ROLL CALL 1. BOARD MEMBERS: Present: VINCE ZARAGOZA, Chairperson CHRIS LEE Absent: RAUL ROJAS STAFF MEMBERS: Present: JIM EGGERT, Assistant Planning Director PAUL HELLMAN, Principal Planner MICHAEL RICHARDS, Attorney GEORGE GILLBURG, Engineer II DELORES OLDHAM, Recording Secretary PUBLIC STATEMENTS 2. No speaker cards were presented. 3.CONSENT CALENDAR A.Non-Public Hearing Items: 1.Approval of the minutes of the special meeting held June 21, 2007 and the regular meeting held July 10, 2007. Motion made by Member Lee to approve the June 21, 2007 and July 10, 2007 minutes. Motion carried by the following roll call vote: AYES: Members: Zaragoza, Lee NAYS: None ABSENT: Member Rojas B.Public Hearing Items: File No. 07-1226: 1. A zoning modification to reduce the required side yard setback from 10 feet to 4 feet to allow the construction of a carport in an R-1 (One-Family Dwelling) zone district located at 7512 Dos Rios Way. Minutes, BZA, 08/14/07 Page 2 Application has been withdrawn. File No. 07-1174: 2. Approval of a zoning modification to increase the height of an existing 12-story office building from 176 feet to approximately 200 feet to permit the construction of an additional story in a C-O (Professional and Administrative Office) zone district located at 5060 California Avenue. Recommend approval to City Council. File No. 07-1372 3.: A conditional use permit to expand an existing automobile dismantling business (Pick Your Part Auto Wrecking) by approximately 2.5 acres in M-1 (Light Manufacturing) and M-2 (General Manufacturing) zone districts located at 5311 S. Union Avenue. Continue to September 11, 2007. File No. 07-1276: 4. Approval of a conditional use permit to allow construction of a 9,826 sq. ft. science classroom building, an approximately 2,500 sq. ft. development office, and modification of an existing parking lot on the Garces Memorial High School campus in an R- 1 (One-Family Dwelling) zone district located at 2800 Loma Linda Drive. File No. 07-1275: 5. Approval of a conditional use permit to construct a 13 space off-site parking lot for St. Francis Church, situated approximately 130 feet north of the church in an R-3 (Multiple-Family Dwelling) zone district located 1011 Eye Street. The public hearing was opened. No one from the audience requested removal of any item from the consent calendar. Member Lee requested removal of item 2 from the consent calendar. The public hearing on the consent calendar was closed. Member Lee moved to approve items 4 and 5 and to continue item 3 to the next BZA meeting on September 11, 2007. Motion carried by the following roll call vote: AYES: Members: Zaragoza, Lee NAYS: None ABSENT: Member Rojas Minutes, BZA, 08/14/07 Page 3 4.PUBLIC HEARINGS File No. 071174: 1.- Approval of a zoning modification to increase the height of an existing 12-story office building from 176 feet to approximately 200 feet to permit the construction of an additional story in a C-O (Professional and Administrative Office) zone district located at 5060 California Avenue. The public hearing was opened and the staff report was given. No one spoke in opposition to the staff recommendation. Barry Goldner of Klein, DeNatale, Goldner, appearing on behalf of the applicant and property owner, stated that he is available to answer any questions. Mr. Goldner further indicated that they agree with the staff recommendation. Member Lee commented that because of the uniqueness of this project members of the City’s Building Division met with the applicant/architect, Paul Skarphol, to discuss major structural design issues, means of egress, construction staging, tenant and pedestrian safety issues, as well as the smoke evacuation system which would be mandated for this project. Member Lee asked for confirmation from Mr. Skarphol that he has assured the City that a full scale structural analysis, as well as fire safety analysis, will be prepared by a separate expert professional, and in return the Building Division intends to obtain a structural engineer’s service in reviewing this project. Mr. Goldner stated that Mr. Skarphol nodded in agreement, and pointed out that he advised Mr. Skarphol of the nature of the discussion held, and further clarified that steps have already been undertaken to pursue the appropriate design to make sure that the project will be in full compliance with all applicable requirements. The public hearing was closed. Mr. Zaragoza expressed his concurrence with Mr. Lee’s concerns. Member Lee moved to recommend approval of File No. 07-1174 to the City Council. ADJOURNMENT: There being no further business the meeting was concluded at 3:18 p.m. The next Board of Zoning Adjustment meeting is scheduled for September 11, 2007.
