The meeting was called to order by Boardmember Salvaggio at 4:06pm. 2. Present: Mark Salvaggio, Chair Patricia M. Smith Jacquie Sullivan (seated at 4:15pm) 3. Boardmember Salvaggio made a motion to approve the minutes of the Regular Meeting held March 18, 1998. Motion carried. 4. There were no public statements. 5. Water Superintendent Patrick Hauptman gave an update on the current Kern River operations. On April 29th the Corp of Engineers took over operation of Lake Isabella and put the Kern River Group on mandatory release to evacuate storage in anticipation of the predicted large snowmelt. Kern River outflow for Isabella is 3,800 cfs and minor stream inflows to the Kern River bring First Point to about 4,150 cfs. As of May 20th the state estimated the Kem River April/July runoff would be 226% of normal. Kern River flows are expected to increase to 5,000 cfs in the Bakersfield area output throughout the summer and possibly into the fall. For Board information, no action required. 6. New Business 6A. The Agricultural and Domestic water divisions 1998 water price schedules were presented by Mr. Core. The Agricultural Division's water rates are generally not to be increased this year. Some categories will decrease due to a drop in the pricing indexes. The Domestic Water rates that have been in effect since October 1996 will continue at least through June of 1999. Because of a fourth wet year in a row, electricity rates being flat for the past year and one-half and the Interface project online (reducing pump taxes), staff is not requesting a Domestic Water rate increase at this time. For Board information, no action required. 6B. The renewal of the exchange agreement with Buena Vista Water Storage District was brought before the Board by Mr. Bogart. The agreement with Buena Vista WSD would allow the City, when there is not enough water in the river during dry years, to pump groundwater from the "2800 Acres" and deliver to Buena Vista WSD in exchange for a Kern 1 River supply to areas upstream of the "2800 Acres." This exchange will also allow the Northeast Bakersfield Water Supply project to move forward and insure a firm supply to the citizens in the northeast. A motion was made by Boardmember Smith for approval of the agreement. Motion carried. 6C. A Resolution requesting Kern River Parkway funding from potential 1998 state budget surplus was presented to the Board by Mr. Bogart. In light of a large state budget surplus, many state legislators are submitting funding requests for various projects and programs. The Kern River Parkway is an ongoing project that has broad community support and is in need of funding in order to complete the plan. A Resolution to our representatives is essential to earmark a portion of the proposed $25,000,000 for statewide Parkway projects. This Resolution requests support of our state legislators for funding to complete the Kern River Parkway. A recommendation for approval of the Resolution to City Council was made by Boardmember Smith. Motion carded. 7. Closed Session. Adjourned to Closed Session at 4:17pm. 7A. Conference with legal counsel - existing litigation. Boardmembers and staff left on a scheduled tour of the Kern River and potential property acquisition sites. Boardmembers and staff returned fi'om the tour at 7:10pm. 10. SUBJECT: ACQUISITION OF WATTENBARGER PROPERTY Don Anderson has informed me that an agreement on sales price was reached yesterday on the Wattenbarger property. As you know, this parcel is contiguous to the Kern River Parkway and has a high prior/ty with respect to Kern River land acquisitions. According to Don the negotiated price for the property is based on two options. The first option is for $125,000 cash. The second option is for $138,000 over three years or $46,000 per year. In order to keep funds available for other Kern River land acquisitions this year we recommend that the property be purchased over a three year period with an option to pay offthe loan earlier without any payoff penalties. This will allow more funding for future land purchase opportunities and provide additional funding for appraisal fees and other such acquisition related costs that are not eligible for Proposition 204 funding during the 1998-99 fiscal year. We will be taking this item to the Water Board for their consideration and recommendation on July 29, 1998. If you need any further information or documentation from us at this time, please call. As you may know, the Budget Conference Committee is continuing to meet in an attempt to craft a state budget. I have forwarded your letters on to the committee for their review and consideration. Once the conference committee agrees on a budget, it will be presented to the entire legislature. At that time I will have an opportunity to cast my vote either in support, or in opposition, of the entire budget. I will not, however, be able to vote for just one particular portion of the budget, such as the item you have written me. It is an all or nothing propositiOn. Please be assured, however, that I will do my best to make sure your budget priorities are given the attention 'they deserve by letting the committee members know what issues are important to me. Adrienne J. Mathews Division 5 Berrenda Mesa Water District (District), a member unit of the Kern County Water Henry C. Garnett Agency (Agency), has entered into an agreement to permanently sell 8,000 acre-feet of Division 6 the District's State Water Project (SWP) entitlement to Western Hills Water District. Gene A. Lundquist The price of the entitlement is a one-time charge of $1,000 per acre-foot, plus future Vice President SVi/P costs. A copy of said agreement is enclosed. Division 7 Pursuant to the Monterey Amendment to the SWP contracts, up to 130,000 acre-feet Thomas N. Clark of SWP entitlement can be made available for sale on a permanent basis by the SWP General Manager Agricultural Contractors provided, however, that local interests be given a 90 day John F. Stovall right of first refusal option to purchase at the price offered. This 8,000 acre-foot sale General Counsel will be considered as part of the 130,000 acre-feet, unless it is purchased by a local interest. If your district wishes to exercise this option it must notify the Agency and Berrenda Mesa Water District by certified letter on or before 5:00 p.m. Monday, September 14, 1998 that it will purchase the Berrenda Mesa SWP entitlement under the same terms, conditions and price as agreed to by Western Hills Water District.
