S.ftsa MIf85P Ct py]]g4 ENGINEER'S REPORT CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 93-3 (CALIFORNIA-OAK) EXHIBIT D DESCRIPTION OF ASSESSMENT SPREAD METHOD EXHIBIT D ENGINEER'S REPORT CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 93-3 (CALIFORNIA-OAK) DESCRIPTION OF ASSESSMENT SPREAD METHOD INTRODUCTION The 1913 Act requires that a specific procedure or formula be developed for every assessment levied pursuant to said Act, for the purpose of apportioning the total cost of the assessment district improvements. The law requires that the cost of the assessment be apportioned to the individual parcels in proportion to the estimated benefit that each parcel can be expected to receive from the work and improvements covered by the assessment. The City Council appointed the Director of Public Works as the Engineer of Work for AD 93-3 by adoption of Resolution No. 160-93 on October 6, 1993. Resolution No. 160-93 also approved Agreement No. 93-214 with Edward J. Wilson, a Registered Civil Engineer, appointing him as the Assessment Engineer for AD 93-3. The Assessment Engineer has been retained by the City to prepare an Engineer's Report on the proposed assessment that will include, in part, an analysis of the. facts in AD 93-3 and the development of a method of apportioning the total amount of the costs and expenses of the proposed improvements to the several subdivisions of land located therein, in proportion to the estimated benefits to be received by each such subdivision, respectively, from the improvements. AD 93-3 has been formed pursuant to a property owner petition, requesting the City Council to waive further proceedings under Division 4 of the Streets and Highways Code and to undertake proceedings pursuant to the 1913 Act. The petition is on file with the City Clerk. On October 6, 1993, the City Council adopted its Resolution No. 159-93, determining to undertake proceedings under the 1913 Act, without further proceedings under Division 4 of the Streets and Highways Code. ASSESSMENT DISTRICT PURPOSE AD 93-3 has been formed for the purpose of financing the private property beneficial cost share for the construction and acquisition of various street improvements in California Avenue, several California Avenue to Fwy 99 on- and off-ramp modifications, and certain on-site utility improvements. A detailed description of those improvements is presented in Engineer's Report, Section II. The AD 93-3 proceedings will confirm an assessment for the estimated total cost of the improvements to be constructed and acquired, pursuant to the 1913 Act and the Municipal Code. The City will issue bonds under the 1915 Act, 29149FER.IXD D-1 06/23/94 representing the unpaid assessments, to pay the cost to install, construct, and acquire the improvements, and pay all incidental costs and expenses related thereto and authorized for funding by the 1913 Act. The improvements are to be constructed pursuant to the plans for each of the three projects described in Engineer's Report Section II, and pursuant to the terms and conditions of the CalOak Acquisition Agreement. A description of AD 93-3 is presented in Engineer's Report Section I, and a General Description of Work and Acquisitions to be made pursuant to the AD 93-3 proceedings is included in Engineer's Report Section II. There are no non-benefited and non-assessed parcels in AD 93-3. ASSESSMENT SPREAD METHOD A description of the methodology used to apportion the costs of the AD 93-3 construction work and acquisitions and of the incidental work, cost, and expenses of the AD 93-3 assessment proceedings is presented below. Description of AD 93-3 Benefits It is the Assessment Engineer's responsibility to identify the benefits that the AD 93-3 parcels will receive from the Improvements proposed to be constructed and acquired. In the case of AD 93-3 the City Construction Project, the Caltrans Construction Project and the CalOak Acquisition Project (all as described in Engineer's Report Section II) will provide the following primary benefits: ~k City of Bakersfield Traffic Facilitation Benefits Category ~k AD 93-3 Property Development Benefits Category These two primary benefit categories provide the basis for an allocation of specific improvement system work and associated costs by benefit category and for the spread of those allocated system costs to the AD 93-3 properties, in direct proportion to the estimated level of benefit each property will receive from the system improvements. The improvement systems, or portions of systems, and their associated shares allocated to each primary benefit category are described as follows: * City of Bakersfield Traffic Facilitation Benefits Category The scope of work included in this primary benefit category is limited to the portion of the City Construction Project system improvements directly related to the widening of California Avenue between Oak Street and Real Road. It is the finding of this Assessment Spread Method that the work and improvements included in this benefit category will provide a general traffic facilitation benefit to the City street system, by relieving congestion and thereby improving traffic operations and safety along this 29149FER.E}~ D-2 06/23/94 section of a primary east/west arterial street. The improvements included in this benefit category will, therefore, provide traffic facilitation to properties located both within and outside of AD 93-3. In accordance with the Generalized Public Benefit associated with the improvements allocated to this benefit category, the cost of those improvements is to be paid by the City as a Contribution. The improvements allocated to the City of Bakersfield Traffic Facilitation Benefit Category are described as follows: Street System Improvements Based on the information provided by City staff, the City will not cover any costs that are part of either of the following projects in AD 93-3: CalOak Acquisition Project Caltrans Construction Project The following City Construction Project Improvement Systems work is included in this benefit category: A. California Avenue Widening Improvements 1. California Avenue Street Improvements between Oak Street and Real Road, except for the portion of frontage improvements along the CalOak site frontage on the north side of California Avenue between Oak Street and westbound California Avenue to the northbound Fwy 99 on-ramp. 2. Fifty percent of the cost to relocate and modify the existing traffic signal at the intersection of California Avenue and the northbound Fwy 99 off-ramp. B. One hundred percent (100%) of the cost of the eastbound California Avenue to the northbound Fwy 99 loop on-ramp modification work. C. Fifty Percent (50%) of the cost to modify the existing Northbound Fwy 99 to California Avenue off-ramp. Storm Drain Improvements The total cost of work to modify existing storm drain improvements, if any, that is required within the limits of work for the Street System Improvements described above, as shown on the plans for the City Construction Project. 29149FER.EXD D-3 06/23/94 Sewer System Improvements The total cost of work to modify existing sewer system improvements, if any, that is a part of the City Construction Project and that is required within the limits of work for the Street System Improvements described above and shown on the plans for the City Construction Project. See Exhibit B, Tables B-I and B-II for a detailed breakout of the improvement costs identified as "the City Share." The City Share Costs are the apportioned shares of the City Construction Project Improvement System costs for this primary benefit category. The improvement costs for the City Share used in this filed for final approval form of the Engineer's Report are taken from the cost estimate prepared by City design engineering consultant on 6/22/94. * AD 93-3 Property Development Benefits Category The scope of work allocated to this primary benefit category includes all of the. CalOak Acquisition Project improvements and costs,-all of the Caltrans Construction Project bridge widening work and cost assigned to the City and to CalOak by the City/Caltrans District Agreement No. 06-0932 and City Agreement No. 93-238, and -the following described portions of the City Construction Project Improvements: AD 93-3 Apportioned Share of City Construction Project Improvements and Associated Costs: Street System Improvements: A. California Avenue Widening Improvements 1. Fifty percent (50%) of the cost to relocate and modify the existing traffic signal at the relocated intersection of California Avenue and the northbound Fwy 99 off-ramp. 2. One hundred percent (100%) of the cost to relocate and modify the existing traffic signal at the northwest quadrant of the California Avenue and Oak Street intersection. This signal relocation and modification work was preliminarily assessed as part of the City Construction Project, but has subsequently been shifted into the scope of work for the CalOak Acquisition Project. It is stated here for clarification to avoid possible confusion due to the shift of work from construction to acquisition. 29149FER.EXD D-4 06/23/94 B. Freeway 99 On-ramp and Off-ramp Relocations and Modifications: 1. Fifty percent (50%) of the cost to modify the existing Northbound Fwy 99 to California Avenue Off-ramp; and 2. One hundred percent (100%) of the cost of the Transitional (merge) Lane Modification work at the top of the eastbound California to Fwy 99 northbound loop on-ramp, to accommodate the westbound California Avenue to northbound Fwy 99 On-ramp relocation/modification work that is to be completed as part of the City Construction Project; and 3. One hundred percent (100%) of the cost to relocate the existing westbound California Avenue to Northbound Fwy 99 On-ramp. CALCULATION OF AD 93-3 PARCEL ASSESSMENTS The AD 93-3 Property Development Primary Benefit Category, its allocated improvements, and their associated costs have been further divided into the following Benefit and Assessment groups and subgroups: ^ AD 93-3 Site Development Benefit and Assessment Group. ^ AD 93-3 California Avenue Access Improvement Benefit and Assessment Group, which is further divided into the following Benefit and Assessment Subgroups: A. Site Development Traffic Impacts Mitigation Benefit and Assessment Subgroup B. Incidental Site Access Improvement Benefit and Assessment Subgroup C. Abandoned Caltrans Right-of-way Availability Benefit and Assessment Subgroup The improvements and their associated costs that have been allocated to the AD 93-3 Property Development Primary Benefit Category are apportioned to each of the two benefit and assessment groups and their subgroups as follows: Description of the Improvements, their related Benefits, and Method of Assessment Spread for the AD 93-3 Site Development Benefit and Assessment Group. It is the finding of this Assessment Spread Method that the following described AD 93-3 improvements are required to be installed as general conditions of development of the AD 93-3 properties. It is the further finding of this Assessment Spread Method that these primary site development improvements will provide a uniform level of benefit to all of the AD 93-3 parcels, because they are improvements that must be 29149FER.EXD D-5 06/23/94 installed as part of the development and buildout with commercial land uses of all of the AD 93-3 parcels. Accordingly, the total estimated cost of the AD 93-3 Site Development Benefit and Assessment Group Improvements is spread to the AD 93-3 properties in direct proportion to each parcel's assessable gross area. The included improvements for this benefit and assessment group are as follows: 1. California Avenue street frontage improvements between Oak Street and the westbound California Avenue to northbound Fwy 99 on-ramp; 2. Traffic signal relocation at the northwest quadrant of the intersection of California Avenue and Oak Street (100% of the total cost); 3. Private utility relocations; 4. Storm drain improvements, including the cost to acquire the sump site parcel 5. Sewer system improvements. The parcel assessable gross areas used to spread the total estimated cost of the above- described improvements to the AD 93-3 parcels is defined herein as the parcel gross area as shown on the Lot Line Adjustment No. 366 (LLA 366) map recorded November 9, 1993 in the Office of the Kern County Recorder, a. Less all present and future easement dedications, as shown on the proposed Parcel Map Waiver 5-94 (PMW 5-94) map printed March 16, 1994 and on file with the Engineer of Work; b. Plus areas of excess Caltrans right-of-way to be abandoned and added to the adjacent AD 93-3 properties. A detailed tabulation of parcel assessable areas is presented in Exhibit E, while the sketch map of existing and proposed parcel lines is presented in Exhibit F. II. Description of the Improvements, their related Benefits and Method of Assessment Spread for the AD 93-3 California Avenue Access Improvement Benefit and Assessment Group and its Subgroups A. Site Development Traffic Impacts Mitigation Benefit and Assessment Subgroup: According to information provided by City engineering staff, the California Avenue and Oak Street Intersection is an impacted intersection with existing daily traffic volumes at the carrying capacity of these streets. Development of the AD 29149FER.EXD D-6 06/23/94 93-3 properties to their highest and best uses as commercial property will generate additional traffic movements into and out of the site that would further impact the adjacent streets and disrupt traffic flows. In order to develop all of the AD 93-3 properties to their highest and best use, City engineering staff has further described the need for the site development traffic impacts to be mitigated. The method of mitigating potential site development traffic impacts that has been selected by CalOak, is to develop a second point of access to California Avenue at the signalized intersection with the northbound Fwy 99 to California Avenue off-ramp. It is the finding of this Assessment Spread Method that: The work and cost to relocate the existing westbound California Avenue to Northbound Fwy 99 on-ramp; and 2. Fifty percent (50%) of the cost to relocate and modify the existing traffic signal at the relocated intersection of California Avenue and the northbound Fwy 99 off-ramp are primary improvements that need to be completed in order to permit the development of a new point of access to California Avenue. It is the further finding of this Assessment Spread Method that the Traffic Impacts Mitigation Benefits provided to the AD 93-3 parcels from the development of this new signalized access to California Avenue are proportionate to the estimated vehicle trips that would use the new access to California Avenue. Accordingly, the estimated total cost of the above-described improvements is spread to the parcels in AD 93-3 in direct proportion to the estimated total number of vehicle trip ends (in and out trips) passing through this new access to California Avenue. This access is identified as Drive A in the vehicle trip generation calculation tables provided by the City Traffic Deparhnent, attached as Engineer's Report Exhibit H and incorporated herein by reference. B. Incidental Site Access Improvement Benefit and Assessment Subgroup: The relocation of the existing California Avenue westbound to Fwy 99 northbound on-ramp creates the need to modify other portions of the existing Fwy 99 to California Avenue interchange. These improvements are, for the purpose of this Assessment Spread Method, considered to be incidental to the relocation of the existing California Avenue westbound to Fwy 99 northbound on- ramp and are described as follows: The northbound Fwy 99 bridge widening over the AT&SF railroad, (the Caltrans Construction Project); 29149FER.EXD D-7 06/23/94 2. Fifty percent (50%) of the cost to modify the existing northbound Fwy 99 to California Avenue off-ramp; 3. Transitional (merge) lane modification at the top of the eastbound California Avenue to northbound Fwy 99 loop on-ramp. 4. Acquisition of Caltrans excess right-of-way and California Avenue access rights Since these improvements are considered to be incidental to the primary work described in Subgroup II.A, above, it is the finding of this Assessment Spread Method that they will provide a uniform level of improved site access benefits to all AD 93-3 parcels. Accordingly, the cost of these improvements is spread to the AD 93-3 parcels in direct proportion to each parcel's assessable gross area. C. Abandoned Caltrans Right-of--way Availability Benefit and Assessment Subgroup As a part of the process of relocation of the westbound California to northbound Fwy 99 on-ramp, Caltrans will abandon in favor of the City a portion of its right- of-way at the north side of California Avenue adjacent to the .CalOak property. At this moment the plan is that a portion of this Caltrans right-of--way, which will not be a part of the future street right-of--way, will be transferred by the City to the adjacent AD 93-3 properties. Based on the information obtained from the City on the estimated land value of the sump site at the northwest corner of Assessment No. 5, which is to be acquired by the City as part of -the AD 93-3 proceedings, the proposed sump site acquisition unit price per square foot ($4.00/sf) was used as the estimated value of the abandoned Caltrans right-of-way to be added to adjacent properties. Those to be abandoned areas are clearly marked on the Exhibit F sketch map, and the tabulation of estimated net areas to be added to adjacent properties is a part of Exhibit E. The estimated total cost of Caltrans right-of-way to be abandoned and added to adjacent properties ($79,128.00) is subtracted from the total improvement cost for the AD 93-3 Site Development Benefit and Assessment Group and from the Incidental Site Access Improvement Benefit and Assessment Subgroup. The net costs apportioned to these two benefit and assessment improvement groups are the costs spread to the AD 93-3 parcels on the basis of assessable parcel area. APPORTIONMENT OF IMPROVEMENT INCIDENTAL COST5 The work assessed as improvement incidental costs includes the cost to design the improvements and the costs of construction inspection, staking, soils and materials testing, plan checks fees, and project administration. An itemized estimate of the City Project Construction Incidental costs is included in Engineer's Report Exhibit B, Table B-III, and 29149FER.EXD D-8 06/23/94 similar cost details for the CalOak Acquisition Project are included in Exhibit B, Table B-V. The Caltrans Construction Project incidental cost is assumed to be a part of the estimated $156,000.00 cost for those unprovements. City Project improvement incidental costs are apportioned in direct proportion to the City Project improvement cost assessed to a parcel, and the CalOak Acquisition Project incidental costs are apportioned in direct proportion to each parcel's assessed share of the separate improvement system cost to which the incidental work and cost is associated. APPORTIONMENT OF IMPROVEMENT CONTINGENCY The improvement contingency has been estimated at 10% of the improvement cost for the improvements that are a part of the City Construction Project, while the amounts for the Caltrans Construction Project and the CalOak Acquisition Project are assumed to be included in the estimated improvement costs and, therefore, are not assessed separately. The improvement contingency is apportioned in direct proportion to the improvement cost for which the contingency allowance has been provided. RIGHT-OF-WAY AND EASEMENTS ACQUISITION The scope of right-of--way and easements to be acquired consists of only the City Acquisition of the storm drain sump site from CalOak. Pursuant to the appraisal of the AD 93-3 properties and the sump site, dated May 13, 1994, and prepared by Bruce Beaudoin & Associates, Inc., the storm drainage sump parcel to be acquired by AD 93-3 from CalOak is valued at $110,000.00. This acquisition cost includes the appraised value of the 24,000 sf parcel located in the northwest corner of Assessment No. 5 and the estimated cost of site financing. This sump will store storm drain water collected by on- and off-site storm drain facilities for which CalOak is responsible to construct. The amount of $110,000.00 is spread to all benefited AD 93-3 properties in direct proportion to their assessable areas. CONTRIBUTIONS As previously described, the City is participating in funding a portion of the City Construction Project. The total estimated cost of the City funded improvements, together with improvement incidentals and contingency is identified in Item 12-A of Exhibit B, Table B-I, as the City share of contributions. Therefore, no Assessment Proceeding and Bond Issuance Costs are assessed to the City share of the improvements cost. APPORTIONMENT OF ASSESSMENT PROCEEDING EXPENSES AND BOND ISSUANCE COSTS These costs are apportioned in direct proportion to the subtotal cost to assessment (cost of improvements to be constructed and/or acquired, improvement incidentals, contingencies, 29149FER.EXD D-9 06/23/94 rights-of-way, and easements) for all three project benefit groups combined for the AD 93-3 share of these costs. See Exhibit C for a summary of individual amounts assessed to each benefited property. PROJECT ASSESSMENT CONTINGENCY At the time this Engineer's Report was prepared and filed for preliminary approval by the City Council, most parts of all of the three referenced projects were in preliminary or incomplete stages of the design procedure. Therefore, the entire preliminary assessment spread calculation was based on early estimates of all costs for improvements to be constructed and/or acquired. In order to make provision for unavoidable adjustments that may occur in the cost estimates, 15% of the estimated Total Amount Assessed to Bonds was added as a Project Assessment Contingency to each benefited and assessed parcel. The preparation of engineered plans for all of the improvements proposed to be funded by AD 93-3 had, at the time this Engineer's Report was being updated to file for final approval by the City Council, progressed to a point where more accurate cost estimates could be provided by the design engineers than had previously been available. As stated in the preliminarily approved Engineer's Report, it was the intent of this Assessment Spread Method that the Project Assessment Contingency would be eliminated when more accurate costs became available. Accordingly, this contingency has been reduced to zero in this final form assessment. SUMMARY OF PARCEL ASSESSMENT CALCULATIONS Engineer's Report Exhibit C entitled "Engineer's Summary of Individual Assessments," presents the results of the assessment spread calculations for all of the AD 93-3 parcels. It also provides a breakdown of the results of the vehicle trip generation based and of the parcel assessable gross areas based assessment spread data and cost allocations, and the total amount of improvement incidental, assessment proceeding and bond issuance costs apportioned to each parcel. 29149FER.EXD D-10 0623/94 ASSESSMENT ENGINEER'S CERTIFICATION OF THE ASSESSMENT SPREAD METHOD This Engineer's Report has been prepared to present the following: 1. An estimate of the total cost of the Improvements, Acquisitions, and Incidental Costs proposed to be funded pursuant to this assessment proceeding; and 2. An analysis of the benefits of those improvements and a description of the methodology developed to spread the estimated improvement acquisition costs to the AD 93-3 properties in proportion to the estimated benefits that those properties will receive from the improvements. However, this Engineer's Report makes no recommendation as to the economic feasibility for the assessment of the estimated cost of the proposed improvements on the benefited properties, nor on the financial feasibility of the issuance of 1915 Act Bonds to represent any unpaid amount of the AD 93-3 Assessment. The AD 93-3 Assessment may exceed the amount for which bonds can be issued pursuant to recommendation of the City's financial advisor, as to the minimum acceptable property value to assessment lien ratio for bonds issued and secured by AD 93-3 unpaid assessments. Additional property value in excess of the estimated current value of the assessed property with the improvements completed and installed may need to be confirmed by MAI appraisal, before the City can issue 1915 Act Bonds in the full amount of the AD 93-3 Assessment. In conclusion, it is my opinion that the Estimated Total Cost of the proposed improvements, including all incidental costs, has been spread in direct proportion to the estimated benefits that each separate lot, piece, parcel or subdivision of lands within AD 93-3 will receive from the improvements.
