County Recorder, County of Kern, California ENGINEER'S REPORT THE CITY OF BAKERSFIELD ASSESSMENT DISTRICT N0.93-2 (Stine-Harris) BOYLE ENGINEERING CORPORATION, Assessment Engineer for the City of Bakersfield Assessment District No. 93-2 (Stine-Hams), Kern County, California, makes this report, as directed by the City, pursuant to Section 10204 of the Streets and Highways Code (Municipal Improvement Act of 1913.) LOCATION: Assessment District No. 93-2 (Stine-Harris), is located in Section 22, Township 30 South, Range 27 East, Mount Diablo Base and Meridian, City of Bakersfield, County of Kern, State of California. The Assessment District can more specifically be described as follows: • Parcels 1 through 3 of Parcel Map 9918 which are bounded on the east by Stine Road, on the west by the Farmer's Canal, on the north by Harris Road and on the south by Panama Lane; • Parcels 1 through 11 of Parcel Map 9939* which are bounded on the east by the Farmer's Canal, on the north by Harris Road and on the south by Panama Lane and the Arvin Edison Water Storage District Canal; • Parcels 1 through 4 of Parcel Map No. 9919 which are north of Harris Road, bounded on the east by Tract 3891 Unit B, on the south by Harris Road; and, • The final area making up the Assessment District is an 0.80 acre block of property located at the northwest corner of the intersection of Stine Road and Harris Road. It is bounded on the south by Hams Road, on the east by Stine Road, and on the west and north by Tract 3891 Unit A. *Note: • Parcel 1 of Parcel Map 9939 has recorded as Tract 5652. • Parcel ? of Parcel Map 9939 has recorded as Tract 5701. ENGINEER' S REPORT SUBMITTAL STATEMENT I, Ed W. Schulz, Public Works Director and Superintendent of Streets of the City of Bakersfield, having been appointed the Engineer of Work for AD 93-2 by adoption of City Council Resolution No. 142-93 (herein "Engineer of Work") to do and perform all services in making preliminary surveys, preparing plans, estimates of costs, and diagram and assessment, and pursuant to the provision of the Municipal Improvement Act of 1913, as amended (herein "1913 Act"), being Division 12 of the Streets and Highways Code of the State of California (herein "Street and Highways Code"), and pursuant to the Charter and Municipal Code of the City of Bakersfield (herein "Municipal Code") and to Section 10204 contained in the Streets and Highways Code, and in accordance with City Council Resolution No. being a Resolution of Intention Regarding Construction and Acquisition of Improvements By special Assessment and Assessment Bond Proceedings in the matter of the City of Bakersfield Assessment District No. 93-2 (herein "Resolution of Intention"), herewith submit the "Engineer's Report" for AD 93-2 consisting of the following attached exhibits: NOTICE IS HEREBY GIVEN that serial bonds to represent unpaid assessments and bearing interest at a rate not to exceed 12 percent (12%) per annum, shall be issued in the manner and form provided in Part 6, Division 10, of the Streets and Highways Code of the State of California (Improvement Bond Act of 1915) and the last installment of such bonds shall mature not to exceed years from the day of 1994 next succeeding 12 months from their date. EXHIBIT A -Statement regarding plans and specifications for improvements to be constructed. GENERAL DESCRIPTION OF WORKS AND ACQUISITIONS: A General Description of Work and Acquisitions to be completed pursuant to the AD 93-2 proceedings is included in this Engineer's Report. EXHIBIT B -ENGINEER'S ESTIMATE OF TOTAL COSTS An estimate of total assessment district costs that consists of an itemized breakdown of the total improvement, acquisition and incidental costs and expenses including the estimated cost of preparing, printing, registering, servicing and collecting bonds .issued pursuant to these proceedings is included in Exhibit "B". EXHIBIT C - ACOUISITIONS A description, including the costs, of the acquisitions to be made under these proceedings. EXHIBIT D -ASSESSMENT SPREAD METHOD A statement of the method by which the undersigned determined the amount proposed to be assessed against each parcel. It includes a Description of the Assessment Spread Method used to apportion the total estimated cost of the improvements, acquisitions and incidental costs to the several subdivisions of land in AD 93-2, in direct proportion to the benefits received by each subdivision, respectively, from those improvements and acquisitions. EXHIBIT E -ASSESSMENT ROLL The assessment roll shows the name and addresses of the owners and the amount to be assessed against each parcel of real property within the City of Bakersfield Assessment District No. 93-2 (Stine-Hams). Each parcel is descnbed and assigned a separate "assessment number" for the purposes of this proceeding. The assessment numbers that appear on the Assessment Roll correspond to the diagram numbers shown on the Assessment Diagram. Maximum Annual Assessment for Assessment District Administration Costs: The Report Requirements section to this Engineer's Report also includes a statement of the proposed maximum annual assessment upon each of the several subdivisions of land in AD 93-2, to pay the costs incurred by the City of Bakersfield and not otherwise reimbursed, which result from the administration and collection of assessments or registration of any associated bonds and reserve or other related funds. This maximum annual assessment is levied pursuant to Subdivision (f) of Section 10204 of the Streets and Highways Code. EXHIBIT F -ASSESSMENT DIAGRAM A diagram showing all of the parcels of real property within The City of Bakersfield Assessment District No. 93-2 (Stine-Harris) is included in this exhibit. The diagram is keyed to Exhibit E by assessment number. The AD 93-2 Assessment Diagram illustrates the boundaries of AD 93-2 and the lines and dimensions of each separate lot, parcel and subdivision of land within AD 93-2 as they existed at the time of Preliminary Approval of this Engineer's Report by the City Council, each lot, parcel and subdivision of land having been assigned a separate assessment number upon the Assessment Diagram. The assessment numbers assigned to each separate lot, parcel and subdivision of land and shown on the AD 93-2 Assessment diagram, correspond with the numbers shown on the Assessment roll as contained herein. SCHULZ, PUBLIC WORKS DIRECTOR AND ENGINEER OF WORK ASSESSMENT DISTRICT NO. 93-2 CITY OF BAKERSFIELD 6 ENGINEER' S REPORT CITY OF BAKERSFIELD, ASSESSMENT DISTRICT NO. 93-2 (STINE-HARRIS) ASSESSMENT REPORT REQUIREMENTS: WHEREAS, on , 1993, the City Council, pursuant to the provisions of the City Charter and Municipal Code and to the provisions of the Municipal Improvement Act of 1913, adopted its Resolution of Intention No. ,for the construction and acquisition of improvements more particularly described therein and did further declare its intention to levy a maximum annual assessment pursuant to Subdivision (f) of Section 10204 of the Streets and Highways Code to recover costs incurred from the administration and collection of assessments and from the administration or registration of any associated reserve or other related funds, in an assessment district know and designated as CITY OF BAKERSFIELD ASSESSMENT DISTRICT N0.93-2 (STINE-HARRIS) (herein "AD 93-2"); and, WHEREAS, said Resolution directed the appointed engineer of work for AD 93-2 to make and file a report presenting a general description of any works and appliances already installed and any other property necessary or convenient for the operation of the improvements, plans and specifications for the proposed construction, estimate of costs, maps and descriptions of lands and easements to be acquired, and diagram and assessment of and upon the subdivision of land within the assessment district, to which Resolution and the description of said proposed improvements therein contained reference is hereby made for further particulars. PROPOSED ASSESSMENT OF ESTIMATED IMPROVEMENT AND ACQUISITION COSTS AND EXPENSES NOW, THEREFORE, I, Ed W. Schulz, Public Works Director for the City of Bakersfield and duly appointed Engineer of Work for AD 93-2, by virtue of the power vested in me under the Charter and Municipal Code and under the 1913 Act and the order of the City Council of the City of Bakersfield, hereby make the following assessment to cover the portion of the estimated cost of the acquisitions, work and improvements and the costs and expenses incidental thereto to be paid by AD 93-2. 1. Pursuant to the provisions of law and of the Resolution of Intention, I have assessed the total amount of the costs and expenses of the acquisitions, work and improvements, and expenses incidental thereto upon the several lots, pieces, parcels or portions of lots or subdivisions of land liable therefor and benefited thereby and hereinafter numbered to correspond with the numbers upon the attached Assessment Diagram, upon each in direct proportion and relation to the estimated benefits to be received by such subdivision, respectively, from the acquisitions and improvements, all as subdivisions, respectively, from the acquisitions and improvements, all as subdivision, respectively, from the acquisitions and improvements, all as is more particularly set forth in the Assessment Roll, attached hereto as Exhibit "E" and incorporated herein by reference as though set forth in full. The numbers on the Assessment Roll correspond with the numbers assigned to each respective parcel and shown on the Assessment Diagram. Each subdivision of land assessed is described in the Assessment Diagram. Each subdivision of land assessed is described in the within Assessment Roll County of Kern for the fiscal year 1992-1993 or by reference to maps and deeds of record. For a more particular description of said property, reference is hereby made to the deeds and maps on file and of record in the office of the County Recorder of said County. For a more particular description of the manner in which the Estimated Total Improvement and Acquisition Cost and Incidental expenses have been assessed upon the several subdivisions of land in AD 93-2, reference is made to the Description of Assessment spread Method, attached hereto as Exhibit "D" and incorporated herein by reference as though set forth in full. 8 3. As required by law, the assessment diagram entitled "ASSESSMENT DIAGRAM OF CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 93-2, COUNTY OF KERN, STATE OF CALIFORNIA," consisting of four (4) sheets, is on file in the office of the City Clerk. The Assessment Diagram for AD 93-2 being too bulky to be bound with this Engineer's Report, a reduced, not to scale copy is attached hereto as Exhibit "F" and incorporated herein by reference as though set forth in full. For a more particular description of the AD 93-2 exterior boundaries reference is made to the AD 93-2 Boundary Map on file in the office of the City Clerk, attached hereto in reduced, not to scale form as Exhibit "F" and incorporated herein by reference as though set forth in full. STATEMENT OF MAXIMUM ANNUAL PARCEL ASSESSMENT FOR RECOVERY OF ASSESSMENT DISTRICT ADMINISTRATION COSTS AND EXPENSES Pursuant to Subdivision (f) of Section 10204 of the Streets and Highways Code, I present the following statement of a proposed maximum annual assessment upon each parcel and subdivision of land in AD 93-2, in the amount of plus an annual maximum five percent (5%) adjustment for inflation. Said annual assessment shall be levied by the City Council cover all administrative costs of AD 93-2 incurred by the City of Bakersfield, and not otherwise reimbursed, which result from the administration and collection of assessments or from the administration or registration of any associated bonds and reserve or other related funds. The City Council shall determine, by resolution, the amount of the annual assessment for this purpose, which shall not exceed the maximum assessment stated above and shall not exceed a reasonable estimate of costs actually incurred. The above stated maximum annual assessment amount shall be separate from and in addition to any fee charged to property owners in AD 93-2 by the City of Bakersfield, pursuant to Sections 8682 and 8682.1 of the Streets and Highways Code. 9 BOND DECLARATION NOTICE IS HEREBY GIVEN, that serial bonds to represent the unpaid assessments and to bear interest at the rate not to exceed twelve percent (12%) per annum will be issued in the manner provided by the Improvement Bond Act of 1915 (being Division 10 of the Streets and Highways code); the last installment of such bonds shall mature not to exceed thirty-nine (39) years from the day of ,1994, next succeeding twelve (12) months from their date and shall be subject to a call premium of not less than 3 percent (3%) nor more than 5 percent (5%) of the unmatured principal, as maybe set by the City Council, upon all redemptions prior to maturity. The provisions of Part 11.1 of the Improvement Bond Act of 1915, providing an alternative procedure for the advance payment of assessments and the calling of bonds, shall apply and the principal amount of the bonds maturing in each year shall be other than an amount equal to an even annual proposition of the aggregate principal of the bonds. The total amount assessed pursuant to the AD 93-2 proceedings includes an incidental expense to cover the estimated cost of preparing, printing, registering, servicing and collecting the improvement bonds proposed to be issued to represent the assessments. SCHULZ, PUBLIC WORKS DIRECTOR AND ENGINEER OF WORK ASSESSMENT DISTRICT NO. 93-2 CITY OF BAKERSFIELD 10 EXHIBIT A STATEMENT REGARDING THE PLANS AND SPECIFICATIONS Plans and specifications for the proposed acquisition improvements will be filed with the City and made a part hereof by reference. A discussion of the improvements is included in Exhibit "C". 11 EXHIBIT B ENGINEER'S COST ESTIMATE The "COST ESTIMATE" includes those items defined below and where appropriate summarized in Exhibit B. "CONSTRUCTION COST" figures are based on the actual bid received for the project. "ACQUISITIONS" are to be made under the proceedings. The acquisitions include water and sewer pipelines, storm water drainage improvements, street improvements and park site improvements. The acquisition improvement costs were assessed against the parcels benefitting from the improvements. A description and cost estimate of the facilities are included in Exhibit C of this report. "INCIDENTAL EXPENSES", including engineering, legal, financial and consulting fees are part of the project cost. A "CONTINGENCIES" allowance to cover unexpected costs that may arise during the course of the project has been included. An "UNDERWRITER' S BOND DISCOUNT" of 1.495% of the estimated bond amount has been included in the cost estimate. A "BOND RESERVE FUND" has been included. This fund will be used to cover delinquent assessment payments from landowners within the assessment district. Sums expended to cover delinquent payments will be recovered from the landowners and credited to the Bond Reserve Fund. The funds will be deposited in an interest earning account and all interest earned will be applied towards bond repayment as will the principal amount. Pursuant to Section 10204 (f) of the California Streets and Highways Code, an annual assessment upon each of the several subdivisions of land in the assessment district will be made for "ADMINISTRATIVE COSTS", including costs incurred by the The City of Bakersfield and not otherwise reimbursed which result from the administration and collection of assessments or from administration and registration of any associated bonds and reserve or other related funds. The improvements to be acquired include water pipelines, sewer pipelines, a drainage sump and associated pipelines, and street improvements and engineering fees that will benefit all participants. The infrastructure for Tract 5652 which includes streets, water, sewer and drainage pipelines is included with this acquisition. Improvements for the Mason Tract are also included. School site improvements consist of constructing curb and gutter for this location. Park site acquisiton improvements are included. Improvements include a block wall on the northern boundary of the development north of Harris Road and entry monument signs. Acquisitions are detailed in the following table. The improvements to be acquired by the City will be bid. The bidding process is the responsibility of the developer. The cost estimates used for the purpose of estimating the total assessment were based on "Improvement Bond Estimates for Kern County". The total assessed against each parcel is shown in Exhibit E, Assessment Roll. The following parcels were not assessed: • The east half of Parcel 2 of Parcel Map 9939, Diagram Number 106, is designated as a future park site. • The west half of Parcel 2 of Parcel Map 9939, Diagram Number 195, is designated as a future school site. • The following APN's, included within the Assessment District boundary but not listed in the assessment roll or shown on the boundary map and assessment diagram maps, are deeded to the City of Bakersfield: 370-022-31-00-8 370-022-37-00-6 370-022-38-00-9 370-022-48-00-8 370-022-49-00-1 370-022-50-00-3 • The following APN's, included within the Assessment District boundary but not listed in the assessment roll or shown on the assessment diagram maps, are part of the Farmer's Canal: 370-022-34-00-7 370-022-47-00-5 • The drainage site located within Tract 5701. ACQUISITION COSTS The acquisition costs were apportioned to all parcels based on their area benefitted basis of the total improvements. Complete infrastructure acquisitions for Tract 5652 (Assessment Diagram Numbers 14 through 105) have been included. WATER The design of the water network allows for tie-in to major distribution water pipelines on both the east and west sides of the Assessment District. Thus, all parcels, except Assessment Diagram Numbers 5, 106 and 195 participated on an area benefitted basis in water pipeline improvements. SEWER All parcels, except Assessment Diagram Numbers 5, 106 and 195, participated on an area benefitted basis in sewer pipeline improvements. Assessment Diagram Numbers 1, 2, 9, 11 through 13, and 107 through 194 were assessed for the 10, 12 and 15-inch diameter trunk line and appurtances for the sewer extension to the intersection of Ashe Road and Panama Lane. Assessment Diagram Numbers 1 through 4 was not assessed for any 8-inch diameter pipeline. Assessment Diagram Numbers 6, 7, 8, 10, and 196 were assessed for the Seasons Drive sewer and appurtances. 17 Assessment Diagram Numbers 3, 4, and 14 through 105 (Tract 5652 -lots 1 through 92) were assessed for the Harris Road sewer. Lots in Tract 5652 were only assessed for their share of the 12-inch diameter pipeline, 24-inch bore encasement, and tie-in for the Harris Road trunk line. STORM DRAINAGE All parcels, except Assessment Diagram Numbers 5, 106 and 195, participated on an area benefitted basis in storm drainage pipeline and sump improvements. STREETS The street improvements will allow improved access for all participating parcels; thus all parcels participated on an area benefitted basis in street improvements. Assessment Diagram Numbers 1, 2, 3, and 4 were not assessed for the Seasons Drive. Assessment Diagram Number 5 was assessed on an area benefitted basis for the Stine Road improvements south of Harris Road and for Harris Road. All parcels were assessed for the improvements to the section of Stine Road north of Harris Road based on street frontage. Diagram Number 5 has approximately 15% of the total street frontage along Stine Road; thus, this parcel shared in approximately 15% of the improvements to this section and the other parcels were assessed the remaining 85%. PARK SITE All parcels, except Assessment Diagram Numbers 5, 106 and 195, participated on an area benefitted basis in park site improvements. OTHER ACQUISITIONS -ENTRY SIGNS AND BLOCK WALL All parcels, except Assessment Diagram Numbers 5, 106 and 195, participated on an area benefitted basis in monument sign improvements. Assessment Diagram Numbers 1 through 4 were the only parcels assessed for the block wall.
