MINUTES WATER BOARD - CITY OF BAKERSFIELD WEDNESDAY, DECEMBER 2, 1981 4:00 P.M. The meeting was called to order by Vice-Chairman Payne in the Department of Water Conference Room. The secretary called the roll as follows: Present: Payne, Ratty, Kelmar Absent: Barton, Oberholzer The minutes from the meeting of October 14, 1981, were approved as presented. A'request to purchase larger water storage facilities for Tracts 4188 and 4190 located adjacent to Stockdale Highway, 1/4 mile west of Allen Road was presented to the board for consideration. Dale Hawley, Public Works Director at this time gave a map illustration of the area involved. The staff recommends the use of up to $14,000 for the purpose of the additional water storage capacity. Mr. Kelmar made a motion that the board authorize the expenditure of funds to obtain the additiQnal storage capacity. The motion was passed. There being no further business to come before the board, Vice- Chairman Payne adjourned the meeting at 4:07 P.M. James J. Barton, Chairman City of Bakersfield Water Board Linda Hostmyer, Secretary City of Bakersfield Water Board Mr. Robert McCarthy President Kern County Water Agency 4114 Arrow Street Post Office Box 58 Bakersfield, California 93302 Re: Improvement District No. 4 Reorganization Dear Mr. McCarthy: During the past 2% years we have been discussing a possible reorganization of Improvement District No. 4 directed toward the creation of an autonomous entity with its own board of directors. The result of the initial discussion was that our special counsel, Stanley C. Hatch, worked with Judge Roy Gargano, your counsel, to determine the various methods by which this might be done. The result of these discussions was some proposed legislation which was designed to protect the existing rights and powers of Improvement District No. 4 by minimizing the organizational changes and creating a new board to manage the existing District. We had the impression .this approach would be acceptable to your Board. We are now told, informally, that this is not the case and that instead you apparently favor a greater form of autonomy by the creation of a separate entity over which your Board has no supervisory duties. It is the Water Board's feeling that definite action should be taken. However, to avoid costly delays and wasted effort we need some authoritative indication of the direction in which we should proceed. Consequently, we would request that your Board take formal action to indicate to our Board whether you favor: 1. Legislation which would create an independent Board of Trustees for the existing Improvement District No. 4, as 150'1 TRUXTUN AVENUE · BAKERSFIELD, CALIFORN IA 93301 · (805) 861-2715 Mr. Robert McCarthy Kern County Water Agency December 9, 1981 Page 2 proposed in the documentation previously provided to Judge Gargano by Mr. Hatch; or 2. Total separation of Improvement District No. 4 from the Kern County Water Agency by the legislative formation of a new and separate district to which the assets of Improvement District No. 4 and the powers and obligations of that District would be transferred. This alternative would also involve the execution of a member unit contract similar to those used for other member units to create an on-going relationship between the Agency and the new district, or 3. Some other method of reorganization. This matter has been pending since at least June 1979 when your Agency initially responded favorably to a recommendation by the Water District's Advisory Committee that this action be taken. Because the 1982 Legislative session is almost upon us, we would like to have some direction from you so that appropriate legislation can be timely introduced to achieve this objective.
