in the cost estimate. A "BOND RESERVE FUND" of 10% of the issue size has been included: This fund will be used to cover delinquent assessment payments from landowners within the assessment district. Sums expended to cover delinquent payments will be recovered from the landowners and credited to the Bond Reserve Fund. The funds will be invested and all interest earned will be applied towards bond repayment as will the principal amount. "CAPITALIZED BOND INTEREST" representing two months of interest at 7.25% per annum on the bond amount has been included in the cost estimate. Pursuant to Section 10204 (f) of the California Streets and Highways Code, an annual assessment upon each of the several subdivisions of land in the assessment district will be made for "ADMINISTRATIVE COSTS", including costs incurred by the City of Bakersfield and not otherwise reimbursed which result from the administration and collection of assessments or from administration and registration of any associated bonds and reserve or other related funds. Along Allen Road from the southern boundary of the Kern River to the western extension of White Lane, the improvements include the following: • 6,540 LF of 42-inch, PVC lined, RCP. • Fifteen (15) PVC lined reinforced concrete manholes • Mobilization. Along Allen Road from White Lane to Pacheco Road and along Pacheco Road from Allen Road to Buena Vista Road, the improvements include the following: • 11,400 LF of 42-inch, PVC lined, RCP. • 110 LF of a bored section of 42-inch, PVC lined RCP in a 60-inch steel casing across the Union Pacific Railroad. • Twenty-three (23) PVC lined reinforced concrete manholes • Mobilization, traffic control and pavement repair. The cost estimates used for the purpose of estimating the total assessment were based on a March 19, 1997 construction cost estimate prepared by Porter-Robertson. The total cost estimate for the sewer project was $7,375,319. Of this cost, it was determined that the cost share to benefiting parcels in this Assessment District was $1,361,954.67. The cost share was based on a percentage of total flow contribution by the benefiting parcels. These improvements will be bid by the City. If the actual bids received for the improvements are below the estimate given in this section, the proportionate difference shall be used for the retirement of the bonds. 15 IMPROVEMENT COSTS -Equivalent Dwelling Unit (EDU) Calculation All parcels participated in the sewer pipeline improvements. Only a portion of Diagram Numbers 1, 6, 8 and 11 were determined to benefit from the sewer pipeline improvements. Only those parcels and parts of parcels benefiting from the sewer pipeline improvements were assessed. The improvement costs were first apportioned to all parcels equally on an EDU basis. The EDU's for a particular parcel were calculated by determining the estimated peak flow for a parcel and dividing by the peak flow per EDU. The peak flow for an EDU was determined using 100 gallons per day per person, 2.6 persons per EDU and a 2.2 peaking factor. The resultant peak flow per EDU was therefore 570 gallons per day. The peak flow for a parcel was calculated according to the zoning of the parcel along with the dwelling density and peaking factor for the particular zoning. The following table shows the zonings, dwelling densities, persons per dwelling, flows per person and peaking factors used to determine the peak flows for the parcels. Zonings, dwelling densities, persons per dwelling and peaking factors were -taken from the January 1997 report "Allen Road/Buena Vista Sewer Trunkline Study" prepared by Carollo Engineers, from the August 8, 1997 report "96-2 Assessment District Study, Brimhall III" prepared by Martin-McIntosh, from proposed zoning submitted to the City of Bakersfield Planning Department also prepared by Martin-McIntosh, and from updated zoning information provided by the City of Bakersfield. The total benefit area for Diagram Nos 1, 2A, 2B, 3A, 3B, 3C, 5, 7, 8, 9, 10, and 11 was calculated to be 1,082.3 acres. The assessment per acre for these parcels, determined by dividing the total assessment for these parcels by the total acreage, was calculated to be $1574.00 per acre. Exhibit "E" shows the resulting asssessment for these and all parcels in the assessment district. 17 NON-IMPROVEMENT COSTS All parcels participated in non-improvement costs. INCIDENTAL COSTS The incidental costs were apportioned to all parcels based on their percentage of the total improvement costs. CONTINGENCY COSTS The contingency costs were apportioned to all parcels based on their percentage of the total improvement costs. BOND ISSUANCE COSTS The bond issuance costs were divided among all the parcels based on their percentage of the total unpaid assessment.
