HomeMy WebLinkAboutORD NO 2304ORDINANCE NO. 2304 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17o12.020 OF TITLE 17 OF THE MUNICIPAL CODE CHANGING THE LAND USE ZONING OF THAT CERTAIN LAND LOCATED ON THE NORTH SIDE OF STOCKDALE HIGHWAY AND WESTERLY OF PARK STOCKDALE; AND MAKING FIND- INGS IN CONNECTION WITH THE P.U.D. ZONE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Con~nission and City Council have held hearings respectively, on a petition to change the land use zoning on the property hereinafter described; and WHEREAS, the City Council has determined, after due con- sideration of said application, consisting of a Preliminary Develop- ment Plan indicating the matters required by Section 17.51.020 of the Municipal Code, together with a plot plan, photos and maps and a statement pertaining to density, estimated population and con- formance to the General Plan, and all other matters as required by law, and after having considered the recommendations of the Planning Commission, together with the reasons advanced at the hearings for a change of zoning, of the hereinafter-described property, that a zoning change should be authorized upon annexation of the property hereinafter described; and WHEREAS, at the hearing before the City Council on November 29, 1976, the City Council considered the following findings: 1. That the public necessity, convenience, general welfare and good zoning practice justify the zoning upon annexation to P.U.D. 2. That the applicant does intend to start construction within two and one-half (2½) years from the effective date of the zoning upon annexation. conforms to 4. environment That the proposed planned unit development substantially the General Plan. That such development will constitute a residential of sustained desirability and stability and that it will be in harmony with the character of the surrounding neighbor- hood and community. 5. That the development as proposed, constitutes a har- monious, integrated plan and justifies exceptions from the normal application of the Municipal Code. 6. That the area proposed for zoning upon annexation to a P.UoD. is in excess of one acre as required by Section 17.51.090 of the Municipal Code. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. That the above recitals are true and correct. 2. That the Preliminary Development Plan and accompanying documents as submitted, are approved and adopted, and the six findings as stated above are hereby made. 3. That the Preliminary Development Plan is incorporated into this Zoning Ordinance by reference as fully as though set forth herein. 4. That the Zoning Map is hereby ordered changed by identifying the area hereinafter described with the map symbol P.U.D. 5. That Section 17.12.020 of Chapter 7.12 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include that certain property in the County of Kern located on the north side of Stockdale Highway and westerly of Park Stockdale, known as Stock- dale No. 9 Annexation, in a P.U.D. Zone upon annexation of said property to the City of Bakersfield, the boundaries of which property o are shown ordinance on the map hereto attached and made a part of this and are more particularly described as follows: Conmaencing at the southeast corner of Section 33, Township 29 S., Range 27 East, M.D.B.& M., in the County of Kern, State of California; Thence north along the east line of said Section 33, a distance of 320.00 feet to True Point of Beginning; the Thence north 89o43'00", a distance of 80.00 feet; Thence north 00°17'00" east, a distance of 30.00 feet; Thence north 89°43'00" west, a distance of 148.60 feet; Thence north 00o17'00" east, a distance of 67.00 feet; Thence north 89o43'00" west a distance of 135.13 feet; Thence north 63°33'32" west, a distance of 45.00 feet; Thence north 89~43'00" west, a distance of 74.89 feet; Thence north 78~23'00" west, a distance of 92.17 feet; Thence north 24°40'00" east, a distance of 27.00 feet; Thence north 28o36'00" east, a distance of 203.90 feet to the south line of Tract #3614, recorded February 8, 1973, in Book 24, Pages 136 and 137, Official Records of Kern County; Thence east along the south line of said Tract 3614 a distance of 459.49 feet to the east line of said Section 33; Thence south along the east line of said Section 33, a distance of 339.99 feet to the True Point of Beginning. .......... o0o ..........
