AN EMERGENCY ORDINANCE OF THE CITY OF BAKERSFIELD
AMENDING CHAPTER 3.18 BY ADDING NEW SECTIONS
3.18.200(1) (SICK LEAVE) AND 3.18.195 (VACATION).
WHEREAS, the City has acquired a water system from Tenneco
West Inc., and has created a Water Department with employees, all
to commence January 1, 1977; and
WHEREAS, this ordinance is necessary in order to operate
the department with employees being brought in to City employment,
by reason of the acquisition of said water system.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield as follows:
SECTION 1.
That Section 3.18.200(1) is added to Chapter 3.18 of the
Municipal Code to read as follows:
(1) Tenneco West Employees.
1. Those employees of Tenneco West Inc. who become City
employees as a result of the acquisition of the water system from
TWI shall, upon employment with the City, be credited with five
days sick leave for each full year of employment with *IMI up to
the maximum allowable to all City personnel.
2. Employees mentioned iu (1.) above shall, after employ-
ment commences with the City, accrue additional sick leave in accord-
ance with this chapter.
3. For purposes of sick leave retirement benefits, such
retirement means eligibility for retirement benefits in PERS.
SECTION 2.
That Section 3.18.195 is added to Chapter 3.18 of the
Municipal Code to read as follows:
3.18.195 Tenneco West Employees. Those employees who were
formerly employed with Tenneco West Inc. who, as a result of the
acquisition of the water system, will be eligible for vacation on
the following basis.
1o From and after January 1, 1977, each employee shall be
credited with the length of time employed by Tenneco West Inc. as if
they had worked for the City during such period.
2. Such employees shall not be granted any accrued vaca-
tion except as they may accrue such in accordance with this chapter
from and after January 1, 1977.
SECTION 3.
This ordinance is an emergency ordinance under Section
24 of the Bakersfield City Charter for the daily operation of a
municipal department and shall be effective irmnediately upon adoption
by a two-thirds vote of the members present.
