" A description of -the AD 94-2 boundaries and of the properties benefited by the improvements to be acquired is presented below. A detailed description of the improvements proposed to be acquired and of related incidental costs and expenses proposed to be funded by AD 94-2 are presented in Section II of this report. All of the AD 94-2 properties are located within the existing Corporate Limits of the City of Bakersfield (the "City Limits"). GENERAL DESCRIPTION OF BOUNDARIES AND BENEFIT ZONES AD 94-2 is located in the City's southwest area adjacent to the "Campus Park" and the "Oaks" residential community areas. The district site is two miles south of the Stockdale Highway and is generally bounded on the east by Gosford Road, on the south by White Lane, on the west by Pin Oak Park Boulevard, and on the north by South Laurelglen Boulevard. The Arvin-Edison Canal runs diagonally across AD 94-2 from South Laurelglen Boulevard, .southeasterly to Gosford Road and splits the district into two areas that are planned for subdivision into a total of 373 single-family dwelling lots ("R-1 lots"). The AD 94-2 property located southwest of the Arvin- Edison Canal is owned by Castle & Cooke Homes, Inc. ("Castle & Cooke"), an AD 94-2 proponent, and has been approved for subdivision into 290 R-i lots by Tentative Tract No. 5678 ("Ten TR 5678"). According to Castle & Cooke, the 131 R-1 lot initial phase of that sub- division, Tract No. 5678-Phase B ("TR 5678-B"), is to be given final approval by the City Council on December 14, 1994, and pursuant to Castle & Cooke's request, those 131 lots are included in AD 94-2 as separate lot assessments. Castle & Cooke is also the owner of the parcel located northeast of the Arvin-Edison Canal. That parcel is planned for development into 83 R-1 lots, as shown on their proposed Tentative Tract No. 5679 subdivision map ("Ten. TR 5679"), 29177FER.I I-1 11/21/94 which has, as of the date of filing this Engineer's Report, not been approved by the City Planning Commission. The scope of improvements planned to be financed by AD 94-2 and shown in the form of this AD 94-2 Engineer's Report (the "Engineer's Report") preliminarily approved on October 12, 1994, by City Council adoption of its Resolution No. 164-94, included the acquisition of "off- site" improvements and incidental costs that are either already required or that are expected by Castle & Cooke to be required to be installed as conditions of final map approval for Ten TR 5678 and Ten TR 5679. However, after adoption of Resolution No. 164-94 but prior to the December 14, 1994 Protesting Hearing on AD 94-2 set by Resolution No. 164-94, Castle & Cooke requested that the Ten TR 5679 "off-site" improvement acquisitions and existing AD 82-1 assessment refinancing for the Ten TR 5679 property be removed from the scope of the AD 94-2 final assessment. In accordance with the Castle & Cooke request, the AD 94-2 assessment contained in the Engineer's Report apportions no cost and assessment to the Ten TR 5679 property. In addition, the TR 5678-B R-1 lots have been added to the AD 94-2 assessment since the adoption of Resolution No. 164-94. AD 94-2 is located in the northeast quarter of Section 17 ("T 30 S, R 27 E"), Mount Diablo Base & Meridian ("MDB&M") and encompasses a land area of about 84 acres. There are no special benefit zones within AD 94-2, wherein a separate scope of improvements would be acquired that would benefit only the parcels located within the designated zone. On September 7, 1994, the City Council adopted its Resolution No. 154-94, Resolution Approving Boundary Map, Assessment District No. 94-2. The AD 94-2 boundaries are shown and described on the map entitled "PROPOSED BOUNDARIES OF CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 94-2 (GOSFORD/WHITE), COUNTY OF KERN, STATE OF CALIFORNIA" (herein "AD 94-2 Boundary Map") consisting of three (3) sheets, on file in the office of the City Clerk. Reference is made to the AD 94-2 Boundary Map for a detailed description of the AD 94-2 boundaries. A reduced and not to scale copy is attached hereto as Engineer's Report Appendix A and incorporated herein by reference. ENVIRONMENTAL REVIEW STATUS Pursuant to the Charter and Municipal Code of the City of Bakersfield (herein "Municipal Code"), the formation of an assessment district is exempt from compliance with the California Environmental Quality Act ("CEQA"). Accordingly, a Notice of Exemption from CEQA will be filed by the City for the AD 94-2 proceedings prior to confirmation of the AD 94-2 assess- ment by the City Council. ENGINEER'S REPORT SUBMITTAL STATEMENT I, Raul M. Rojas, Public Works Director and Superintendent of Streets of the City of Bakers- field, have been appointed the Engineer of Work for AD 94-2 (herein "Engineer of Work") by adoption of City Council Resolution of Intention No. 1123 to do and perform all services in 29177FER.I I-2 11/21/94 making preliminary surveys, preparing plans, estimates of costs, and diagram and assessment. Pursuant to the provisions of the Municipal Improvement Act of 1913, (herein "1913 Act"), being Division 12 of the California Streets and Highways Code, and to Section 10204 contained therein, and pursuant to the Municipal Code and in accordance with Resolution of Intention No. 1123, being a Resolution of Intention to order the acquisition of improvements, City of Bakersfield Assessment District No. 94-2 (Gosford/White) (herein "Resolution of Intention No. 1123"), I herewith submit the "Engineer's Report" for AD 94-2 consisting of six parts as follows: 1. PLANS AND SPECIFICATIONS, MAPS AND DESCRIPTIONS OF IlVIPROVEMENTS AND LANDS TO BE ACQUIRED: A. Improvements to Be Acquired: At the time -this Engineer's Report was being prepared for filing with the City Clerk and for final approval by the City Council, all of the plans and specifications for the improve- ment acquisitions to be funded by AD 94-2 had not been completed and/or finally approved by the City Engineer. Therefore, this assessment is based on the cost estimates prepared from the approved improvement plans for Ten TR 5678 Phases A through D, and from schematic improvement plans for Ten TR 5678 Phase E. The acquisition cost estimates have been reviewed and approved by Martin-McIntosh Engineering, the subdivision design engineer hired by Castle & Cooke, that is hereinafter referred to as the "AD 94-2 Subdivision Engineer. " The ilprovements funded by AD 94-2 are to be constructed by Castle & Cooke and acquired by the City, pursuant to a proposed acquisition agreement between the City and Castle & Cooke (the "Castle & Cooke Acquisition Agreement"). B. Maps and Descriptions of Lands, Easements, and Rights-of--way and Existing Facilities Capacity and Use Rights to Be Acquired: As of the date of filing this Engineer's Report there were no land, easement, or rights- of-way acquisitions proposed to be financed by AD 94-2. Accordingly, no maps or descriptions have been prepared and filed with the City Engineer. 2. GENERAL DESCRIPTION OF WORK AND ACQUISITIONS: A General Description of Work and Acquisitions to be completed pursuant to the AD 94-2 proceedings is included as Section II of this Engineer's Report. 3. ESTIMATE OF TOTAL ASSESSMENT DISTRICT IMPROVEMENT ACQUISITION, AND INCIDENTAL COSTS: A "Statement of Total Assessment" is presented in Section III of this report. An itemized breakdown of the estimated total ilnprovement acquisition and incidental costs and expenses 29177FER.I I-3 11/21/94 including the estimated cost of preparing, printing, registering, servicing, and collecting bonds issued pursuant to these proceedings is included in Exhibit B, Table B-I, "Engineer's Estimate of Total Cost and Assessment" ("Table B-I"), attached hereto. 4. ASSESSMENT DIAGRAM: The diagram entitled "ASSESSMENT DIAGRAM OF CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 94-2 (GOSFORD/WHITE), COUNTY OF KERN, STATE OF CALIFORNIA" (herein "AD 94-2 Assessment Diagram"), consisting of three (3) sheets, is on file with the City Clerk and incorporated herein by reference. The AD 94-2 Assessment Diagram being too bulky to be bound with this Engineer's Report, a reduced and not to scale copy is attached hereto as Engineer's Report Appendix B. The AD 94-2 Assessment Diagram shows all of the following: A. The exterior boundaries of AD 94-2; B. The boundaries of any special benefit zones within AD 94-2, there being none; C. By reference to the Maps of the Assessor of the County of Kern and to maps and deeds of record and to the approved, unrecorded Tract No. 5678-Phase B (TR 5678-B) map, the lines and dimensions of each separate lot, parcel, and subdivision of land within AD 94-2 as they existed at the time of Approval of this Engineer's Report by the City Council, each lot, parcel, and subdivision of land having been assigned a separate assessment number upon the AD 94-2 Assessment Diagram; and D. The assessment numbers assigned to each separate lot, parcel, and subdivision of land as shown on the AD 94-2 Assessment Diagram correspond with the numbers shown on the AD 94-2 Assessment Roll (Exhibit A contained herein). 5. PROPOSED ASSESSMENT AND ASSESSMENT ROLL: A. A proposed assessment of the estimated total improvement acquisition cost and incidental expenses in connection with the AD 94-2 proceedings is presented in Section III of this Engineer's Report. B. Assessment Roll: An Assessment Roll for AD 94-2 is attached hereto as Exhibit A. The Assessment Roll shows the exact amount of the total estimated cost of -the proposed improvement acquisition and incidental cost that is assessed upon each of the lots and parcels within AD 94-2 in proportion to the estimated benefits to be received from those improvements. The assessment numbers that appear on the Assessment Roll correspond to the diagram numbers shown on the AD 94-2 Assessment Diagram. 29177FER.I I-4 11/21/94 C. Maximum Annual Parcel Assessment for Recovery of Assessment District Administration Costs and Expenses: Section III of this Engineer's Report includes a statement of the proposed maximum annual assessment upon each of the parcels in AD 94-2. The purpose of this separate annual assessment is to pay the costs incurred by the City of Bakersfield, and not otherwise reimbursed, which result from the administration and collection of assessments or registration of any associated bonds and reserve or other related funds. This maximum annual assessment is proposed to be levied pursuant to Subdivision (f) of Section 10204 of the California Streets and Highways Code (the "Streets and Highways Code"). 6. ASSESSMENT SPREAD METHOD: A description of the assessment spread method used to apportion the total estimated cost proposed to be fmanced for the acquisition of improvements and incidental costs to each parcel in AD 94-2, in direct proportion to the estimated benefits received by each parcel, respectively, from those improvements is attached hereto as Exhibit D and incorporated herein by reference. DESCRIPTION OF ENGINEER'S REPORT EXHIBITS A. B. AND C Exhibits A, B, and C that are attached to this Engineer's Report include a total of 6 tables of AD 94-2 parcel assessments, cost estimates and/or assessment spread cost allocations. A brief description of each of the three report exhibits and of the separate tables contained in each exhibit is presented below. Engineer's Report Exhibits A through C have been designed for the purpose of presenting astep- by-step breakdown of how the AD 94-2 total assessment has been spread to the individual lots and parcels that are proposed to be assessed. The exhibits and their tables begin with: 1. A listing in Exhibit A, Assessment Roll, of the exact amount proposed to be assessed to every existing parcel or lot in AD 94-2; then, 2. The Exhibit B tables present the major items of total system costs and incidental expenses for all of AD 94-2 (Table B-I), the breakdown of those major items to show their cost share details for the Ten TR 5678 off-site improvements (Table B-II-A) and for the Ten TR 5679 off-site improvements (Table B-II-B) that are proposed to be acquired. All item costs in Table B-II-B are zero, pursuant to the Castle & Cooke request to remove Ten TR 5679 acquisitions from the scope of AD 94-2 financing. Table B-III-B presents a separate itemized statement of the total cost, as calculated by the City Finance Office, to pay off existing AD 82-1 Assessment 3083. That assessment payoff cost is proposed to be fmanced by AD 94-2. Table B-III-A showed the pay-off calculations for existing AD 82-1 Assessment 2166. That assessment pay-off cost has also been removed 29177FER.I I-5 11/21/94 from AD 94-2 at the request of Castle & Cooke. Accordingly, Table B-III-A is not included in this final form of the Engineer's Report; and 3. Exhibit C shows how every item of AD 94-2 improvement system acquisition cost, fees, and incidental expense shown in the Exhibit B Tables has been spread among the existing AD 94- 2 parcels and lots. Since all of the AD 94-2 parcels are involved in the process of subdivision and development into R-1 lots, it is the intent of this Engineer's Report that the Exhibit C table shows how the existing parcel assessments will be segregated and apportioned to the planned new R-1 lots that will be created as the existing parcels are subdivided. The detailed spread calculations shown in Exhibit C are based on the number of lots planned by Castle & Cooke for development within each proposed phase of Ten TR 5678, according to the maps and information available at the time this Engineer's Report was prepared. For the purpose of future apportionments, Exhibit C provides data on the total original assessment share to be apportioned to each individual lot in Ten TR 5678. Exhibit C shows a $0.00 amount as the Ten TR 5679 "Final Assessment Per Lot," in accordance with the deletion from AD 94-2 of the improvement acquisitions for that future subdivision. A description of the assessment segregation and apportionment process for the future R-1 lots to be subdivided from the existing AD 94-2 assessed parcel configurations is presented in Engineer's Report Exhibit D. The tables in Exhibits A, B, and C have been structured in hierarchical levels of cost and assessment spread data, with Exhibit A showing the final parcel assessment totals and Exhibit C the parcel assessment details. The concept of this structure is that a property owner in AD 94-2 can look through the Engineer's Report data tables to find his property's total assessment amount shown in Exhibit A and then continue on a step-by-step progression in the Exhibits B and C tables to find the assessment spread details for that parcel and all other parcels in AD 94-2. 29177FER.I I-6 11/21/94 ENGINEER'S REPORT CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 94-2 (GOSFORD/WHITE) SECTION II GENERAL DESCRIPTION OF WORK AND ACQUISITIONS PROJECT DESCRIPTION The separate improvement systems to be acquired and their related incidental work and costs eligible for financing pursuant to the AD 94-2 proceedings (hereinafter the "Improvements") aze described below. The descriptions of the Improvements and the termini of the proposed work do not necessarily extend for the full length of their description. The plans and profiles of the Improvements shall be controlling as to their correct and detailed description. The general scope of the Improvements includes the acquisition of public infrastructure improvements that will be owned, operated, and maintained by the City, the payment of certain regulated public utility improvement costs, financing of the cost to pay off existing AD 82-1 Assessment 3083, and the payment of certain improvement, assessment proceeding and bond issuance incidental costs and expenses related to the AD 94-2 Improvement acquisitions. ^ The AD 94-2 Proposed Subdivisions All of the AD 94-2 Improvement acquisitions and private utility construction costs involve work and expense that are either required or expected by Castle & Cooke to be required as conditions of final map approval for the tentative subdivision map overlaying the AD 94-2 parcels southwest of the Arvin-Edison Canal. They are described as follows: A. Ten TR 5678 overlays all of the benefited AD 94-2 property located southwest of the Arvin- Edison Canal. The subdivision was approved by the City Planning Commission on April 21, 1994, for the development of 289 R-1 lots in five phases (Phases A through E). However, the proposed final form maps for TR .5678 Phases A through E show a combined total of 290 R-1 lots. The revised subdivision design will meet the Ciry requirement that 80% of the lots in a small subdivision be smaller in area than the 6,000 square foot minimum that applies to a standazd subdivision. The AD 94-2 Assessment spread is based on the planned development of 290 R-1 lots in Ten TR 5678. Engineer's Report Exhibit C, "Engineer's Summary of Individual Assessments," attached hereto and incorporated herein by reference, lists the total number of R-1 lots shown on each of the five (5) subdivision phase maps for Ten TR 5678. The parcel covering Ten TR 5678 Phases A, C, D, and E is shown on the AD 94-2 Assessment Diagram and on the AD 94-2 Assessment Roll as Assessment 5. Tract No. 29177FER.II II-1 11/21/94 5678-Phase B (TR 5678-B) is planned for approval by the City Council on December 14, 1994, and will be recorded prior to recordation of the AD 94-2 Assessment. Assessment Nos. 6 through 141- are assigned to the TR 5678-B lots shown on the fmal unrecorded TR . 5678-B map provided by the subdivision engineer. The boundaries of the five phases within Ten TR 5678 are shown on Exhibit E ("Sketch Map of Proposed Tract No. 5679 and of Proposed Tract No. 5678 Phases A Through E (Showing Total Number of Residential Lots Per Tract or Tract Phase)"). All of Ten TR 5678 is subject to an existing special assessment lien for AD 82-1 (Assessment 3083), and AD 94-2 will finance the cost to pay off the remaining principal amount of that existing assessment. B. Proposed Ten TR 5679 overlays all of the AD 94-2 benefited property located northeast of the Arvin-Edison Canal. However, as stated in Section I of this Engineer's Report, after the Engineer's Report for AD 94-2 was "Preliminarily Approved" by City Council Resolution No. 164-94 on October 12, 1994, Castle & Cooke decided to eliminate the Ten TR 5679 off-site improvements from the AD 94-2 fmancing. The Ten TR 5679 parcel is shown on the AD 94-2 Assessment Diagram and Assessment Roll as Assessments 1 through 4. Since those assessments will not benefit from the improvements funded by AD 94-2, they are apportioned a zero assessment amount, as shown on Exhibit A, Assessment Roll. ^ Acquisition Agreement: AD 94-2 Improvements As stated in Section I, the AD 94-2 Improvements are proposed to be acquired by the City in accordance with the terms and conditions of the proposed Castle & Cooke Acquisition Agreement. That agreement will define the specific scope of Improvements that are to be constructed and installed by Castle & Cooke and, upon their completion, be acquired by the City using funds provided through the AD 94-2 proceedings. DESCRIPTION OF PROJECT IMPROVEMENTS. INCIDENTAL WORK AND ANNUAL ASSESSMENT Separate general descriptions are presented below of the proposed improvement acquisitions, of any incidental work and expense to be financed by AD 94-2 that is related to the improvement system acquisitions or to the AD 94-2 proceedings, and of the proposed annual assessment to be levied by AD 94-2 for the recovery of certain costs that may be incurred by the City in future years from the administration of the AD 94-2 bonds and reserve fund. ^ General Description of AD 94-2 Improvement Acquisitions The AD 94-2 Improvements proposed to be acquired include the construction and installation as separate improvement systems of the public improvements and private utility company facilities, City facilities capacity charges or fees, and incidental work described below. The Improvements are to be constructed in accordance with plans and specifications prepared by the AD 94-2 29177FER.II II-2 11/21/94 Subdivision Engineer and as approved by the City Engineer. As stated above in Section II, the plans and specifications for all of the Improvements had not been completed and/or fmally approved by the City Engineer at the time this Engineer's Report was prepared. Accordingly, the following description of-work is based on schematic, preliminary, and/or approved plans, quantities, and estimates that have been reviewed and confirmed by the AD 94-2 Subdivision Engineer. The separate improvement systems to be acquired pursuant to the AD 94-2 proceedings are as follows: A. Tentative Tract No. 5678 Off-site Improvements to Be Acquired: 1. Sewer System Improvements a. The 1913 Act further requires that the cost of the assessment be apportioned to the individual parcels in proportion to the estimated benefit that each parcel can be expected to receive from the work and improvements covered by the assessment. The City Council appointed the Director of Public Works as the Engineer of Work for AD 94-2 by adoption of Resolution of Intention No. 1123 on September 7, 1994. On August 10, 1994, the City Council adopted its Resolution No. 130-94 approving Agreement No. 94-153 with Edward J. Wilson, a Registered Civil Engineer, appointing him as the Assessment Engineer for AD 94-2. The Assessment Engineer has been retained by the City to prepare an Engineer's Report on the proposed assessment that will include, in part, an analysis of the facts in AD 94-2 and the development of a method of apportioning the total amount of the costs and expenses of the proposed improvements to the several subdivisions of land located within AD 94-2, in proportion to the estimated benefits to be received by each such subdivision, respectively, from the improvements. AD 94-2 has been formed pursuant to a property owner petition, requesting the City Council to waive further proceedings under Division 4 of the Streets and Highways Code and to undertake proceedings pursuant to the 1913 Act. The petition is on file with the City Clerk. On August 10, 1994, the City Council adopted its Resolution No. 128-94, "Accepting Petition and Determining to Undertake Special Assessment Proceedings. " ASSESSMENT DISTRICT PURPOSE AD 94-2 has been formed for the purpose of financing the private property beneficial cost share for the acquisition of certain public improvements within AD 94-2. A description of AD 94-2 is presented in Section I of the "Engineer's Report, City of Bakersfield Assessment District No. 94-2 (Gosford/White)," hereinafter referred to as the "AD 94-2 Engineer's Report." A detailed description of those improvement acquisitions is presented in AD 94-2 Engineer's Report Section II. The AD 94-2 proceedings will confnm an assessment for the estimated total cost of the improvements to be acquired pursuant to the 1913 Act and the Municipal Code. The City 29177FER.EXD D-1 11/21/94 proposes to issue bonds under the 1915 Act, secured by the unpaid assessments, to pay the cost to acquire the improvements and pay all incidental costs and expenses related thereto and authorized for funding by the 1913 Act. NON-BENEFITED AND NON-ASSESSED PARCELS There are nine (9) non-benefited and non-assessed parcels in AD 94-2, described as follows: Assessments 1, 2, and 3 (identified as parcels 2, 3, and 4 of Parcel Map No. 7333) are landscape easement parcels owned by Castle & Cooke Homes, Inc. They are located within Ten TR 5679 along Gosford Road and South Laurelglen Boulevard. In the AD 94-2 Financing Proposal prepared July 19, 1994, the referenced parcels are shown as being combined with Parcel 1 of Parcel Map No. 7333 (Assessment 4) and resubdivided by Ten TR 5679 into landscape easement lots A, B, and C. Pursuant to the Castle & Cooke decision to eliminate all Ten TR 5679 off-site improvements from the district, none of the assessments covered by Ten TR 5679 (Assessments 1 through 4) are benefitted by the improvements described in AD 94-2 Engineer's Report Section II and are, accordingly, not apportioned a share of the AD 94-2 assessment. Assessments 137 through 141 in Tract No. 5678-Phase B (TR 5678-B) are all non-residential, non-buildable parcels that are classified herein as non-benefited by the AD 94-2 improvements and are, accordingly, not assessed a share of the AD 94-2 total cost and are described as follows: a. Assessment 137: A park lot that will provide all Ten TR 5678 parcels access to the existing City owned Garden Park; b. Assessments 138 & 139 Landscape lots, provided for construction of block wall and landscaping along the west right-of--way for Gosford Road along the eastern Ten TR 5678 frontage; c. Assessment 140: Non-buildable easement lot within existing PG&E power easement. d. Assessment 141: Non-buildable lot between TR 5678-B residential lots and existing Arvin-Edison Canal; and ASSESSMENT SPREAD METHOD A description of the methodology used to apportion the costs of the AD 94-2 acquisitions and of the incidental work, cost, and expenses of the AD 94-2 assessment proceedings is presented below. 29177FER.EXD D-2 12/01/94 Description of AD 94-2 Benefits It is the Assessment Engineer's responsibility to identify the benefits that the AD 94-2 parcels will receive from the Improvements proposed to be acquired. The benefits to the lots -and parcels in AD 94-2 are described as follows: Pursuant to the proposed Castle & Cooke Acquisition Agreement referenced in Section I of the AD 94-2 Engineer's Report, AD 94-2 will finance the acquisition of certain improvements and the payment of City improvement fees and costs required as conditions of final subdivision map approvals related to the approved Ten TR 5678 subdivision map that overlays the AD 94-2 parcels located to the southwest of the Arvin-Edison Canal. Improvements proposed to be financed pursuant to the AD 94-2 proceedings are to provide direct benefit to the area proposed to be developed by-Ten TR 5678. The improvements to be acquired are either already required or are expected by Castle & Cooke to be required to be installed as conditions of fmal map approval for Ten TR 5678. ^ The primary categories of direct bene,~t provided by the separate systems of Ten TR 5678 off-site improvements proposed to be acquired, as they are described in detail in Section II of this AD 94-2 Engineer's Report, are as follows: 1. Sewer System Improvements Those improvements will provide the Ten TR 5678 parcel with connections to sewer mains in Gosford Road and Pin Oak Park Boulevard, as a partial fulfillment of the subdivision approval requirements to provide the tract with connections to the existing sewer mains. The improvements in Gosford Road will benefit only Phases A through D of Ten TR 5678, and the improvements in Pin Oak Park Boulevard will benefit only Phase E of Ten TR 5678. 2. Water System Improvements: Those improvements will provide the Ten TR 5678 parcel with connections to water mains in Gosford Road, White Lane, and Pin Oak Park Boulevard, as a partial fulfillment of the subdivision approval requirements to provide the tract with connections to the existing water mains. Two connections in Pin Oak Park Boulevard (at Salix Court and ,Dove Tree Way) will benefit only Ten TR 5678 Phase E, while the remaining Water System Improvements will benefit the entire Ten TR 5678. 3. Storm Drain System Improvements: The proposed storm drain system acquisitions will provide both off-site frontage street drainage along Pin Oak Park Boulevard and in-tract street drainage only for Phase E of Ten TR 5678. The Phases A through D areas and the Gosford Road/White Lane Ten. TR 5678 frontages will not receive street drainage benefits from these improvements. 29177FER.EXD D-3 11/21/94 4. Street System Improvements: The improvements planned to be installed as Ten TR 5678 off-site street improvements include sidewalk, curb returns, handicap ramps, street lights with conduits and street signs along the tract frontages along Gosford Road, White Lane, and Pin Oak Park Boulevard, and are more particulazly described in Section II of the AD 94-2 Engineer's Report. As a part of the Street System Improvement benefit category, left and right turn lanes will be installed in Gosford Road at Ficus Drive, and a right turn lane in White Lane at Umbrella Pine Way. Those improvements will provide. for patial mitigation of traffic impacts related to the buildout of the lots in Ten TR 5678 and as partial fulfillment of the subdivision approval requirements to complete the tract frontage streets to their full master- planned configuration. 5. Miscellaneous Improvements Improvements classified as "Miscellaneous Improvements" by the AD 94-2 Subdivision Engineer include the block wall and landscaping strip along the outer perimeter of TR 5678 in Gosford Road, White Lane, and Pin Oak Park Boulevard, and also along Persimmon Drive within the Ten TR 5678 power line easement held by Pacific Gas & Electric Company ("PG&E"). A "view" wall will be constructed instead of a portion of the block wall in Gosford Road, and this "view" wall is not a part of the AD 94-2 financing. Miscellaneous Improvements also include the landscaping of the Garden Park access along the northwesterly boundary of Ten TR 5678 and aze, collectively, also improvements being installed as partial fulfillment of the subdivision approval requirements to complete the tract frontage streets. ^ As described in Sections I through III of the AD 94-2 Engineer's Report, pursuant to Castle & Cooke's request, all of the Ten TR 5679 off-site improvements have been removed from the AD 94-2 Scope of Work. Spread of AD 94-2 Costs to Benefited Parcels In accordance with the 1913 Act and subpazagraph (e) of Section 10204 as contained therein, the total cost and expense of the improvements to be financed aze required to be spread among the properties in the district in proportion to the estimated benefits each pazcel will receive from the improvements. All of the existing AD 94-2 pazcels except the lots in Tract No. 5678-Phase B ("TR 5678-B") are unsubdivided, existing APN's that are, in effect, interim pazcel configurations for properties that are currently involved in the land development process. The basis for this statement is that all of the AD 94-2 parcels have been approved or are planned for submittal to be approved for subdivision into single-family dwelling lots by two tentative tract maps as follows: 29177FER.EXD D-4 11/21/94 1. Tentative Tract 5678 overlays the entire AD 94-2 area southwest of the Arvin-Edison Canal. As stated in Section II of the AD 94-2 Engineer's Report, Ten TR 5678 is planned for development of 290 R-1 lots. A total of 131 residential lots have been approved in TR 5678-B (Assessments 6 through 136), and 159 residential lots are planned for development in phases A, C, D, and E, as shown on the AD 94-2 Engineer's Report Exhibit E. 2. Tentative Tract 5679 overlays all of AD 94-2 Assessments 1, 2, 3, and 4. As described earlier in this Exhibit D, Assessments 1, 2, and 3 are landscape easement parcels. Ten TR 5679 is planned for development of 83 R-1 lots. As also described earlier in this Report, all of the Ten TR 5679 Assessments (1 through 4) are assessed a zero assessment since no off-site improvements for that tract will be funded by AD 94-2. O Basis for AD 94-2 Assessment Spread As stated earlier in this Exhibit D, all of the improvements to be acquired and financed by the AD 94-2 proceedings are required or are expected by Castle & Cooke to be required to be installed as conditions of fmal map approval for Ten TR 5678. Accordingly, the tentative tract approval conditions are referenced as the basis for spreading the AD 94-2 improvement system acquisition costs. Therefore, the total cost of Ten TR 5678 off- site improvements and incidentals is assessed to Assessments 5 through 141. The Engineer's Itemized Estimates of that cost is presented in Exhibit B, Table B-II-A. O Spread of Assessed Tentative Tract Total Costs to Tract Phases and Individual Lots As the Ten TR 5678 Phases A, C, D, and E maps are recorded to subdivide AD 94-2 Assessment 5 into R-1 lots, the total system acquisition cost share assessed to this tentative tract parcel in accordance with the spread methodology described above will need to be segregated and apportioned to the new subdivision lots. The method of apportioning each tentative tract's total assessed cost share to its internal tract phases and then of spreading the tract phase costs to the future lots that will be developed within each phase is described below for each of the two tentative tracts. In this assessment spread method, a tentative tract's total cost share has been spread to that tract based on its existing and/or expected final map approval improvement requirements. The method used for spreading each tentative tract's total cost share among its phases and, fmally to the future lots that will be recorded within the tentative tract phases is based on each tract's estimated total number of R-1 lots as follows: a. The total Ten TR 5678 share, with the exception of its Storm Drain System Improvements and portions of Sanitary Sewer and Water System Improvements cost shares, is spread to its phases (A through E) in direct proportion to the proposed number of R-1 lots within each phase. The Ten TR 5678 Storm Drain System benefits only the Phase E portion of Ten TR 5678, and the total cost of those improvements, accordingly, is apportioned to the 29177FER.EXD D-5 11/21/94 Phase E area. The Sanitary Sewer System in Gosford Road benefits only Phases A through D, and the Sanitary Sewer System in Pin Oak Park Boulevard benefits only the Phase E portion of Ten TR 5678. Those improvements are spread separately to Phases A through D and Phase E, respectively. The Water System Improvements in Salix Court and Dove Tree Way will provide benefits only to Phase E of Ten TR 5678, and the total cost of those improvements, accordingly, is apportioned to the Phase E area. All other Water System Improvements (in Gosford Road at Ficus Drive, in White Lane at Umbrella Pine Way, and in Pin Oak Park Boulevard at Persimmon Drive) will benefit the entire Ten TR 5678, providing for the future, looped, in-tract water system. This portion of the Water System Improvements is spread to all Ten TR 5678 phases in direct proportion to the proposed number of lots within each phase. When each individual phase (A, C, D, and E) is recorded, its assessment share will be apportioned to each new lot within a phase on an equal-per-lot basis, since each individual lot will receive the same level of benefit from the tract off-site improvements to be fmanced by AD 94-2. The Phase B share of the Ten TR 5678 total assessment has already been apportioned to 131 residential lots (Assessments 6 through 136), since this phase of TR 5678 is planned to be recorded prior to the recordation of the AD 94-2 Assessment. b. As described above, all of Ten TR 5679 off-site improvements preliminarily planned to be acquired have been deleted from AD 94-2. Therefore, there is no assessment apportioned to Ten TR 5679 Assessments 1 through 4. Exhibit E of the AD 94-2 Engineer's Report, "Sketch Map of Proposed Tract No. 5679 and of Proposed Tract No. 5678 Phases A Through E (Showing Total Number of Residential Lots Per Tract or Tract Phase)" shows the boundaries of the planned five tract phases in Ten TR 5678, and also lists the proposed number of R-1 lots within each phase and in Ten TR 5679. Exhibit C the of AD 94-2 Engineer's Report ("Engineer's Summary of Individual Assessments") provides a detailed break down of how the tentative tract shares have been apportioned to the planned tract phases. O Spread of Cost to Refinance Existing AD 82-1 Assessments The cost to refmance the one existing AD 82-1 Assessments is spread as follows: 1. The total cost to pay off the existing fixed special assessment lien of record for AD 82-1 Assessment 3083, encumbering the parcel described as Kern County APN 391-010-34 (AD 94-2 Assessments 5 through 141), is financed as part of the total AD 94-2 assessment. The amount of remaining principal balance for Assessment 3083, effective July 1, 1995, assuming that both 1994/ 1995 debt service installments for Assessment 3083 billed on the 1994/1995 Kern County Property Tax Bill for the parcel will be paid by April 30, 1995, plus the total amount of all the estimated charges and credits associated with the payoff and release of lien for Assessment 3083 are itemized and shown on Table B-III-B, Payoff Calculation for Assessment District No. 82-1 Assessment 3083 in AD 94-2 Engineer's Report Exhibit B ("Table B-III-B"). 29177FER.EXD D-6 11!21/94 AD 94-2 Assessment Diagram sheets 2 of 3 and 3 of 3, attached as AD 94-2 Engineer's Report Appendix B, show that AD 82-1 Assessment 3083 covers all of AD 94-2 Assessments 5 through 141. APN 391-010-34 is also the same property area referred to in this Assessment Spread Method as Ten TR 5678. Therefore, the total AD 82-1 Assessment 3083 payoff cost is assessed to AD 94-2 Assessments 5 through 136 as an equal share per existing or per planned R-1 lot, since Assessments 137 through 141 are non-benefited parcels. The Assessment 5 share will be segregated and apportioned on anequal-per-lot basis to the future Ten TR 5678 Phases A, C, D, and E R-1 lots. 2. Pursuant to Castle & Cooke's decision, the total cost to pay off the existing fixed special assessment lien of record for AD 82-1 Assessment 2166, encumbering the parcel described as Kern County APN 389-010-17 (AD 94-2 Assessment 4), is not financed as part of the total AD 94-2 assessment. O Spread of AD 94-2 Assessment Proceeding Costs, Contributions and Bond Issuance Costs The method used to spread the AD 94-2 incidental costs and expenses related to the assessment proceedings is described below, along with a description of how any AD 94-2 contributions have been credited to the benefited parcels. 1. Spread of AD 94-2 Assessment Proceeding Incidental Cost and Expense The total amount of all of the Ten TR 5678 and Ten TR 5679 Improvement, Incidental, Contingency, and Additional Cost/Fees to be financed by AD 94-2 is stated in line 12.C of Table B-I, and the total cost shares for the Ten TR 5678 and Ten TR 5679 are itemized in lines 12.A and 12.B of Table B-I. An itemized list of "Estimated Assessment Proceeding Incidental Cost and Expense" for AD 94-2 is presented in lines 13. A through 13. G of Table B-I. All of the costs stated in Table B-I, lines 12.A and 12.B have been spread in proportion to parcel benefit from the improvements and costs proposed to be financed by AD 94-2. The AD 94-2 Assessment Proceeding Costs are to be incurred to make special assessment financing available for the improvements and costs to be funded. Therefore, it is the fording of this Assessment Spread Method that the AD 94-2 parcels are benefited by the Assessment Proceeding Costs in proportion to the total improvement and other costs assessed to each parcel. In accordance with this fording, the Table B-I line 13. G, Total Estimated Assessment Proceeding Incidental Cost and Expense, is spread to Ten TR 5678 and Ten TR 5679 in proportion to their total improvement and other costs assessed, as shown in lines 12.A and 12.B of Table B-I. The apportioned assessment proceeding cost share for each Assessment in Ten TR 5678 and Ten TR 5679 is shown in Exhibit C. 29177FER.EXD D-7 11/21/94 2. Spread of AD 94-2 Contributions Table B-I line 14 states the total amount proposed to be assessed to finance the estimated cost of Improvements, Additional Fees, and Assessment District Expenses and line 15 separately states the amounts of any "Contributions and Cash Collections" to reduce the cost to assessment for Ten TR 5678 and Ten TR 5679. The- Contribution amounts are deducted from the Ten TR 5678 or Ten TR 5679 line 14 total cost amounts and the net amount shown on line 16 is the total cost to 1915 Act Bond Financing. The separate contribution and cash collection amounts are credited to the parcel for which the cash payment or contribution was made, to reduce that parcel's share of the total cost to bond issuance. The apportioned contribution share for each Assessment in Ten TR 5678 and Ten TR 5679 is shown in Exhibit C. 3. Spread of AD 94-2 Bond Issuance Costs The AD 94-2 estimated Bond Issuance Costs are shown in line 17 of Table B-I. These costs are based on the actual cost of improvements and incidental expense to be financed and, accordingly, they are spread to each Assessment in proportion to the parcel's net total improvement and incidental cost share remaining after deducting any contribution. Each Assessment's Bond Issuance Cost share is shown in Exhibit C under the Bond Issuance_ Cost column. O Calculation of AD 94-2 Parcel Total Assessments The total cost shares spread to each parcel for nnprovements, incidental expenses, fees, assessment proceeding, and bond issuance costs to be financed are added and the contribution amounts subtracted, to calculate each parcel's total assessment. Parcel total assessment amounts are shown in Exhibit C and in Engineer's Report Exhibit A, Assessment Roll for AD 94-2. 29177FER.EXD D-8 1 I/21/94 ASSESSMENT ENGINEER'S CERTIFICATION OF THE ASSESSMENT SPREAD METHOD This Engineer's Report has been prepared to present the following: 1. An estimate of the total cost of the improvements to be acquired, and incidental costs proposed to be funded pursuant to this assessment proceeding; and 2. An. analysis of the benefits of those improvements and a description of the methodology developed to spread the estimated improvement acquisition costs and incidental expenses to the AD 94-2 properties in proportion to the estimated benefits that those properties will receive from the improvements. However, this Engineer's Report makes no recommendation as to the economic feasibility for the assessment of the estimated cost of the proposed improvements on the benefited properties, nor on the financial feasibility of the issuance of 1915 Act Bonds to represent any unpaid amount of the AD 94-2 Assessment. The AD 94-2 Assessment may exceed the amount for which bonds can be issued pursuant to recommendation of the City's fmancial advisor, as to the minunum acceptable property value to assessment lien ratio for bonds issued and secured by AD 94-2 unpaid assessments. Additional property value in excess of the estimated current value of the assessed property with the improvements completed and installed may need to be confirmed by MAI appraisal, before the City can issue 1915 Act Bonds in the full amount of the AD 94-2 Assessment. In conclusion, it is my opinion that the Estimated Total Cost of the proposed improvement acquisitions, including all incidental costs, has been spread in direct proportion to the estimated benefits that each separate lot, piece, parcel or subdivision of lands within AD 94-2 will receive from the improvements. The Assessment Engineer -has been retained by the Ciry to prepare an Engineer's Report on the proposed assessment that will include, in part, an analysis of the facts in AD 94-2 and the development of a method of apportioning the total amount of the costs and expenses of the proposed improvements to the several subdivisions of land located within AD 94-2, in. proportion to the estimated benefits to be received by each such subdivision, respectively, from the improvements. AD 94-2 has been formed pursuant to a property owner petition, requesting the City Council to waive further proceedings under Division 4 of the Streets and Highways Code and to undertake proceedings pursuant to the 1913 Act. The petition is on file with the Ciry Clerk. On August 10, 1994, the Ciry Council adopted its Resolution No. The City 29177PER.EXD D-1 09/29/94 proposes to issue bonds under the 1915 Act, secured by the unpaid assessments, to pay the cost to acquire the improvements and pay all incidental costs and expenses related thereto and authorized for funding by the 1913 Act. NON-BENEFITED AND NON-ASSESSED PARCELS There are three (3) non-benefited and non-assessed parcels in AD 94-2, described as follows: Assessments 1, 2, and 3 (identified as parcels 2, 3, and 4 of. Parcel Map No. As existing and planned landscape easement lots, those parcels are not benefited by the improvements described in the AD 94-2 Engineer's Report Section II and are, accordingly, not apportioned a share of the AD 94-2 Assessment. ASSESSMENT SPREAD METHOD A description of the methodology used to apportion the costs of the AD 94-2 acquisitions and of the incidental work, cost, and expenses of the AD 94-2 assessment proceedings is presented below. Description of AD 94-2 Benefits It is the Assessment Engineer's responsibility to identify the benefits that the AD 94-2 parcels will receive from the Improvements proposed to be acquired. The benefits to the lots and parcels in AD 94-2 are described as follows: Pursuant to the proposed Castle & Cooke Acquisition Agreement referenced in Section I of the AD 94-2 Engineer's Report, AD 94-2 will finance the acquisition of certain improvements and the payment of City improvement fees and costs required as conditions of final subdivision map approvals related to the approved Ten TR 5678 and proposed Ten TR 5679 subdivision maps that overlay the AD 94-2 parcels. Improvements proposed to be fmanced pursuant to the AD 94-2 proceedings are divided into two groups, with each group providing separate direct bene,~t to the two non-overlapping areas proposed to be developed by Ten TR 5678 and Ten TR 5679. The improvements to be acquired are either already required or are expected by Castle & Cooke to be required to be installed as conditions of final map approval for Ten TR 5678 and for Ten TR 5679. ^ The primary categories of direct bene,~t provided by the separate systems of Ten TR 5678 off-site improvements proposed to be acquired, as they are described in detail in Section II of this AD 94-2 Engineer's Report, are as follows: 29177PER.EXD D-2 09/29/94 Sewer System Improvements Those improvements will provide the Ten TR 5678 parcel with connections to sewer mains in Gosford Road and Pin Oak Park Boulevard, as a partial fulfillment of the subdivision approval requirements to provide the tract with connections to the existing sewer mains. 4. Street System. Improvements: The improvements planned to be installed as Ten TR 5678 off-site street improvements include sidewalk, curb returns, handicap ramps, street lights with conduits and street signs along the tract frontages along Gosford Road, White Lane, and Pin Oak Park Boulevard, and are more particularly described in Section II of the AD 94-2 Engineer's Report. As a. part of the Street System Improvement benefit group, left and right turn lanes will be installed in Gosford Road at Ficus Drive, and a right turn lane in White Lane at Umbrella Pine Way. Those improvements will provide for partial mitigation of traffic impacts related to the buildout of the lots in Ten TR 5678 and as partial fulfillment of the subdivision approval requirements to complete the tract frontage streets to their full master- planned configuration. 5. Miscellaneous Improvements Improvements classified as "Miscellaneous Improvements" by the AD 94-2 Subdivision Engineer include the block wall and landscaping strip along the outer perimeter of TR 5678 in Gosford Road, White Lane, and Pin Oak Park Boulevard, and also along Persimmon Drive within the Ten TR 5678 PG&E tower easement. Those improvements also include the landscaping of the Garden Park access along the northwesterly boundary of Ten TR 5678. Those improvements are also a partial fulfillment of the subdivision approval requirements to complete the tract frontage streets. 29177PER.EXD D-3 09/29/94 ^ The primary categories of direct benefit provided by the separate systems of Ten TR 5679 off-site improvements proposed to be acquired, as they are described in detail in Section II of the AD 94-2 Engineer's Report, are as follows: 1. Storm Drain System Improvements Those improvements will provide off-site street drainage for Ten TR 5679 parcels and connection to storm drain mains in Gosford Road/South Laurelglen Boulevard as a partial fulfillment of the expected subdivision approval requirements. 2. Street System Improvements: The improvements planned to be .installed as Ten TR 5679 off-site street improvements include sidewalk, curb returns, handicap ramps, street lights with conduits and street signs along the tract frontage in Gosford Road and South Laurelglen Boulevard, and are more particularly described in Section II of the AD 94-2 Engineer's Report. As a part of the Street System Improvements benefit group, left and right turn lanes will be installed in Gosford Road at Roswell Lane. Those improvements will provide for partial mitigation of traffic impacts related to the buildout of the lots in proposed Ten TR 5679 and as partial fulfillment of the expected subdivision approval requirements to complete the tract frontage streets to their full master-planned configuration. 3. Miscellaneous Improvements: Improvements classified as "Miscellaneous Improvements" by the AD 94-2 Subdivision Engineer include the block wall and landscaping strip along the outer perimeter of Ten TR 5679 in Gosford Road and South Laurelglen Boulevard. Those improvements are also a partial fulfillment of the expected subdivision approval requirements to complete the tract frontage streets. Spread of AD 94-2 Costs to Benefited Parcels In accordance with the 1913 Act and subparagraph (e) of Section 10204 as contained therein, the total cost and expense of the improvements to be financed are required to be spread among the properties in the district in proportion to the estimated benefits each parcel will receive from the improvements. All of the existing AD 94-2 parcels (the unsubdivided, existing APN's) are, in effect, interim parcel configurations for properties that are currently involved in the land development process. The basis for this statement is that all of the AD 94-2 parcels have been approved or are planned for submittal to be approved for subdivision into single-family dwelling lots by two tentative tract maps as follows: 29177PER.EXD D-4 09/29/94 1. Tentative Tract 5678 overlays the entire AD 94-2 Assessment No. 5. As stated in Section II of the AD 94-2 Engineer's Report, Ten TR 5678 is planned for development of 290 R-1 lots. 2. Tentative Tract 5679 overlays all of AD 94-2 Assessments 1, 2, 3, and 4. As described earlier in this Exhibit D, Assessments 1, 2, and 3 are landscape easement parcels and are classified as non-benefited for the purpose of this Assessment Spread Method. Ten TR 5679 is planned for development of 83 R-1 lots. O Basis for AD 94-2 Assessment Spread As stated earlier in this Exhibit D, all of the improvements to be acquired and financed by the AD 94-2 proceedings are required or are expected by Castle & Cooke to be required to be installed as conditions of final map approval separately for Ten TR 5678 and for Ten TR 5679. Accordingly, the tentative tract approval conditions are referenced as the basis for spreading the AD 94-2 unprovement system acquisition costs. Therefore, the total cost of Ten TR 5678 off- site improvements and incidentals is assessed to Assessment 5, and the total cost of Ten TR 5679 off-site improvements and incidentals is assessed to Assessment 4. The Engineer's Itemized Estimates of those costs are presented in Exhibit B, Tables B-II-A and B-II-B, respectively. O Spread of Assessed Tentative Tract Total Costs to Tract Phases and Individual Lots As the Ten TR 5678 and Ten TR 5679 maps are recorded to subdivide AD 94-2 Assessments 4 and 5 into R-1 lots, the total system acquisition cost share assessed to each tentative tract parcel in accordance with the spread methodology described above will need to be segregated and apportioned to the new subdivision lots. The method used for spreading each tentative tract's total cost share among its phases and, finally to the future lots that will be recorded within the tentative tract phases is based on each tract's estimated total number of R-1 lots as follows: a. The total Ten TR 5678 share, with the exception of its Storm Drain System Improvements cost share, is spread to its phases (A through E) in direct proportion to the proposed number of R-1 lots within each phase. The Ten TR 5678 Storm Drain System benefits only the Phase E portion of Ten TR 5678, and the total cost of those improvements, accordingly, is apportioned to the Phase E area. When each individual phase is recorded, its assessment share will be apportioned to each new lot within a phase on an equal-per-lot 29177PER.EXD D-5 09/29/94 basis, since each individual lot will receive the same level of benefit from the tract off-site improvements to be financed by AD 94-2. b. There was no confnmation available on the possible phasing of Ten TR 5679 at the time this report was prepared. Therefore, as described above, the total cost of Ten TR 5679 off-site improvements to be acquired is assessed to Assessment 4. When TR 5679 is recorded, its assessment share will be apportioned to the new lots on an equal-per-lot basis, since each individual lot will receive the same level of benefits from tract off-site improvements to be financed by AD 94-2. Exhibit E of AD 94-2 Engineer's Report, "Sketch Map of Proposed Tract No. Exhibit C of AD 94-2 Engineer's Report ("Engineer's Summary of Individual Assessments") provides a detailed break down of how the tentative tract shares have been apportioned to the planned tract phases. O Spread of Cost to Refinance Existing AD 82-1 Assessments The cost to refinance the -two existing AD 82-1 Assessments is spread as follows: 1. The total cost to pay off the existing fixed special assessment lien of record for AD 82-1 Assessment 2166, encumbering the parcel described as Kern County APN 389-010-17 (AD 94-2 Assessment 4), is financed as part of the total AD 94-2 assessment. The amount of remaining principal balance for Assessment 2166, effective July 1, 1995, assuming that. both 1994/ 1995 debt service installments for Assessment 2166 billed on the 1994/ 1995 Kern County Property Tax Bill for the parcel will be paid by Apri130, 1995, plus the total amount of all the estimated charges and credits associated with the payoff and release of lien for Assessment 2166 are itemized and shown on Table B-III-A, Payoff Calculation for Assessment District No. 82-1 Assessment 2166 in AD 94-2 Engineer's Report Exhibit B ("Table B-III-A"). Reference to AD 94-2 Assessment Diagram sheet 2 of 2, attached as AD 94-2 Engineer's Report Appendix B, shows that AD 82-1 Assessment 2166 covers all of AD 94-2 Assessment 4. APN 389-010-17 is also the same property area referred to in this Assessment Spread Method as Ten TR 5679. Therefore, the total AD 82-1 Assessment 2166 payoff cost is assessed to AD 94-2 Assessment 4. This cost would also be included in the total amount apportioned to the future Ten TR 5679 R-1 lots on anequal-per-lot basis. 2. The total cost to pay off the existing fixed special assessment lien of record for AD 82-1 Assessment 3083, encumbering the parcel described as Kern County APN 391-010-34 (AD 94-2 Assessment 5), is financed as part of the total AD 94-2 assessment. The amount of 29177PER.EXD D-6 09!29/94 remaining principal balance for Assessment 3083, effective July 1, 1995, assuming that both 1994/1995 debt service installments for Assessment 3083 billed on the 1994/1995 Kern County Property Tax Bill for the parcel will be paid by April 30, 1995, plus the total amount of all the estimated charges and credits associated with the payoff and release of lien for Assessment 3083 are itemized and shown on Table B-III-B, Payoff Calculation for Assessment District No. 82-1 Assessment 3083 in AD 94-2 Engineer's Report Exhibit B ("Table B-III-B"). Reference to AD 94-2 Assessment Diagram sheet 2 of 2, attached as AD 94-2 Engineer's Report Appendix B, shows that AD 82-1 Assessment 3083 covers all of AD 94-2 Assessment 5. APN 391-010-34 is also the same property area referred to in this Assessment Spread Method as Ten TR 5678. Therefore, the total AD 82-1 Assessment 3083 payoff cost is assessed to AD 94-2 Assessment 5 and will be segregated and apportioned on an equal-per-lot basis to the Ten TR 5678 R-1 lots. In accordance with this fording, the Table B-I line 13.G, Total Estimated Assessment Proceeding Incidental Cost and Expense, is spread to Ten TR 5678 and Ten TR 5679 in proportion to their total improvement and other costs assessed, as shown in lines 12.A and 12.B of Table B-I. The apportioned assessment proceeding cost share for each APN in Ten TR 5678 and Ten TR 5679 is shown in Exhibit C. 29177PER.EXD D-7 09/29/94 2. The Contribution amounts are deducted from the Ten TR 5678 or Ten TR 5679 line 14 total cost amounts and the net amount shown on line 16 is the total cost to 1915 Act Bond Financing. The separate contribution and cash collection amounts are credited to the parcel for which the cash payment or contribution was made, to reduce that parcel's share of the total cost to bond issuance. The apportioned contribution share for each APN in Ten TR 5678 and Ten TR 5679 is shown in Exhibit C. 3. Spread of AD 94-2 Bond Issuance Costs The AD 94-2 estimated Bond Issuance Costs are shown in line 17 of Table B-I. These costs are based on the actual cost of improvements and incidental expense to be financed and, accordingly, they are spread to each APN in proportion to the parcel's net total improvement and incidental cost share remaining after deducting any contribution. Each APN's Bond Issuance Cost share is shown in Exhibit C under the Bond Issuance Cost column. O Calculation of AD 94-2 Parcel Total Assessments The total cost shares spread to each .parcel for improvements, incidental expenses, fees,. assessment proceeding, and bond issuance costs to be financed are added and the contribution amounts subtracted, to calculate each parcel's total assessment. Parcel total assessment amounts are shown in Exhibit C and in Engineer's Report Exhibit A, Assessment Roll for AD 94-2. 29177PER.EXD D-8 09/29/94 ASSESSMENT ENGINEER'S CERTIFICATION OF THE ASSESSMENT SPREAD METHOD This Engineer's Report has been prepared to present the following: An estimate of the total cost of the improvements to be acquired, and incidental costs proposed to be funded pursuant to this assessment proceeding; and 2. An analysis of the benefits of those improvements and a description of the methodology developed to spread the estimated improvement acquisition costs and incidental expenses to the AD 94-2 properties in proportion to the estimated benefits that those properties will receive from the improvements. The AD 94-2 Assessment may exceed the amount for which bonds can be issued pursuant to recommendation of the City's financial advisor, as to the minimum acceptable property value to assessment lien ratio for bonds issued and secured by AD 94-2 unpaid assessments. Additional property value in excess of the estimated current -value of the assessed property with the improvements completed and installed may need to be confirmed by MAI appraisal, before the City can issue 1915 Act Bonds in the full amount of the AD 94-2 Assessment.
