A RESOLUTION OF THE COUNCIL OF THE
CITY OF BAKERSFIELD ADOPTING THE
STREET CUT WORKMANSHIP AND
PERFORMANCE WARRANTY FEE
WHEREAS, Chapter 12.16 of the Bakersfield Municipal Code requires that the
City Council adopt a resolution establishing a workmanship and performance warranty
fee for street cuts; and
WHEREAS, this workmanship and performance warranty fee was last amended
on July 19, 2006; and
WHEREAS, this workmanship and performance fee is intended to pay for the
cost of resurfacing a City street subject to street cuts with the fee based upon a
minimum of 100 feet; and
WHEREAS, Bakersfield Municipal Code Section 12.16.150 requires that the
Street Cut Workmanship and Performance Warranty Fee be adjusted annually by the
ENR Annual Construction Cost Index (Los Angeles), as published by Engineering News
Record, McGraw-Hili Companies; and
WHEREAS, Bakersfield Municipal Code Section 12.16.150 also allows the Street
Cut Workmanship and Performance Warranty Fee to be annually adjusted to account
for changes in cost estimates for recent City resurfacing projects, and any other items
which would change or add to the component items in the fee; and
WHEREAS, the proposed fee increase from $17.50 per lane-foot to $19.90 per
lane-foot is based upon the actual bids received on three recent pavement projects; and
WHEREAS, the minimum pavement degradation fee will be $1,990 because 50
feet is the practical minimum of pavement that must be placed on either side of a trench
patch to assure the integrity of the roadway; and
WHEREAS, the City Council desires to adjust this fee to recover the City of
Bakersfield's costs in resurfacing streets.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein.
2. That the fee schedule for the workmanship and performance warranty fee
set forth as Exhibit "An is hereby approved and adopted.
3.
The effective date of this resolution shall be October 15, 2007.
