HomeMy WebLinkAboutORD NO 2320ORDINANCE NO. 2320 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD COMMONLY KNOWN AS 515, 550 AND 1000 WEST COLUMBUS STREET AND 4090 SAN DIMAS STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Congnission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield commonly known as 515, 550, and 1000 West Columbus Street and 4090 San Dimas Street; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Con~nission herein on file, together with the reasons aRvanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said city, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from R-3-MH-D (Limited Multiple Family Dwelling-Mobilehome- Architectural Design) Zone; to an MH (Mobile- home) Zone; from an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone; to a C-O-D (Commercial and Professional Office- Architectural Design) Zone; from an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone; to a C-1-D (Limited Co~¥m~ercial-Architectural Design) Zone; and from an MH (Mobilehome) Zone; to a C-2-D (Commercial-Architectural Design) Zone, of those certain properties in the City of Bakers- field commonly known as 515, 550 and 1000 West Columbus and 4090 San Dimas Street, being more particularly described as follows: From an R-3-MH-D (Limited Multiple Family Dwelling-Architectural Design) Zone to an MH (Mobilehome) Zone: Parcel No. 1 of Parcel Map 3512, City of Bakersfield, County of Kern, State of California, as per Map recorded September 22, 1976, in Book 16, Page 166, in the office of the County Recorder of said county. EXCEPTING THEREFROM the area that is located in the unincorporated area of the county. From an R-2-D (Limited Multiple Family Dwelling-Architectural Design) Zone to a C-O-D (Commercial and Professional Office- Architectural Deszgn) Zone. (A) Parcels 2 and 3 of Parcel Map 3722, City of Bakersfield, County of Kern, State of California, as per Map recorded October 12, 1976, in Book 16, Page 190, in the Office of the County Recorder of said County. (B) Parcel B of Parcel Map 3682, as per Map recorded December 21, 1972, in Book 24, Page 109, in the office of the County Recorder of said county. (C) All that portion of land lying between Parcel Map 3722 recorded in Parcel Map Book 16, Page 190, and Parcel Map 3682 recorded in Parcel Map Book 17, Page 47 and between the westerly prolongation of the south line of Parcel No. 1 of Parcel Map 3722 recorded in Parcel Map Book 16, Page 190 and the westerly prolongation of the south line of Parcel No. 3 of Parcel Map 3722. Beginning at the southwest corner of said Parcel No. 1; thence south 20°35'38" east, 859.58 feet; thence south 14o00'38" east, 43.23 feet to the southwest corner of said Parcel No. 3; thence north 89°58'16" west, 148.49 feet along the westerly prolongation of the south line of said Parcel No. 3 to a point on the east line of Parcel Map 3682 recorded in Parcel Map Book 17, Page 47; thence north 20°46'16" west along the easterly line of said Parcel Map 3682, 905.43 feet to a point on the westerly prolongation of the south line of said Parcel No. 1; thence south 89© 58'16" east along the westerly prolongation of said Parcel No. 1, 156.77 feet to the True Point of Beginning. EXCEPTING THEREFROM the westerly 100.0' located southerly of the easterly prolongation of the south line of Parcel B of said Parcel Map 3682. (B) Parcel A of Parcel Map 3682, recorded in Book 17, Page 47, in the office of the County Recorder. (C) All that portion of land lying between Parcel Map 3722 recorded in Parcel Map Book 16, Page 190, and Parcel Map 3682 recorded in Parcel Map Book 17, Page 47 and between the south line of West Columbus Street and the westerly prolongation of the south line of Parcel No. 1 of Parcel Map 3722 recorded in Parcel Map Book 16, Page 190. Beginning at the northwest corner of Parcel No. 1 of said Parcel Map 3722, from which corner the center of a curve bears north 18°54'56" east a radius of 1045.00 feet; thence along said curve in a north- westerly direction an arc distance of 209.97 feet to a point on said curve, from whic~ point the center of said curve bears north 30 25'40" east a radius of 1045.00 feet; thence south 20°46'16" east along the easterly line of Parcel Map 3682 recorded in Parcel Map Book 17, Page 47, 261.12 feet; thence south 89°58'16" east along the westerly prolongation of the south line of said Parcel No. 1, 156.77 feet to the southwest corner of said Parcel No. 1; thence north 20°35'38" west, 167.43 feet to the True Point of Beginning. EXCEPTING THEREFROM the westerly 100.0' located northerly of the easterly prolongation of the north line of Parcel A of said Parcel Map 3682. From an MH (Mobilehome) Zone to a C-2-D (Commercial-Architectural Design) Zone: Parcel No. 3 of Parcel Map 3512, City of Bakersfield, County of Kern, State of California, as per Map recorded September 22, 1976, in Map Book 16, Page 166, in the office of the County Recorder of said county. .......... o0o ..........
