MINUTES OF THE SPECIAL MEETING
OF THE
WATER BOARD - CITY OF BAKERSFIELD
Held Tuesday, July 30, 1996, Water Resources Conference Room, 1000 Buena Vista Road,
Bakersfield, CA 93311.
1. The meeting was called to order by Boardmember Salvaggio at 4:35pm.

3. Boardmember Salvaggio adjourned the meeting to Closed Session at 4:36pm. Boardmember
Rowles was absent from the Closed Session portion of the meeting.
The meeting reconvened from Closed Session at 5:00pm, with Boardmember Rowles seated
at 5:01pm.
4. The Closed Session action was an Ad Hoc Committee was selected to meet with
representatives of North Kern WSD and Kern Delta WD. This meeting will take place
immediately following the Special Water Board meeting. The Committee would consist of
Boardmember Smith and Salvaggio for negotiation purposes. Scheduling conflicts will not
allow Boardmember Smith to be available to attend the Ad Hoc Committee meeting.
5. Boardmember Smith made a motion to approve the minutes of the Water Board Meeting
held May 15, 1996. Motion carried.
6. There were no Public Statements.
7. Correspondence.
7A. A letter was received from the Water Association of Kern County requesting a contribution
of $750 to support the 1996 Water Awareness Campaign. The campaign would consist of
short informative water conservation announcements shown on cable networks and
Channel 29 running through September, 1996. City Attorney Skousen asked if the money
was going to be used for advertisements to sway the election on the November ballot
regarding a water bond measure. After some discussion it was recommended that the
contribution be made with the stipulation that it could not be used to promote any current
or upcoming bond issue. A motion to this effect was made by Boardmember Smith. Motion
carried.
8. Deferred Business
SA. Mr. Hauptman presented the Kern River operations update for Board information. The
peak storage occurred on June 1 lth at 546,149 acre feet, with the latest April-July estimate
at 128% of normal. The 2800 Acre groundwater monitoring wells have risen between 50 and
90 feet since last year due to intensive spreading activities in and around the Kern River
channel. It is anticipated that groundwater spreading operations will continue through the
end of the year.
' 8B. Mr. Core gave some background information regarding the Metropolitan Bakersfield Water
Study and introduced Mr. Harry Starkey, Manager of Bookman-Edmondston Engineering,
the engineering firm selected for this project to give a brief update. The work on the project
started May 6, 1996, with an initial kick-off meeting of the participants. A questionnaire has
been completed by the eight participants for their ideas and suggestions. Several workshops
will be scheduled to monitor progress and guide the program which is designed to meet the
areas future growth.
8C. Mr. Core gave an update on the Improvement District No. 4 of the Kern County Water
Agency overhead/administrative cost allocation procedure. An independent auditor was
hired to review costs charged to ID4 by the KCWA. These charges are eventually passed
on to the purveyors and water users in Bakersfield. A formula was arrived at to resolve this
issue, would allow the Agency to spread their administrative costs among the other groups
the Agency oversees. The costs have not been adjusted for fiscal years 1994-95 and 1995-96
and the urban purveyors and water users are seeking repayment of these costs. An offer has
been made by KCWA in the form of 10,000 to 12,000 acre-feet of underground banked water
delivered through the Kern Water Bank. The ID4 Advisory Group have countered that the
water be delivered into the district. There has been no response to the counter offer as of
this date. Information only, no action required or taken by the Board.
8D. Mr. Core presented for Board consideration, a rescission of covenant offer for water supply
[."~' to a proposed urban development located near 7th Standard Road and Snow Road. A
.: request was received from Porter-Robertson Engineering, representing the landowners, for
an urban water supply. The City Water Board approved the request, contingent upon the
recording of a covenant by the landowners, binding the properties to annex into the City.
Subsequently, the City Manager notified the landowner representative of the annexation
requirement and allowed a two week period in order for compliance. The annexation
application was never received. Staff recommends rescinding offer of municipal water supply
for the properties and reject the acceptance of covenants relating to City municipal water
supplies. A motion was made by Boardmember Rowles-to this effect. Motion carried.
9. New Business
9A. California Water Service Company has requested, by a letter dated July 25, 1996, that the
City of Bakersfield provide a water supply for service to a proposed development, within the
City limits in northeast Bakersfield. Mr. Morris Taylor, an engineer representing Olcese
Water District addressed the Board and expressed concern over Cai-Water servicing this
particular area and that the Board should carefully assess the water service proposals.
Mr. Bogart, Water Resources Manager referred to a letter received from Mike Geddes of
Califarming, Inc., indicating that Califarming had chosen Cai-Water to provide water service
to their development in section 17 of T29S/R29E and that Cai-Water would need to contract
with the City for a water supply. Califarming based their decision on analyses of proposals
received from Cai-Water and Olcese to provide domestic water service to the development.
Boardmember Rowles asked of the issue of an adequate water supply capacity to expand
; beyond Section 17. Mr. Bogart explained that the initial development phase would extend

a water line into the tract, in conjunction with on-site storage facilities to provide a back up
system. As proposed by California Water Service Company, the future water mains serving
the area will loop north and westerly to tie into the existing 18" water main located in
Morning Drive. This system looping will also benefit future development and provide for
the orderly growth of the area. Following Board discussion, staff recommended that a
contract be entered into with California Water Service Company for a water supply to serve
the development. Boardmember Salvaggio made a motion to recommend approval of
agreement to City Council. Motion carried.
9B. Mr. Core presented the Kern County Water Agency's request for response to first right of
refusal option to purchase state project water. As part of the re-negotiation of the state
contract with the 31 water contractors, there are provisions to allow districts to sell their
contract entitlement. The KCWA has a limitation of about 130,000 acre-feet of their
1,100,000 acre-foot entitlement that may be sold. Berrenda Mesa Water District is proposing
to sell 25,000 acre-feet to the Mojave Water Agency (outside Kern County) at the price of
$1,000 per acre-foot plus annual operations costs. There are provisions for the first right of
refusal within the KCWA service area for this water. The City does not need this supply.
Staff recommends the Board authorize staffto sign the rejection notice and return to KCWA
prior to the August 19th deadline. Boardmember Rowles made a motion to this effect.
Motion carried.
9C. A request for a contribution to the 1996 "Water Watchers Series" was brought to the Board
by Mr. Core. This program is a series of 2 minute segments tied in with the weather reports
to be aired on Channel "17". The focus this year is, "Where water comes from" and 'Xvater
conservation." Since the Water Resources department can use this program for satisfying
requirements of its "Domestic Water Management Plan" with the State of California, staff
requests the Board to authorize a $1,000 contribution. Boardmember Salvaggio made a
motion to this effect. Motion carried.
10. A motion to adjourn was made by Boardmember Rowles at 5:35pm. Motion carried.

As you know, the Agency has been participating in the development of the attached
"Principles to Guide the CALFED Process" along with other water entities in the Central Valley,
including the Friant Water Users Authority (FWUA). We have previously faxed you a draft
copy of this Principles document (July 19, 1996). We appreciate the consu'uctive comments
received on the clrafL as well as your tentative endorsement of the principles outlined in the draft
document.
Attached is a final version of the Principles document which was transmitted to
CALFED, Governor Pete Wilson and Secretary Bruce Babbitt today. You will note that the
attached letter of transmittal indicates that a complete list of all organizations supporting the
documem will be compiled and provided by the close of summer.
With that in mind, the Agency asks that you discuss the Principles document with your
governing Boards. We hope that you support the principles outlined in the document, and will
take action to endorse it. We ask that you respond by September 13, 1996 if you do not want
your organization's name to appear on the list of supporting organizations to be
transmitted at the close of summer.

PRINCIPLES TO GUIDE THE CALFED PROCESS
Recommended by
Sacramento Valley and San Joaquin Valle~y Water Users
August 1, 1996
In June, 1994, a "Framework Agreement" between the State of California and the United States
established CALFED, a consortium of five state and five federal agencies with responsibilities
in the San Francisco Bay/Sacramento-San Joaquin Delta Estuary and its tributaries (the "Bay-
Delta System"). The Framework Agreement contained a pledge of cooperation among the
Federal and State agencies and was also intended to foster coordination and communication
among all interested parties. In May, 1995, the "CALFED Bay-Delta Program" was initiated
to develop a comprehensive, long-term program for environmental protection of the Bay-Delta
System and water supply and reliability for all water users. CALFED was charged with
planning, selecting, and implementing this long-term solution.
CALFED is currently engaged in its planning process and, in compliance with the California
Environmental Quality Act ("CEQA") and the National Environmental Policy Act ("NEPA'),
proposes to select a limited number of alternatives for in-depth analysis, from which, by early
to mid-1997, a preferred alternative will be selected. CALFED has requested that the public
comment and provide recommendations on CALFED's proposed process and upon their
preferred alternatives.
Responsive to CALFED's request, a number of Central Valley water supply organizations (the
"Central Valley Water Users") agreed to develop and provide to CALFED certain Guiding
Principles (Part I) and a list of the most important project components which they believe should
be evaluated in depth in CALFED's EIR/EIS (Part Il). It should be noted that this document was
developed through a cooperative effort among numerous water entities from within the Central
Valley. In addition, this document will be circulated in order to develop support from local
governments and private interests from throughout the Valley.
While agriculture is the Central Valley's primary industry, and is vital to its local economies,
the Central Valley's population is currently more than six million people and the Valley is
urbanizing at a rate which is among the highest in the nation. Thus, the Central Valley Water
Users believe that it is in all of their interests to address the broader needs within the Central
Valley, agricultural and urban. Therefore, we have developed a policy which addresses the need
to resolve the general problems of the Bay-Delta System as a foundation for meeting the water
supply, water quality, and environmental needs of all Californians, both urban and agricultural.
PART I
GUIDING PRINCIPLES
The CALFED Bay-Delta Program must produce a long-term, balanced solution which:
a. includes sufficient and reliable urban and agricultural water supplies consistent
with local and regional needs and practices;
b. provides for a comprehensive, scientifically based program of ecosystem
improvements and protection;
c. provides water quality levels which protect current users and uses, public health
and safety, and allow for enhanced implementation of recycling and conjunctive
use programs;
d. reduces the vulnerability of Delta levee systems to failure from earthquake,
floods, and similar natural disasters;
e. includes a continued commitment from urban and agriculture water users to best
management practices, as well as a commitment for best management practices
for water used for environmental purposes;
f. recognizes that the water users who rely on the Bay-Delta System do not all affect
the system in the same manner or to the same extent;
g. reaffirms California law and commits to the water fights priority system and the
area of origin laws;
h. is affordable, with beneficiaries paying according to benefits received; and
i. includes a system of guarantees to insure that the CALFED Bay-Delta Program
is implemented in a manner that is balanced and protects the reasonable needs of
all interests.
Water Supply Adequacy and Reliability
1. Improvements in water supply adequacy and reliability must be accomplished in
a manner that reduces the current conflict between environmental resouw, e~ and
water supply needs and is consistent with the goal of developing a balanced
solution in the Bay-Delta.
2. Agriculture and urban water users have lost, due to a variety of independent
factors, substantial quantities of water that were previously available from the
Delta and its tributaries. The CALFED Bay-Delta Program should include
improvements that will restore, to the maximum extent possible, those water
supplies. The Program should also provide urban and agricultural water users
additional water that is surplus to both the environmental needs of the Bay-Delta
system and the needs of water users within the area of origin. At the option of
urban and agricultural water users, this water will be used to develop dependable
water supplies through implementation of measures outside the Delta.
3. The Central Valley Water Users do not expect the CALFED Bay-Delta Program
to solve all of California's water supply problems or to meet all of California's
urban and agricultural water supply needs. However, the Delta and streams
tributary to the Delta are part of California's water supply system and the
CALFED Bay-Delta Program must recognize the need for adequate and reliable
urban and agricultural water supplies for users in all regions of the State that rely
on water from the Delta and its tributaries.
4. The CALFED Bay-Delta Program must provide certainty that "a deal is a deal"
and that, at a minimum, this program will protect water supply adequacy and
reliability from future endangered species actions and other environmental
restrictions imposed by State and Federal regulatory agencies.
5. Water supply adequacy, quality, and reliability are fundamental to California's
sustained economic vitality.
Ecosystem Improvement and Protection Pro_firms
1. Definitive answers are not presently available concerning the best means of
improving ecosystem conditions in the Delta and its tributaries and the benefits
of various proposed actions. Therefore, ecosystem programs should be developed
and administered utilizing an adaptive management approach which allows for
adjustments in the program as additional data are obtained.
2. Other State and Federal ecosystem improvement programs, such as CVPIA
restoration efforts, the Category III program, and the Four Pumps Program,
should be integrated with, and not duplicated by, the CALFED ecosystem efforts.
3. Water quality protection is an important component of an ecosystem improvement
program. Agriculture will continue its efforts to reduce the water quality impacts
of its operations and other dischargers should carry out similar efforts.
4. The CALFED Bay-Delta Program must acknowledge trade-offs to be made
between competing species, and should design programs which assure that healthy
populations of native species are favored over introduced species when conflicts
arise.
$. A proactive policy should be developed to preclude the introduction of foreign
aquatic species as well as to provide measures to control or eliminate existing
foreign species.
6. Actions should be included to reduce illegal fishing and to balance ocean harvest
with the need for adequate spawner escapement.
Water Quality
1. Increasingly numerous and stringent water quality standards demand that high
quality waters be available to provide the best assurance that source waters can
be successfully treated to meet these standards. The outcome of the CALFED
Bay-Delta Program should provide high quality water for all uses.
2. Salinity of source waters must be managed to assure the continued and enhanced
availability of recycling and conjunctive use opportunities.
System Reliability/VulnerabiliW
1. The CALFED Bay-Delta Program should provide water users with certainty that
their water supply needs can be met in the event of seismically induced levee
failures.
2. A comprehensive and cost effective levee improvement and maintenance program
should be included as part of the CALFED Bay-Delta Program.
Best Management Practices
1. Agricultural Best Management Practices ('BMPs") considered by the CALFED
Bay-Delta Program should be based on locally determined actiom and programs.
To memorialize their existing programs and to measure the effectiveness of on-
going improvements, agencies should develop and execute agricultural BMP plans
using standardized evaluation methodologies that measure cost-effectiveness at the
local level.
2. Urban BMPs considered by the CALFED Bay-Delta Program should be based on
locally determined actions and support of the California Urban Water
Conservation Council's efforts to upgrade the performance of urban agencies
BMP implementation, improve measurement of BMPs, and develop additional
BMPs.
3. An Environmental BMP program should be established as part of the CALFED
Bay-Delta Program. As part of this program State and Federal environmental
agencies shall be required to establish procedures to measure the effectiveness of

and to upgrade BIVIPs to ensure that water dedicated to environmental purposes
is being used in an efficient, scientifically justified manner. Water dedicated to
the environment which is not being used efficiently should be redirected to offset
other environmental, urban, and agricultural water supply requirements. In
addition, BMP procedures must require that any additional environmental water
requirements first be met from existing allocations of environmental water that
do not meet BMP's. This would be done before any regulatory agencies reduce
the water supply available to urban and agricultural water uses.
4. Water conserved in water supply deficient areas should continue to be used in
such areas to offset existing shortages.
5. The CALFED Bay-Delta Program must recognize that fixed definitions of
agricultural BMPs are not appropriate because of regional and local differences
in crops grown, use of return flows by other users, and similar factors. BMPs
should be locally developed to take into account such differences and must be
affordable and structured to avoid environmental impacts on other resources, such
as increased extractions from overdrafted groundwater basins.
6. Urban water providers should, in concert with wastewater producers, develop
wastewater recycling programs which utilize a standardized evaluation
methodology and which incorporates a cost-effectiveness analysis.
7. Land retirement is not an appropriate component of an agricultural BMP
program. The loss of productive agricultural land resulting from the CALFED
Bay-Delta Program would violate the solution principle of no redirected impacts,
and thus should not be a part of any CAI~FED alternative. Indeed, the Central
Valley Water Users believe that the CAI,FED Bay-Delta Program should result
in the preservation of farmland and agricultural production which, in turn, may
provide associated wildlife habitat.
Costs, Financin~ and Schedulin~
1. Funding for all elements of the CALFED Bay-Delta Program needs to be
integrated and assured. This will include funding for the ecosystem program
improvements, such as fish screens and fish passage projects on the Sacramento
River and its tributaries.
2. Ecosystem improvement programs and water supply and water quality
improvement projects need to be developed concurrently with no one element of
the CALFED Bay-Delta Program getting ahead of the others.
3. Costs must be reasonable and affordable and beneficiaries must pay according to
benefits received. Cost-benefit analyses of the proposed elements of the
CAI,FED Bay-Delta Program should be carried out before they are finally
approved. As benefits to the environment are broad public benefits, they should
be funded accordingly. Therefore, the State and Federal governments must
provide the funding to implement the environmental restoration components of the
CALFED Bay-Delta Program.
4. Payments by urban and agricultural water users must be based on (a) the actual
quantities of additional water delivered due to the implementation of a CALFED
Bay-Delta solution, and (b) the water quality benefits received.
5. Cost associated with improving Delta water quality to meet urban water quality
requirements must be paid by those entities requesting such improvements and
should not affect the cost or availability of water to other .users.
6. Entities that provide funding for programs benefitting the Bay-Delta System that
are consistent with elements of the CALFED Program, such as CVPIA
restoration or Category III projects, should receive credit toward any potential
obligation for the long-term Bay-Delta solution.
Guarantees
1. Through the CALFED Bay-Delta process, reaffh'm California law and
commitment to the water rights priority system and the area of origin laws.
2. Facilities included as a part of the recommended CALFED Bay-Delta Program
must be constructed and operated consistent with California's water right priority
system, including the area of origin laws.
3. A system must be developed and included as part of the Bay-Delta Program to
ensure that all major elements of the Program -- environmental improvement,
water quality protection, and water supply improvements -- are implemented as
adopted by CALFED.
4. The CALFED Bay-Delta Program must provide certainty that 'a deal is a deal'
and that at a minimum, this program will protect water supply adequacy and
reliability from future endangered species actions and other restrictions imposed
by State and Federal regulatory agencies.
PART II
CENTRAL VALLEY WATER USER'S RECOMMENDATION ON SHORT-LIST
CALFED ALTERNATIVES FOR EHUEIS EVALUATION
Based upon the principles set forth in Part I, and the CALFED workshops and
background materials, the Central Valley Water Users recommend that the alternatives selected
for analysis in the CALFED Bay-Delta EIPUEIS be as follows:
Basic Alterna~iv~
In addition to the no project alternative, three basic alternatives should constitute the short
list:
1. No additional Delta transfer facilities.
2. A through-Delta Alternative.
3. A dual Delta transfer facility with a capacity to be determined through the
EHUEIS process, based upon analysis of urban, environmental, and
agricultural water quantity and quality needs.
The conclusion that these alternatives should be selected for evaluation is not based on
our position of what is an acceptable CALFED Bay-Delta Program. Rather, it is based on what
NEPA and CEQA require to be technically analyzed in order to approve a final Delta program.
The capacities of the dual Delta transfer facilities were intentionally omitted from the
definition of the third alternative. The Central Valley Water Users recommend that the full
range of technically feasible sizes for the isolated portion of the dual facilities be studied, with
emphasis on the range from 5,000 cfs to 15,000 cfs. This alternative's ultimate size and
configuration would be determined by studies that optimized and balanced benefits related to in-
Delta water quality, export water quality, water supply improvements, and environmental
resources. Until studies are run and the results are evaluated, it is too early to reduce
CALFED's flexibility in choosing the proper size and configuration. Again, what is being dealt
with here is the need to fully study this option.
The Central Valley Water Users do not necessarily recommend any alternative at this
time.
Special Pro_re'ams
The alternatives listed above focus on methods of carrying out water supply and water
quality functions. That is because the Central Valley Water Users view the other major elements
of the Delta solution to be special programs that are common to and would be a part of any
alternative selected. The three special programs, which would replace the CALFED core actions
and essential elements, would be:
1. A comprehensive ecosystem program.
2. Urban and agricultural BMPs and implementation of the recommended
"Environmental BMPs.
3. A levee program..
Policies ami approaches related to the ecosystem, best management practices, and levee
programs are set forth in Part I, above.
The Central Valley Water Users recognize that the exact form each of these programs
will ultimately assume will depend on which Delta conveyance alternative is selected. For
example, an ecosystem program for an essentially no new Delta facilities alternative would likely
look quite different from one associated with a dual transfer facility. CALFED should retain
broad flexibility to appropriately structure these programs as part of the EIR/EIS process,
constrained only by overriding principles such as those recommended in Part I.
Storage
In addition to these special programs, the EIR/EIS should analyze various storage projects
as features of each alternative. These components would be of various types (surface or
groundwater), at various locations (North and South of the Delta and in the Delta), and of
various sizes. They should be added to and subtracted from the each of the alternatives so that
their impacts on cost, flexibility, water supply, water quality, and environmental values can be
studied.
As an example, Sacramento/San Joaquin Valley storage will have significant water
supply, water quality, and environmental benefits for Northern California and may potentially
have additional water supply benefits to water users south of the Delta depending, in large part,
upon the other components of the Delta solution. Each alternative should be analyzed with and
without Sacramento/San Joaquin Valley storage (at various sizes and locations), resulting in an
estimation of the benefits and the costs, who could be expected to pay for the benefits derived,
and the comparative value of this storage alternative to other storage alternatives.
Economic Analysis
With respect to costs, the CEQA Guidelines specifically state that economic information
may be included in an EIR or may be presented in whatever form the agency desires. The
Central Valley Water Users recommend that all economic evaluations required to choose the
preferred Delta program be included in the EIR/EIS.

SUBJECT: RENEWAL OF STORM DRAIN AGREEMENTS WITH KERN DELTA WATER
DISTRICT AND COUNTY OF KERN TO ALLOW FOR CONTINUED DISPOSAL
OF URBAN STORM DRAINAGE WATERS INTO KERN ISLAND AND STINE
CANALS (Street Drainage).
Background:
Since prior to 1970, Tenneco West, Inc., and subsequently the Kern Delta Water District,
has maintained storm water discharge agreements with the County and the City for
discharge and disposal into Kern Delta owned and operated canals. These agreements are
a renewal of previous contracts that allow for disposal of storm drainage waters into the
Kern Island and Stine Canals by the City and County. These agreements are patterned
after the Eastside Canal Storm Drain Agreement that was executed in November, 1994 by
the City and County.
The term of these new agreements is for twenty years. The annual fee charged by Kern
Delta will be $400.00 per outlet into both canal systems. The rates charged by Tenneco
West, Inc. per comparable outlet in July, 1970 was $350.00. The City/County share of costs
is based upon the portion of the total area lying within the respective jurisdictions draining
into the transportation facility. There are currently 58 discharge points on the Kern Island
Canal and 10 on the Stine Canal. The operations and maintenance fee received by Kern
Delta is used for removal of silt, weed control, maintaining safe carrying capacity, operating
storm drain weirs, eliminating trash and debris that accumulates from storm flows and the
disposal of the storm water.
Recommended Water Board Action:
Staff requests Water Board recommend approval of Storm Drain Agreements (Kern Island
Canal and Stine Canal) to City Council.

THIS AGREEMENT is made ~ /~ , 1996, by and

between the COtB~TY OF KERN, a body politic and a political
subdivision of the State of California (herein called "County"),
the CITY OF BAKERSFIELD, a chartered city and a body politic of the
State of California lying within the County of Kern (herein called
'City"), and KERN DELTA WATER DISTRICT, a California water district
(herein called "Kern Delta"),

WHEREAS, Kern Delta is the owner and operator of the Kern
Island Canal system designed and used for the purpose of
transporting water for irrigation from Kern River to irrigators
south of the City and within the County; and
· . WHEREAS, certain portions of the City and the County lie to
the east and west of portions of said canal system, wherein the
terrain naturally slopes towards the Kern Island Canal system
(which said portions shall be referred to as the "drainage area");
and
WHEREAS, disposal of storm drainage waters from portions of
the Cit~ and County referred to herein as the drainage area is
needed; and
WHEREAS, City and County have insufficient facilities for the
disposition of said storm drainage waters collecting in said
drainage area, and desire to obtain means to dispose of the same in
some economical and feasible manner; and
WHEREAS, City, County and Kern Delta, entered into previous
agreements for the limited use of the Kern Island Canal System for
the purpose of disposing of storm drainage waters from the drainage
area through certain drain inlets listed in the agreements; and
WHEREAS, said agreements provided for storm drainage waters to
primarily be collected, controlled and disposed of through that
portion of the Kern Island Canal System running through portions of
the populated, incorporated areas of the City, and the County,
hereinafter referred to as the "transportation facility'; and
WHEREAS, City and County now need to provide for continued
storm drainage flow within the drainage area; and
WHEREAS, Kern Delta has agreed to permit the continuation of
storm drainage flow in and through the transportation facility, to
the extent that the same does not interfere with, or prevent, the
simultaneous transportation of irrigation waters through said Kern
Island Canal system, for the term, and in the manner, more
particularly hereinafter provided in this agreement.
NOW, THEREFORE, incorporating the foregoing herein and in
consideration of the promises and the agreements of the respective
parties herein contained, City, County and Kern Delta agree as
follows:

1. Construction of Facilities=
1.1 Existing facilities authorized by this and prior
agreements are set forth in Exhibit 'A" attached hereto and
incorporated herein by this reference. The construction of new
facilities in addition to those described in Exhibit 'A' is not
permitted. City and County acknowledge the limited capacity of
said canal to accept, transport and dispose of the storm and
drainage waters authorized to be discharged hereunder.
Accordingly, the right of City and County to discharge such storm
and drainage water into said canal shall be limited to those
discharges described in said Exhibit 'A". However, should City or
County propose to make alterations to the drain inlets described in
Exhibit "A", City and County, at their sole cost and expense, shall
provide design, construction and inspection of said alterations.
No additional drain inlets, nor alterations to existing drain
inlets which increase the capacity thereof, shall be permitted
without the prior authorization and written approval of Kern Delta.
1.2 Assuming and following written consent and approval
of Kern Delta, City and County may proceed to make said alterations
in accordance with the approved plans and specifications and to
complete the same within a reasonable time thereafter. City and
County shall cause the alterations to the transportation facility
to be made in a manner that will not interfere with or prevent the
scheduled or needed transportation of irrigation water through said
transportation facility and the Kern Island Canal System.
1.3 City and County agree to pay the total cost of

design, construction and inspection of said alterations, including
legal, engineering and personnel expenses reasonably incurred by
Kern Delta in connection therewith. The proportioning of such
costs between City and County shall be as agreed between City and
County.
1.4 As, when and if facilities are altered, the Exhibit
"A" to this agreement shall be amended to reflect such approved
alteration. Each amendment to Exhibit "A" shall be separately
dated and executed by authorized representatives of the parties to
this agreement.
2. Use o~ Transportation Facility:
2.1 During the continuance of this agreement, City and
County may discharge storm drainage waters into the transportation
facility, but only from the storm drain inlets listed and described
in Exhibit
2.2 The parties hereto acknowledge that the capacity of
the transportation facility, as it now exists, to transport storm
drainage waters, in addition to irrigation waters, is limited, and
that said transportation facility may not be able to handle all of
the storm water from the drainage area. When it appears that the
combination of storm drainage waters and irrigation flows .will
exceed the capacity of the transportation facility or the Kern
Island Canal system, all parties agree to use their best efforts,
in cooperation with one another, to reduce the rate of flow
entering the transportation facility or the Kern Island Canal
system.

3. Naintenance of the Transportation Facility1
3.1 Except as specifically otherwise provided in this
agreement, the performance and control of all maintenance and
operation of the Kern Island Canal system and the transportation
facility shall be under the exclusive direction of Kern Delta.
3.2 Kern Delta may require City and County to perform
major maintenance of the transportation facility and the storm
ddain facilities, including inlets and control structures described
in Exhibit "A" that is attributable to storm drainage. City and
County shall each pay its representative portion of the maintenance
required under this paragraph 3.2 based upon its respective
percentage of the storm drainage flow to be discharged into the
transportation facility. The percentages shall be determined by a
pr~ rata portion of the total payment based on the portion of the
totpl area lying within their respective jurisdictions draining
into the transportation facility. Kern Delta shall notify the City
and County of any required major maintenance of the transportation
facility or the storm drain facilities. Thereupon each party shall
appoint a duly authorized representative, who shall meet with the
others as a committee, to determine the nature, amount, and type of
maintenance activity to be performed on the transportation facility
and the storm drain facilities, and to make cost estimates thereof,
and to report their findings to the parties to this agreement. The
decision of the majority of said representatives shall be binding
upon the parties hereto unless a party objects to said report and
serves written notice on the other parties within ten (10) days

after receipt of the same, in which latter event the nature,
amount, and type of maintenance work, as well as the cost thereof,
shall be subject to a further negotiation of the parties. In the
event no agreement is reached, any party may perform maintenance
work at its expense and seek contribution from the other parties in
an action at law.
3.3 Without advance agreement therefor, work of an
emergency nature on said transportation facility and the storm
drain facilities described in Exhibit "A", which Kern Delta deems
necessary to prevent imminent damage to the transportation facility
or the Kern Island Canal system, may be performed by Kern Delta and
the cost thereof added to the next payment due Kern Delta from City
and County; provided, however, that any emergency work performed on
any one occasion shall not continue for a period in excess of 48
hours without written approval of the City and County, acting
through their respective Storm Drain Contact Person appointed
pursuant to this agreement.
4. Compensation:
4.1 As consideration for the use of the transportation
facility for disposing of storm drainage water and for Kern Delta
performing certain operational duties in connection with the
disposition of storm drainage waters through and from said
transportation facility, payment shall be made to Kern Delta of the
sums, at the times, and in the manner hereinafter provided.
4.2 City and County agree to pay the lump sum of $23,200
per annum for the first five (5) years of the term of this

agreement for their respective shares of the following items (see
paragraph 4.3 infra for payments to be made beyond the initial
five (5) years of the term of this agreement). Said amount is
based on a $400 per outlet charge for the 58 existing outlets in
the transportation facility. It is understood and agreed that City
shall pay 65% ($15,080) of the annual fee and County shall pay the
remaining 35% ($8,120) of the annual fee. Said split will be used
to determine amounts owing to Kern Delta for the years 1995 and
1996. The split for 1997 and future years is to be negotiated
between City and County and shall be applied retroactively. Said
annual payment shall be due and payable on January 1st of each and
every year (commencing with a payment retroactive to January 1,
1995) and shall constitute payment for said calendar year:
4.2.1 Removal of all future alluvial deposits and
berms in the Kern Island Canal to obtain maximum storm drainage
carrying capacity.
4.2.2 Building up of Canal banks, where necessary,
to provide adequate storm drainage carrying capacity.
4.2.3 Maintenance of storm drain weirs.
4.2.4 All operations performed in regulating the
Kern Island Canal System to dispose of actual storm drainage flow
or any regulation performed in anticipation of storm drainage flow.
4.2.5 Submergent and emergent weed control, removal
of debris, and fence repair on the transportation facility.
4.3 The parties to the agreement shall review and adjust
the lump sum payment as appropriate and agreed upon in paragraph
7
4.2 supra. Said review shall occur at five (5) year intervals
commencing July 1, 1999, with any adjustments to the yearly lump
sum payment to commence January 1, 2000. Every five (5) years
thereafter, review and adjustment shall occur in a like manner
during the term of this agreement.
4.4 City and County shall pay to Kern Delta two-thirds
of all of the costs incurred by Kern Delta for all structural
improvements to existing canal structures which may become
necessary to maintain storm drainage flow capacity or improve storm
drainage operations, storm drainage maintenance, or storm drainage
capacity. City and County shall each pay its representative
portion of the costs incurred under this paragraph 4.4 based upon
its respective percentage of the storm drainage flow to be
discharged into the transportation facility. The percentages shall
be determined by a pro rata portion of the total payment based on
the portion of the total area lying within their respective
jurisdictions draining into the transportation facility. Except in
the case of an emergency, Kern Delta will endeavor to give City and
County one year notice before performing structural improvements.
4.5 City and County shall pay to Kern Delta all of the
cOsts, if any, incurred by Kern Delta for maintenance of storm
drain inlets, storm drain outlets, or any structures which function
for storm drainage purposes.
4.6 Ail costs incurred on behalf of City and County by
Kern Delta shall be determined by Kern Delta's established
accounting procedures.
4.7 City and County shall be jointly and severally
obligated to pay Kern Delta all sums which may become owing to Kern
Delta under this agreement. Should City and County agree to
apportion said sums, Kern D~lta will bill upon the agreed basis.
All costs incurred by or billed to City will be paid to Kern Delta
through quarterly credits on the established joint facilities
clearing accounts unless and until alternate arrangements are made
between City and Kern Delta. City and County shall pay to Kern
Delta the lump sum set forth in paragraph 4.2 of this agreement on
or before July 15 of each fiscal year this agreement remains in
~ffect (or such pro rata share thereof as is appropriate for any
partial fiscal year that this agreement remains in effect). City
and County shall pay Kern Delta any other sums owing to Kern Delta
within sixty (60) days after billing therefor.
4.8 In-lieu of a portion of City's or County's required
annual payment under paragraph 4.2 supra, City or County may
install or have installed certain improvements such as headwalls,
drive approaches, and sidewalks. The City's improvements shall be
at locations within the City limits along the Kern Island Canal.
Similarly the County's improvements shall be at locations within
the County's boundaries along the Kern Island Canal. The
improvements and the locations for the improvements shall be at the
mutual agreement of City or County and Kern Delta. Said
improvements undertaken by City or County in-lieu of City's or
County's payment shall not exceed one-half of the required annual
payment under paragraph 4.2 supra. For purposes of calculating the

set-off under this paragraph 4.8, Kern Delta will allow one-half of
the total cost of said approved improvement to be deducted from the
payment due to Kern Delta from City or County. (i.e. if cost of
improvement is $10,000.00, then City or County would be entitled to
a $5,000.00 set-off for the improvement. It is understood that
nothing in this paragraph 4.8 or this agreement obligates Kern
Delta to agree to any improvements proposed by City or County and
that without Kern Delta's consent to said improvements, City or
County shall be required to make the full payment required under
paragraph 4.2.
5. Ownership and Use of Storm Drainage Water:
5.1 For purposes of this agreement, "storm drainage
water" refers to all waters delivered into the transportation
facility through the drain inlets described in Exhibit "A".
5.2 Ail storm drainage water delivered into the
transportation facility or the Kern Island Canal system shall be
and become the property of Kern Delta, and may be used or disposed
of by any lawful manner including, without limitation, by delivery
to landowners, by percolation to underground storage, by permitting
the same to flow down the Kern Island Canal, or any combination
thereof.
Water Quality and Monitoring:
6.1 City and County have each adopted a Stormwater
Ordinance in compliance with their joint National Pollutant
Discharge Elimination System (NPDES) Municipal Stormwater Permit
Application. These ordinances are applicable to the stormwater

systems served by the storm drain inlets to the transportation
facility.
6.2 'City and County Stormwater Ordinances require
compliance with the strictest of any applicable Federal or State
standards or regulations covering the discharge of stormwater or
surface water.
6.3 City and County have instituted a monitoring program
to determine the concentration of selected constituents in the
discharges measured at representative sites in the City and County,
in conformance with the NPDES permit application. Results of the
monitoring program will be made available to Kern Delta when it is
submitted to the California Regional Water Quality Control Board
for their review. This is to assist Kern Delta in an effort to
establish a background profile of the selected constituents
included within the water discharged into the transportation
facility by the City and County.
6.4 In addition to the foregoing, and without limiting
the same, City and County shall not discharge, and shall not permit
others to discharge, into the storm drains or into the
transportation facility or said Kern Island Canal system, any
sewage, debris, industrial waste waters, waters contaminated with
oil, or other substances, which would render the water unfit for
irrigation or other like purposes, or tend to or cause damage to
crops from use thereof, or tend to or cause damage to the canal
facilities.
6.5 In using the transportation facility pursuant to

this agreement, City and County shall comply with all present and
future discharge requirements imposed by laws, rules or regulations
of the State of California or the United States.
7. Indemnity and Insurance:
7.1 City and County shall save, protect, and hold
harmless Kern Delta of and from all claims, suits, demands and
liabilities whatever to any person or persons or corporations, by
reason of bodily injuries, deaths, and by reason of damage to, or
destruction of, any property resulting in whole or in part from the
exercise of the right of City and County hereunder and the
discharge of storm drainage water into and the disposition of storm
drainage water through the transportation facility or the Kern
Island Canal system.
7.2 City and County shall, at their own expense, carry
insurance to protect Kern Delta of and from any and all such claims
and the indemnity agreement hereinabove set forth, by obtaining
public liability insurance with liability limits of not less than
$2,000,000.00 for the injury or death of any one person in any one
accident, and $2,000,000.00 for the injury or death of more than
one person in any one accident, and property damage insurance in an
amount of not less than $1,000,000.00, all such insurance to be
carried with insurance companies satisfactory to Kern Delta.
Regardless of the above, City and County may self-insure any or all
of the insurance requirements hereof.
7.3 Except when self-insured, City and County shall,
upon demand, procure and cause to be furnished to Kern Delta, a

certificate or certificates from said insurance companies, stating
that said insurance is in full..force and effect, that the premiums
thereon have been paid, that the insurance companies will give Kern
Delta at least thirty (30) days' prior written notice of any
termination or cancellation of the same, and of any modification of
the terms of such insurance. When self-insured, City and County
shall, upon demand, provide Kern Delta written acknowledgement
thereof.
8. Term and Termination:
8.1 Unless terminated in a manner hereinafter provided,
this agreement shall be for a term of twenty (20) years, commencing
January 1, 1995. Any of the parties hereto may terminate this
agreement subsequent to said twenty-year period by written notice
given at least ninety (90) days before the end of each year.
8.2 Kern Delta may terminate this agreement by giving
sixty (60) days' written notice to the other parties hereto, if
City and County, or either of them, default in making the payments
required of them, or if they, or either of them, otherwise default
in the performance of their agreements herein contained, and fail
to remedy said defaults within sixty (60) days after written notice
to do so.
8.3 Upon any termination of this agreement, City and
County shall, if requested to do so by Kern Delta, remove, or pay
to Kern Delta the cost of removing, all storm drainage facilities
from the canal. Removal and restoration shall be completed to the
reasonable satisfaction of Kern Delta.

9. Miscellaneous:
9.1 This document represents the entire agreement
between the parties with respect to the subject matter hereof.
This agreement replaces any and all prior agreements between the
parties with respect to the subject matter hereof, whether written
or oral, without limitation.
9.2 Kern Delta may assign all of its rights and
obligations to any public body or private corporation succeeding to
the ownership and operation of the Kern Island Canal system, which
assignee shall agree to perform the obligations of Kern Delta under
this agreement and, in the event of such assignment, Kern Delta
shall be relieved of all further obligation hereunder. City and
County, or either of them, may in like manner assign their rights
and obligations in this agreement to any duly organized public body
or district of the State of California which is authorized to and
agrees to pay and to perform City's and County's obligations
hereunder, and thereafter City and County shall be relieved of all
further obligations hereunder.
9.3 The parties to this agreement shall appoint and
designate a person on their respective staffs who shall be
identified as the "Storm Drain Contact Person." This person shall
be available to all other parties for information and expression of
concerns regarding maintenance, increasing storm drainage
discharges and capacity, compliance with quality requirements,
monitoring, and any other matter relating to this agreement. The
object of this provision is to provide a definite and easily

instituted method of communication between all the parties to this
agreement with the assurance that the individual named as the Storm
Drain Contact Persou will hav® sufficient authority to and will
respond by action to all concerns expressed to him or her by the
other parties.
9.4 Any notice or demand by any party to the others in
connection with this agreement shall be deemed to be fully given or"
made when written and deposited in a sealed envelope in the United
States Mail, registered and postage prepaid and addressed as
follows:

STORM DRAIN AGREEMENT
(Stine CanaX)
THIS AGREEMENT is made , 1996, by and
between the COUNTY OF KERN, a body politic and a political
subdivision of the State of California (herein called "County'),
the CITY OF BAKERSFIELD, a chartered city in the State of
California, County of Kern (herein called 'City'), and KERN DELTA
WATER DISTRICT, a California water district (herein called 'Kern
Delta"),
W I TN E S S H T H:
WHEREAS, Kern Delta is the owner and operator of the Stine
Canal system designed and used for the purpose of transporting
water for irrigation from Kern River to irrigators south of the
City and within the County; and
WHEREAS, certain portions of the City and the County generally
lie to the east and west of portions of said canal system, wherein
the terrain naturally slopes towards the Stine Canal system (which
said portions shall be referred to as the "drainage area"); and
WHEREAS, disposal of storm 'drainage waters from portions of
the City and County referred to herein as the drainage area is
needed; and
WHEREAS, City and County have insufficient facilities for the
disposition of said storm drainage waters collecting in said
drainage area, and desire to obtain means to dispose of the same in
some economical and feasible manner; and
WHEREAS, City, County and Kern Delta, entered into previous
agreements for the limited use of the Stine Canal System for the
purpose of disposing of storm drainage waters from the drainage
area through certain drain inlets listed in the agreements; and
WHEREAS, said agreements provided for storm drainage waters to
primarily be collected, controlled and disposed of through that
portion of the Stine Canal System running through portions of the
populated, incorporated areas of the City, and the County,
hereinafter referred to as the "transportation facility"; and
WHEREAS, City and County now need to provide for continued
storm drainage flow within the drainage area; and
WHEREAS, Kern Delta has agreed to permit the continuation of
storm drainage flow in and through the transportation facility, to
the extent that the same does not interfere with, or prevent, the
simultaneous transportation of irrigation waters through said Stine
Canal system, for the term, and in the manner, more particularly
hereinafter provided in this agreement.
NOW, THEREFORE, incorporating the foregoing recitals herein
and in consideration of the promises and the agreements of the
respective parties herein contained, City, County and Kern Delta
agree as follows:
Construction o~
1.1 Existing facilities authorized by this and prior
agreements are set forth in Exhibit "A" attached hereto and
incorporated herein by this reference. The construction of new
facilities in addition to those described in Exhibit "A" is not
permitted. City and County acknowledge the limited capacity of
said canal to accept, transport and dispose of the storm and
drainage waters authorized' to be discharged hereunder.
Accordingly, the right of City and County to discharge such storm
and drainage water into said canal shall be limited to those
discharges described in said Exhibit "A". However, should City or
County propose to make alterations to the drain inlets described in
Exhibit "A", City and County, at their sole cost and expense, shall
provide design, construction and inspection of said alterations.
No additional drain inlets, nor alterations to existing drain
inlets which increase the capacity thereof, shall be permitted
without the prior authorization and written approval of Kern Delta.
1.2 Assuming and following written consent and approval
of Kern Delta, City and County may proceed to make said alterations
in accordance with the approved plans and specifications and to
complete the same within a reasonable time thereafter. City and
County shall cause the alterations to the transportation facility
to be made in a manner that will not interfere with or prevent the
scheduled or needed transportation of irrigation water through said
transportation facility and the Stine Canal System.
1.3 City and County agree to pay the total cost of
design, construction and inspection of said alterations, including
legal, engineering and personnel expenses reasonably incurred by
Kern Delta in connection therewith. The proportioning of such
costs between City and County shall be as agreed between City and
County.
1.4 As, when and if facilities are altered, the Exhibit
"A" to this agreement shall be amended to reflect such approved
alteration. Each amendment to Exhibit "A" shall be separately
dated and executed by authorized representatives of the parties to
this agreement.
2. Use of Transportation Facility:
2.1 During the continuance of this agreement, City and
County may discharge storm drainage waters into the transportation
facility, but only from the storm drain inlets listed and described
in Exhibit "A".
2.2 The parties hereto acknowledge that the capacity of
the transportation facility, as it now exists, to transport storm
drainage waters, in addition to irrigation waters, is limited, and
that said transportation facility may not be able to handle all of
the storm water from the drainage area. When it appears that the
combination of storm drainage waters and irrigation flows will
exceed the capacity of the transportation facility or the Stine
Canal system, all parties agree to use their best efforts, in
cooperation with one another, to reduce the rate of flow entering
the transportation facility or the Stine Canal system.

3, ~a£ntenance of the ~ransportat£on Facil£t¥~
3.1 Except as specifically otherwise provided in this
agreement, the performance and control of all maintenance and
operation of the Stine Canal system and the transportation facility
shall be under the exclusive direction of Kern Delta.
3.2 Kern Delta may require City and County to perform
major maintenance of the transportation facility and the storm
drain facilities, including inlets and control Structures described
in Exhibit "A" that is attributable to storm drainage. City and
County shall each pay its representative portion of the maintenance
required under this paragraph 3.2 based upon its respective
percentage of the storm drainage flow to be discharged into the
transportation facility. The percentages shall be determined by a
pro rata portion of the total payment based on the portion of the
total area lying within their respective jurisdictions draining
into the transportation facility. Kern Delta shall notify the City
and County of any required major maintenance of the transportation
facility or the storm drain facilities. Thereupon each party shall
appoint a duly authorized representative, who shall meet with the
others as a committee, to determine the nature, amount, and type of
maintenance activity to be performed on the transportation facility
and the storm drain facilities, and to make cost estimates thereof,
and to report their findings to the parties to this agreement. The
decision of the majority of said representatives shall be binding
upon the parties hereto unless a party objects to said report and
serves written notice on the other parties within ten (10) days

after receipt of the same, in which latter event the nature,
amount, and type of maintenance work, as well as the cost thereof,
shall be subject to a further negotiation of the parties. In the
event no agreement is reached, any party may perform maintenance
work at its expense and seek contribution from the other parties in
an action at law.
3.3 Without advance agreement therefor, work of an
emergency nature on said transportation facility and the storm
drain facilities described in Exhibit 'A', which Kern Delta deems
necessary to prevent imminent damage to the transportation facility
or the Stine Canal system, may be performed by Kern Delta and the
cost thereof added to the next payment due Kern Delta from City and
County; provided, however, that any emergency work performed on any
one occasion shall not continue for a period in excess of 48 hours
without written approval of the City and County, acting through
their respective Storm Drain Contact Person appointed pursuant to
this agreement.
4. Compensation:
4.1 As consideration for the use of the transportation
facility for disposing of storm drainage water and for Kern Delta
performing certain operational duties in connection with the
disposition of storm drainage waters through and from said
transportation facility, payment shall be made to Kern Delta of the
sums, at the times, and in the manner hereinafter provided.
4.2 City and County shall pay the lump sum of $4,000 per
annum for the first five (5) years of the term of this agreement

for their respective shares of the following items (see paragraph
4.3 infra for payments to be made beyond the initial five (5) years
of the term of this agreement). Said amount is based on a $400 per
outlet charge for the 10 existing outlets in the transportation
facility. It is understood and agreed that City shall pay 80%
($3,200) of the annual fee and County shall pay the remaining 20%
($800) of the annual fee. Said annual payment shall be due and
payable on January' 1st of each and every year (commencing with a
payment retroactive to January 1, 1995) and shall constitute
payment for said calendar year:
4.2.1 Removal of all future alluvial deposits and
berms in the Stine Canal to obtain maximum storm drainage carrying
capacity.
4.2.2 Building up of Canal banks, where necessary,
to provide adequate storm drainage carrying capacity.
4.2.3 Maintenance of storm drain weirs.
4.2.4 All operations performed in regulating the
Stine Canal System to dispose of actual storm drainage flow or any
regulation performed in anticipation of storm drainage flow.
4.2.5 Submergent and emergent weed control, removal
of debris, and fence repair on the transportation facility.
4.3 The parties to the agreement shall review and adjust
the lump sum payment as appropriate and agreed upon in paragraph
4.2 supra. Said review shall occur at five (5) year intervals
commencing July 1, 1999, with any adjustments to the yearly lump
sum payment to commence January 1, 2000. Every five (5) years

thereafter, review and adjustment shall occur in a like manner
during the term of this agreement.
4.4 City and County shall pay to Kern Delta two-thirds
of all of the costs incurred by Kern Delta for all structural
improvements to existing canal structures which may become
necessary to maintain storm drainage flow capacity or improve storm
drainage operations, storm drainage maintenance, or storm drainage
capacity. City and County shall each pay its representative
portion of the costs incurred under this paragraph 4.4 based upon
its respective percentage of the storm drainage flow to be
discharged into the transportation facility. The percentages shall
be determined by a pro rata portion of the total payment based on
the portion of the total area lying within their respective
jurisdictions draining into the transportation facility. Except in
the case of an emergency, Kern Delta will endeavor to give City and
County one year notice before performing structural improvements.
4.5 City and COunty shall pay to Kern Delta all of the
costs, if any, incurred by Kern Delta for maintenance of storm
drain inlets, storm drain outlets, or any structures which function
for storm drainage purposes.
4.6 All costs incurred on behalf of City and County by
Kern Delta shall be determined by Kern Delta's established
accounting procedures.
4.7 City and County shall be jointly and severally
obligated to pay Kern Delta all sums which may become owing to Kern
Delta under this agreement. Should City and County agree to

apportion said sums, Kern Delta will bill upon the agreed basis.
All costs incurred by or billed to City may be paid to Kern Delta
through quarterly credits on the established joint facilities
clearing accounts. City and County shall pay to Kern Delta the
lump sum set forth in paragraph 4.2 of this agreement on or before
July 15 of each fiscal year this agreement remains in effect (or
such pro rata share thereof as is appropriate for any partial
fiscal year that this agreement remains in effect). City and
County shall pay Kern Delta any other sums owing to Kern Delta
within sixty (60) days after billing therefor.
4.8 In-lieu of a portion of City's or County's required
annual payment under paragraph 4.2 supra, City or County may
install or have installed certain improvements such as headwalls,
drive approaches, and sidewalks. The City's improvements shall be
at locations within the City limits along the Stine Canal.
Similarly the County's improvements shall be at locations within
the County's boundaries along the Stine Canal. The improvements
and the locations for the improvements shall be at the mutual
agreement of City or County and Kern Delta. Said improvements
undertaken by City or County in-lieu of City's or County's payment
shall not exceed one-half of the required annual payment under
paragraph 4.2 supra. For purposes of calculating the set-off under
this paragraph 4.8, Kern Delta will allow one-half of the total
cost of said approved improvement to be deducted from the payment
due to Kern Delta from City or County. (i.e. if cost of improvement
is $1,000.00, then City or County would be entitled to a $500.00

set-off for the improvement. It is understood that nothing in this
paragraph 4.8 or this agreement obligates Kern Delta to agree to
any improvements proposed by City or County and that without Kern
Delta's consent to said improvements, City or County shall be
required to make the full payment required under paragraph 4.2.
5. Ownership and Use of Storm Drainage Water:
5.1 For purposes of this agreement, "storm drainage
water" refers to all waters delivered into the transportation
facility through the drain inlets described in Exhibit "A".
5.2 All storm drainage water delivered into the
transportation facility or the Stine Canal system shall be and
become the property of Kern Delta, and may be used or disposed of
by it in any lawful manner including, without limitation, by
delivery to landowners, by percolation to underground storage, by
permitting the same to flow down the Stine Canal, or any
combination thereof.
6. Water Quality and Monitoring:
6.1 City and County have each adopted a Stormwater
Ordinance in compliance with their joint National Pollutant
Discharge Elimination System (NPDES) Municipal Stormwater Permit
Application. These ordinances are applicable to the stormwater
systems served by the storm drain inlets to the transportation
facility.
6.2 City and County Stormwater Ordinances require
compliance with the strictest of any applicable Federal or State
standards or regulations covering the discharge of stormwater or

surface water.
6.3 City and County have instituted a monitoring program
to determine the concentration of selected constituents in the
discharges measured at representative sites in the City and County,
in conformance with the NPDES permit application. Results of the
monitoring program will be made available to Kern Delta when it is
submitted to the California Regional Water Quality Control Board
for their review. This is to assist Kern Delta in an effort to
establish a background profile of the selected constituents
included within the water discharged into the transportation
facility by the City and County.
6.4 In addition to the foregoing, and without limiting
the same, City and County shall not discharge, and shall not permit
others to discharge, into the storm drains or into the
transportation facility or said Stine Canal system, any sewage,
debris, industrial waste waters, and waters contaminated with oil,
or other substances, which would render the water unfit for
irrigation or other like purposes, or tend to or cause damage to
crops from use thereof, or tend to or cause damage to the canal
facilities.
6.5 In using the transportation facility pursuant to
this agreement, City and County shall comply with all present and
future discharge requirements imposed by laws, rules or regulations
of the State of California or the United States.
7. Indemnity and Insurance:
7.1 City and County shall save, protect, and hold
harmless Kern Delta of and from all claims, suits, demands and
liabilities whatever to any person or persons or corporations, by
reason of bodily injuries, deaths, and by reason of damage to, or
destruction of, any property resulting in whole or in part from the
exercise of the right of City and County hereunder and the
discharge of storm drainage water into and the disposition of storm
drainage water through the transportation facility or the Stine
Canal system.
7.2 City and County shall, at their own expense, carry
insurance to protect Kern Delta of and from any and all such claims
and the indemnity agreement hereinabove set forth, by obtaining
public liability insurance with liability limits of'not less than
$2,000,000.00 for the injury or death of any one person in any one
accident, and $2,000,000.00 for the injury or death of more than
one person in any one accident, and property damage insurance in an
amount of not less than $1,000,000.00, all such insurance to be
carried with insurance companies satisfactory to Kern Delta.
Regardless of the above, City and County may self-insure any or all
of the insurance requirements hereof.
7.3 Except when self-insured, City and County shall,
upon demand, procure and cause to be furnished to Kern Delta, a
certificate or certificates from said insurance companies, stating
that said insurance is in full force and effect, that the premiums
thereon have been paid, that the insurance companies will give Kern
Delta at least thirty (30) days' prior written notice of any
termination or cancellation of the same, and of any modification of

the terms of such insurance. When self-insured, City and County
shall, upon demand, provide Kern Delta written acknowledgement
thereof.
8. Term and Termination:
8,1 Unless terminated in a manner hereinafter provided,
this agreement shall be for a term of twenty (20) years, commencing
January 1, 1995. Any of the parties hereto may terminate this
agreement subsequent to said twenty-Year period by written notice
given at least ninety (90) days before the end of.each year.
8.2 Kern Delta may terminate this agreement by giving
sixty (60) days' written notice to the other parties hereto, if
City and County, or either of them, default in making the payments
required of them, or if they, or either of them, otherwise default
in the performance of their agreements herein contained, and fail
to remedy said defaults within sixty (60) days after written notice
to do so.
8.3 Upon any termination of this agreement, City and
County shall, if requested to do so by Kern Delta, remove, or pay
to Kern Delta the cost of removing, all storm drainage facilities
from the canal. Removal and restoration shall be completed to the
reasonable satisfaction of Kern Delta.
9. Miscellaneous:
9.1 This document represents the entire agreement
between the parties with respect to the subject matter hereof.
This agreement replaces any and all prior agreements between the
parties with respect to the subject matter hereof, whether written

or oral, without limitation.
9.2 Kern Delta may assign all of its rights and
obligations to any public body or private corporation succeeding to
the ownership and operation of the Stine Canal system, which
assignee shall agree to perform the obligations of Kern Delta under
this agreement and, in the event of such assignment, Kern Delta
shall be relieved of all further obligation hereunder. City and
County, or either of them, may in like manner assign their rights
and obligations in this agreement to any duly organized public body
or district of the State of California which is authorized to and
agrees to pay and to perform City's and County's obligations
· hereunder, and thereafter City and County shall be relieved of all
further obligations hereunder.
9.3 The parties to this agreement shall appoint and
designate a person on their respective staffs who shall be
identified as the "Storm Drain Contact Person." This person shall
be available to all other parties for information and expression of
concerns regarding maintenance, increasing storm drainage
discharges and capacity, compliance with quality requirements,
monitoring, and any other matter relating to this agreement. The
object of this provision is to provide a definite and easily
instituted method of communication between all the parties to this
agreement with the assurance that the individual named as the Storm
Drain Contact Person will have sufficient authority to and will
respond by action to all concerns expressed to him or her by the
other parties.

9.4 Any notice or demand by any party to the others in
connection with this agreement shall be deemed to be fully given or
made when written and deposited in a sealed envelope in the United
States Mail, registered and postage prepaid and addressed as
follows:

2800 ACRE RECHARGE FACILITY
1995 OPERA TIONS
During the 1995 calendar year, 148,332 acre-feet from combined Kern River, Federal
and State water sources was spread in the 2800 Acre facility. In the 20-year history of the
City's 2800 Acre project, only the 1986 year total of 153,131 acre-feet surpassed the 1995
recharge amount. Kern River water deliveries into the 2800 Acres during 1995 amounted
to 57,525 acre-feet, a reflection of the 199% of normal Kern River April through July
runoff.
The City of Bakersfield, Olcese Water District, Buena Vista Water Storage District
and the Kern County Water Agency all scheduled water for recharge on the 2800 Acre
property during 1995. A new benchmark was established in 1995 when the cumulative
recharge by all participants (since inception of the project) exceeded the one million mark
during the year, ending at 1,094,057 acre-feet.
The City was notified by the Friant Water Users Authority on February 16, 1995, of
its plans to commence flood releases from the Friant-Kern Canal into the Kern River
channel. The following day, the Friant Authority began releases of 1,200 cubic feet per
second out of the end of the Friant-Kern Canal. Full operation of the Kern River channel
and 2800 Acre Recharge Facility during this flood release period served to minimize
downstream flooding problems while maximizing the recharge of the imported Federal water
the Kern River fan for local benefit.

In July, the Kern County Water Agency's planned use of the 2800 Acre facility for
banking purposes was disrupted poor quality Project supplies
due
to
the

water
caused by high turbidity levels. To help circumvent the water quality issue, an arrangement
between City and Agency for interim use of the 2800 Acres went into effect on July 15,
1995. The operation resulted in the recharge of high quality Kern River and Federal water
supplies acquired by Agency and others in the 2800 Acre spreading area during periods of
time that the Agency's Pioneer Property, the Berrenda Mesa Property and the Kern Water
Bank were at capacity. Under the terms of this unique operation, future recovery of the
water spread by Agency will be from wells located off the 2800 Acre property. All .told,
34,333 acre-feet of additional water was spread in the 2800 Acres under the City/Agency
interim use agreement.
In August of 1995, the City began producing water from one of its domestic wells
situated in the 2800 Acres, delivering the water easterly by pipeline into the City's domestic
water system. This event marked the inaugural operation of the City's Agricultural/Domestic
Water Interface Project, allowing for water previously spread and banked by City in the
2800 Acres to be recovered and utilized directly by Bakersfield residents.
