AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY
CHANGING THE LAND USE ZONING OF THAT CERTAIN
PROPERTY IN THE CITY OF BAKERSFIELD LOCATED
BETWEEN AUBURN STREET AND STATE FREEWAY ROUTE
178 AND IMMEDIATELY EAST OF OSWELL STREET.
WHEREAS, in accordance with the procedure set forth in the
provisions of Title 17 of the Municipal Code of the City of Bakers-
field, the Planning Commission and City Council have held hearings
respectively, on a petition to change the land use zoning of that
certain property in the City of Bakersfield located between Auburn
Street and State Freeway Route 178 and immediately east of Oswell
Street; and
WHEREAS, the City Council has determined after due con-
sideration of said petition and the recommendations of the Planning
Commission herein on file, together with the reasons advanced at
the hearings for a change of zoning of said property, that a zoning
change should be authorized; and
WHEREAS, the City Council has determined and found that
this zoning ordinance is consistent with the General Plan of the
City of Bakersfield.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield as follows:
That Section 17.12.020 (Zoning Map) of the Municipal Code
of the City of Bakersfield, be and the same is hereby amended by
changing the land use zoning of certain property in said City, the
boundaries of which property are shown on the map hereto attached
and made a part hereof, as follows:
Parcel "n":
Amending the zoning boundaries from an R-1
(One Family Dwelling) Zone to an R-2-D (Limited
Multiple Family Dwelling-Architectural Design)
Zone:
That portion of the northwest one-quarter of
Section 23, Township 29 South, Range 28 East,
M.D.B.& M., in the City of Bakersfield, County
of Kern, State of California, described as follows:
Beginning at a point in the north line of said
Section 23 from which point the northwest corner
of said section bears south 89°48'13" west 835.00
feet thereon;
Thence south 00o11'47" east 335.24 feet;
Thence south 82~36'52" east 322.53 feet;
Thence south 89°08'41" east 165.48 feet to a point
in the east line of the northwest 1/4 of the north-
west 1/4 of said Section 23;
Thence north 00°04'19" east along said east line
380.84 feet to a point in the north line of said
Section 23;
Thence south 89°48'13" west 486.94 feet to the
Point of Beginning.
EXCEPTING THEREFROM the right-of-way within Auburn
Street.

From an R-1 (One Family Dwelling) Zone to a C-1-D
(Limited Con~nercial-Architectural Design) Zone:
That portion of the northwest 1/4 of Section 23,
Township 29 South, Range 28 East, M.D.B.& M., in
the City of Bakersfield, County of Kern, State of
California, described as follows:
Beginning at a point in the north line of said
Section 23; from which point the northwest corner
of said Section bears south 89°48'13" west 75.00
feet thereon;
Thence south 04°17'15" east 264.18 feet;
Thence south 81°39'29" east 324.56 feet;
Thence north 73°36'24" east 79.60 feet;
Thence south 82o36'52" east 94.58 feet;
Thence north 0°11'47" west 301.97 feet to a point
in the said north line of Section 23;
Thence south 89°48'13" west along said north line
510.00 feet to the Point of Beginning.
EXCEPTING THEREFROM the right-of-way within Auburn
Street.

I HEREBY CERTIFY that the foregoing ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 14th day of February, 1977~ by the follow-
ing vote:
