HomeMy WebLinkAboutORD NO 2297ORDINANCE NO. 2297 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTHEAST CORNER OF STOCKDALE HIGHWAY AND CALIFORNIA AVENUE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield located on the northeast corner of Stockdale Highway and California Avenue; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from a C-O-D (Commercial and Professional Office - Architectural DesSgn) Zone to a C-2-D (Commercial - Architectural Design) Zone of that certain property in the City of Bakersfield located on the northeast corner of Stockdale Highway and California Avenue, being more particularly described as follows: Parcel I: Commencing at the intersection of the centerline of Stockdale Highway with the centerline of California Avenue as shown on Parcel Map No. 541, filed in Book 3 of Parcel Maps, at Page 171, in the office of the Recorder of Kern County, State of California; thence north 00°03'57" west, on and along said centerline of California Avenue 74.998 feet; thence north 89° 56'03" east, 55.00 feet to the easterly line of California Avenue and the True Point of Beginning; thence north 00°03'57" west, on and along said easterly line, 260.036 feet; thence north 89°56'03" east, 250.269 feet, thence south 00°03'57" east, 280.042 feet, to the northerly line of Stockdale Highway, thence south 89o56'08" west on and slong said northerly line, 230.269 feet to the beginning of a tangent curve, concave to the northeast, having a radius of 20.00 feet, thence northwesterly on and along said curve, through a central angle of 89© 59'55", an arc distance of 31.415 feet more or less to the True Point of Beginning. Parcel II: Commencing at the intersection of the centerline of Stockdale Highway with the centerline of California Avenue as shown on Parcel Map No. 541, filed in Book 3 of Parcel Maps, at Page 171, in the office of the Recorder of Kern County, State of California; thence north 00°03'57" west, on and along said centerline of California Avenue, 558.149 feet; thence north 89o56'03" east, 55.00 feet to the easterly right-of- way line of California Avenue and the True Point of Beginning; thence north 00°03'57" west, on and along said right-of-way line, 161.867 feet, to the beginning of a tangent curve, concave to the southeast, having a radius of 20.00 feet; thence northeasterly, on and along said curve, through a central angle of 89°59'17", an arc distance of 31.412 feet; thence north 89o55'20" east, 310.273 feet, thence south 00°03'57" east, 181.932 feet; thence south 89°56'03" west, 330.269 feet, more or less, to the True Point of Beginning. Parcel III: Commencing at the intersection of the centerline of Stockdale Highway with the centerline of California Avenue as shown on Parcel Map No. 541, filed in Book 3 of Parcel Maps, at Page 171, in the office of the Recorder of Kern County, State of California; thence north 89o56'08" east, on and along said centerline of Stockdale Highway, 747.842 feet; thence north 00°05'52" west, 408.143 feet to the True Point of Beginning; thence south 89°56'03" west, 150.00 feet; thence north 00o03'57" west, 332.00 feet; thence north 89o55'20" east, 4.571 feet, to the beginning of a tangent curve, concave to the southwest having a radius of 25.00 feet; thence southeasterly, on and along said curve, through a central angle of 29°35'31" an arc distance of 12.912 feet to a point of reverse curvature with a second curve, concave northerly, having a radius of 90.00 feet, from which point the radial point of said curve bears north 29°30'51"; thence easterly, on and along said curve east through a central angle of 65°51'35", an arc o distance of 103.452 feet; thence south 16~43'21" east, 123.08 feet; thence south 00°05'52" east, 216.545 feet, more or less, to the True Point: of Beginning. .......... 000 ..........
