AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING AMENDMENT TO THE CONTRACT
BETWEEN THE CITY OF BAKERSFIELD AND THE BOARD OF
ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES
RETIREMENT SYSTEM CONCERNING PROVISION FOR 15%
INCREASE IN ALLOWANCES TO OR ON ACCOUNT OF CERTAIN
MISCELLANEOUS MEMBERS RETIRED OR MEMBERS DECEASED
PRIOR TO JULY 1, 1971.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
That an amendment to the Contract between the Council of
the City of Bakersfield and the Board of Administration, California
Public Employees Retirement System is hereby authorized, a copy of
said amendment being attached hereto, marked "Exhibit A," and by
such reference made a part hereof as though set out in full.
SECTION 2.
That the Mayor of the City of Bakersfield is hereby
authorized, empowered and directed to execute said amendment for
and on behalf of the City of Bakersfield.
SECTION 3.
That this ordinance shall become effective thirty days
from and after the date of its passage.

I HEREBY CERTIFY that the foregoing ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 29th day of November, 1976, by the

The Board of Adm~ n~ stration, Biblic Employees, Retirement System~ hereinafter
referred to as Boardr and the CITY COUNCIL of the CITY OF BAKERSF~LD~ hereinafter
referred to as P~blic Agency~ havi~ entered into a contract under date of July 17~
19~+, effective July 1~ 1944~ and as amended effective January 1, 1950, November 1~
1957, October 1~ 1958, Apri~ 1~ 1965, October 1, 1967~ January 1~ 1971~ june 26~
1972, January 22, 1973~ '~'[~y 23~ 1973~ September 16~ 1973~ and February 1~ 197~
~fnich provide for participation of Public Agency in said System, Board and Public.
Agency hereby agree as follows:

Section 21222.6 (providing for 15% increases in allowances payable

Bo Paragraph 8.5 sb~]] be added to said contract:
Pablic Agency, in accordance with Section 2o7~0, Government Code,
shall cease to be an ,,employer,, for ~rposes of Chapter 6 of the
Public Employees' P~tirement Law effective as of the effective date
of this amendment to this contract. Accumulated contributions of
the Public Agency as of the date of such amendment shR]~ be fixed
and determined as provided in Section 20759~ Gover.oment Coder and
such accumulated contributions and contributions hereafter made
shall be held by the Board as provided in Sectio~ 20759~ Government
~ode.

9- Public Agency sh~]l c~ntribute to said Retirement ~ystem as follows:
With respect to ~iscellaneous members, the .l~O~c Agency shall
contribute the following percentages of mont~hly salaries earned
as misce]]=neous members of said System:
(1) 0.565 percent until Ju~e 30, 1980 ~ account of the lia-
bility for prior service benefits.
(2) 9.328 percent on account of the lia i]ity for current service
benefits.
(3) 0.168 percent on account of the liatil~ty for the 1959
Su~-~ivors program.

· (4) 0.~00 percent for five (5) years from September 16, 1973
to provide the benefits under Section 21222.1 of the Govern-
ment Code.
