WATER SALE AND REPAYMENT AGREEMENT
BETWEEN OLCESE WATER DISTRICT AND CITY OF BAKERSFIELD
BACKGROUND: On November 9, 1977, the City of Bakersfield and
Olcese Water District entered into'Agreement Nc,.
77-07 W.B. This agreement gave Olcese the right to
construct water wells on the City's 2,800 acre
property for the purpose of extracting water supplies
previously spread and banked by Olcese. The water
extracted by Olcese is then exchanged for Kern River
water upstream of the 2,800 acre site and used for
agricultural and domestic purposes within the
boundaries of Olcese. As of January 1, 1989, Olcese
has installed six water wells upon the 2,800 acre
property and conveyed these extraction facilities to
the City. As set forth in Article IV of Agreement Nc,.
77-07 W.B., the City is to repay Olcese for
instaliatic, n of water wells by giving Olcese credit
for all Olcese extraction charges until Olcese shall
have been repaid the actual cost of the wells plus
interest.
PROPOSAL: City of Bakersfield proposes to sell to Olcese Water
District, in- place, approximately 20,947 acre-feet of
City water currently banked 'underground in the 2,800
Acre Recharge Facility at a value of $ 40.00 per acre-
foot. In lieu of cash payment by Olcese tc, City, City
shall be relieved of its obligation to Olcese under
the terms of Article IV of Agreement Nc,. 77-0? W.B.,
"REPAYMENT TO OLCESE FOR CONSTRUCTION OF WATER WELLS".
PRICE: The sale of City banked ground water to Olcese has a
purchase price of $ 40.00 per acre-foot. Olcese credit
from City for construction of water wells as of June
30, 1989 will be approximately $837,897.35.
QUANTITY: Approximately 20,94~ acre-feet
LOCATION: The water is currently stored in the City's ground
water storage account within the 2,800 Acre Recharge
Facility.
USE: The water sold by City to Olcese will be used by
Olcese pursuant re. the terms and conditions set forth
in Agreement No. 77-07 W.B.
IMPACT: The City, as of May 1, 1989, holds 289,745 acre-
feet of banked water ir, its 2,800 Acre ground water
storage account. The water sale, as proposed, will
reduce the City ground water storage account by
approximately 20,947 acre-feet and increase the Olcese
ground water storage account by a like amount.

Gentlemen:
On ~rch 9, 1989, I met with Mr. Florin Core, ~nager of the Depart-
ment of Water Resources, and Mr. Paul Dow, Co,unity Service ~nager,'
to express the desire of the Stockdale ~nex Mutual Water Co. to
connect to the City's Ash Water system for emergency back-up use only.
We would expect to pay all costs. We would also use a contractor and
the specifications and design required by the City. This option was
discussed with the Planning Department in 1988.
I am sorT that it has taken so long to reply. I ask for your fair-
able decision, at your earliest convenience.

You asked i£ we would instal2 water meters. Our practice is .-to install
water meter~ at our expense. We feel that they encourage conservation and
they proviJe the fairest method of distributing the cost of a system.
Al:hough keeping close track of water usage is more work, the City believes
that payment for water should be based on the amount used and those, who use
more should not be subsidized by those who are more conservative. Since
our meeting, the Water Department has reviewed your water consumption rate
and estimated that the average monthly water bill would be between $31 and
$35.
You asked if you could review Morris Taylor's report on the value of your
system. By now the report should be in your hands. He used two different
approaches in estimating a value for the system. We found it very
reassuring. Naturally, we would not be as willing to assume responsibility
for a system if it had been neglected through the years.
Ue understand your reluctance to just give the system to the City and your
concern over increasing the water rates. Even ~hough we would rather not
buy :he syste~ we could make you an offer similar to ~he kind of arrange-
men: we have'made ~:h developers. They have put in new systems :o city
'standards and we have then accepted them %~th a pa)~emt for the system at
no interest over 40 years. Im a similar fashion we could take into account
the age of your system and deduct the cost of :he improvements needed to
your system to march city standards and pay the balance in vzlue by giving
a credit on :he ware: bills. Ue could adjust the payment schedule to 25
years so :here would be an estimated $4.00 per month reduction in the water
bills.
Another opiion we have considered is that for the sake of an emergency
back-up service for the residents :here could be a connection ~o our system
for :his purpose. You woul~ pay :he cost related :o :hat. If you ever
needed the inter-tie~'- ~ould be ir. media:elY available.
We also talked about so~e of :he other advam:ages of annexation. A quick

2. SEk~R SERVICES: Sewer service could be made available
upon annexation at the option of property owners. If
~ewer services are not available now, sewer services
could be obtained through participation in a district
formed by property o~n~ers representing at least 60 per-
cent of a proposed sewer assessment district area wishing
service. The City would assist property o~ners with the
formation of the district. The actual cost of the sewer
line would be prorated over 100 percent of the total
assessment area. Thi~ cost would include [he lateral
street connection to bring sewer lines to your property.
Connection would be at your convenience or upon failure
of },our existing septic system. The costs usually run
between 52,600 and $3,000 and are spread over !5 years.
Your on-site sewer costs would be dependent on the amount
of work required.
3. POLICE PROTECTION: Currently your neighborhood receives
police protection from two sources, California Highway
Patrol for :raffia and Sheriff's Department for invesui-
cation of criuinal wiola:ions. Anmexauion would offer
expedient protectiom for bo:h from a single source. The
~evel of police service for your neighborhood would be
increased ~o meet the City's standard.
&. Fi?~ PROTECTION: There would be some improvemenr in the
area's level of fire suppression service due to increased
fire hydrants. However, the City and Counry have signed

.A fiat rate fee of $$7.00 per year would provide no limit

6. STPSET F=~I]~EN~3CE: Overall szree: naimtenance would
prove upon anne~:ation. Po=holes would be repaired more
frequencly. Stree:s would be resurfa~ed more frequently.
Saree: sweeping would occur om a regular basis.
7. OTb~R SERVICES: Annexation would increase other services
to your neighborhood. The City also provides for school
~rossing guards, leaf collection, street lighting (includ-
ing energy cos:), a~ no additional charge. The city would
install a traffic signal at the intersection of Fairway
Road and S~ockdale Highway.
Other optional services and improvements available include
installation of curbs, gutters, and sidewalks. These
improvements would occur only if property owners chose
form a Public Improvement District. This would be an
association of property owners representing at least 60
percent of ~he proposed distric~ area. The actual cos: of
the improvements would be prorated over 100 percent of the
total district assessment area.
These and o~her public services can be provided to you more efficiently and
effectively by =he city. S:ockdale is very much a part of our co,unity-
physically, economically and socially-through annexation we can formally
confirm =hat re!a=ionskip.
