HomeMy WebLinkAboutORD NO 2308EMERGENCY ORDINANCE NO. 2308 NEW SERIES AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADDING CHAPTER 1.45 TO THE MUNICIPAL CODE CREATING THE DEPARTMENT OF WATER. WHEREAS, by condemnation, the City of Bakersfield has acquired all of the water interests of Tenneco West Inc. in the Kern River and canals and other facilities related thereto; and WHEREAS, Section 12 of the City Charter authorizes the City Council to create offices in the City; and WHEREAS, it is the desire of the City Council to create a water department to administer and operate the water facilities acquired from Tenneco West Inc.; and WHEREAS, certain employees of the company, through experience of operating the water system for the company are neces- sary for the continuance of such operation under the City; and WHEREAS, it is necessary that such officers and employees be hired by the City and given certain credits for their employment by Tenneco West, Inc.; and WHEREAS, City Charter Section 24 provides that an emer- gency ordinance may be adopted for the daily operation of a munici- pal department; and WHEREAS, the emergency is, that it is necessary to have a water department established by January 1, 1977. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. There is hereby added to the Bakersfield Municipal Code Chapter 1.45 and related sections which read as follows: Sections: 1.45.010 1.45.020 1.45.030 1.45.040 Chapter 1.45 WATER DEPARTMENT Creation of Department Employees of Tenneco West, Water Manager Duties of Water Manager Inc . 1.45.010 Water Department and the office of Water Manager Bakersfield. 1.45.020 Employees of Tenneco West, Inc. To Creation of Department. There is hereby created a for the City of the extent possible, those employees of Tenneco West Inc. whose primary duties were con- fined to the operation of the water and canal system may be brought into the work force of the City, without examination, upon approval of the appropriate civil service commission of the City. 1.45.030 Water Manager. The Water Manager who shall be appointed by the City Manager shall have general supervision over the depart- ment. 1.45.040 Duties of Water Manager. The duties of Water Manager shall be as follows: (1) Supervise the activities of employees in the department. (2) Regulate the operation of the canal system within the jurisdiction of the City. (3) Attend meetings, consult with, and advise the City Manager on water-related matters which may have an effect on the City. (4) Supervise administrative and clerical work and prepare department budget. (5) Maintain water records on all water from the Kern River under the ownership of the City. (6) Cooperate with those districts and entities contracting with the City for water supplies. (7) Make recommendations from time to time on the operation of the water program of the City. SECTION 2.
