HomeMy WebLinkAbout05-08-2007 MINUTES OF THE REGULAR MEETING BOARD OF ZONING ADJUSTMENT OF THE CITY OF BAKERSFIELD Held Tuesday, May 8, 2007, 3:00 p.m., City Council Chamber, City Hall, 1501 Truxtun Avenue, Bakersfield, California. 1.ROLL CALL BOARD MEMBERS: Present: VINCE ZARAGOZA, Chairperson CHRIS LEE JACK LA ROCHELLE (3:05 p.m.) STAFF MEMBERS: PAUL HELLMAN, Principal Planner RYAN PHARR, Associate Planner MICHAEL RICHARDS, Associate Attorney GEORGE GILLBURG, Engineer II DELORES OLDHAM, Recording Secretary 2.PUBLIC STATEMENTS No speaker cards were presented. 3.CONSENT CALENDAR A.Non-Public Hearing Items: 1.Approval of the minutes of the regular meeting held on April 10, 2007. Motion made by Member Lee to approve the April 10, 2007 minutes. Motion carried by the following roll call vote: AYES: Members: Zaragoza, Lee NAYS: None ABSENT: Member La Rochelle B.Public Hearing Items: File No. 07-0722 – 1.Approval of a zoning modification to reduce the required special dwelling setback for dwellings on lots adjoining agricultural zoned property from 50 feet to 5 feet in an E (Estate) zone district located at the northwest corner of Allen Road and Rosedale Highway. Minutes, BZA, 05/08/07 Page 2 File No. 07-0796 – 2.Approval of a Conditional Use Permit to allow a 1,500 square foot second dwelling unit in an R-1 (One-Family Dwelling) zone rd district located at 732 East 3 Street. File No. 07-0521 - 3.Approval of a Conditional Use Permit to allow a roominghouse with 14 residents on a 12,525 square foot lot with two detached dwelling units in an R-3 (Multiple-Family Dwelling) zone rd district at 1030 33 Street. The project also includes a Modification to allow a reduction in required off-street parking from 11 to 0 spaces. The public hearing was opened. Gary Thompson, applicant for Conditional Use Permit 07-0521, stated that he will not be adding to the testimony that he provided at the April 10, 2007 BZA public hearing. The Board did not request the removal of any consent agenda items. The public hearing was closed. Member La Rochelle moved to approve the consent agenda. Motion carried by the following roll call vote: AYES: Members: Zaragoza, Lee, La Rochelle NAYS: None 4.PUBLIC HEARINGS File No. 07-0580: 1. Conditional Use Permit to allow a 64 resident licensed group home in an R-2 (Limited Multiple-Family Dwelling) zone district located at 300 Hayes Street and 301 Northrup Street. The public hearing was opened and the staff report was given. No one spoke in favor or against the staff recommendation. The public hearing was closed. There was no member discussion. Member Lee moved to adopt the attached resolution with all findings denying Conditional Use Permit 07-0580 as depicted in the project description. Motion carried by the following roll call vote: AYES: Members: Zaragoza, Lee, La Rochelle NAYS: None Minutes, BZA, 05/08/07 Page 3 File No. 07-0776: 2. Conditional Use Permit to allow a 30-foot tall roof mounted wireless communications antenna accessory to a bank in a C-2 (Regional Commercial) zone district located at 13125 Rosedale Highway. The public hearing was opened and the staff report was given. No one spoke in favor or against the staff recommendation. The public hearing was closed. There was no member discussion. Member La Rochelle moved to adopt the attached Resolution with all findings denying Conditional Use Permit 07-0776 as depicted in the project description. Motion carried by the following roll call vote: AYES: Members: Zaragoza, Lee, La Rochelle NAYS: None 5.COMMUNICATIONS; None. 6.BOARD COMMENTS: None. 7.ADJOURNMENT: There being no further business the meeting was concluded at 3:18 p.m. The next Board of Zoning Adjustment meeting is scheduled for June 12, 2007.
