WATER BOARD - CITY OF BAKERSFIELD
WEDNESDAY, DECEMBER 12, 1984
12:00 P.M. "NOON
The meeting was called to order by Chairman Barton in the
Department of Water Resources Conference Room.
The secretary called the roll as follows:
Present: Barton (Chairman) , Moore, Ratty
The minutes from the meeting of October 10, 1984 were approved
as presented.
There were no public statements nor correspondence received.
Mr. Bogart presented to the Board the Agreement for Transportation,
Exchange of Water and System Capacity between North Kern W.S.D.
and Cawelo W.D. Since this exchange agreement involves the use of
the Beardsley Canal, City Basic Contract water and North Kern W.S.D.
use of Kern River water, it will require City approval before the
agreement can be implemented. This item was discussed at length.
The staff recommended, since this is a long-term agreement, that
it be presented before the City Council. A motion was made by
Mr. Moore that the Board make a recommendation for Council to accept
the agreement and cover letter. Motion passed.
The proposed 5-year (1985-1989) agreement for the sale of City
Oilfield Discharge water to Cawelo Water District was presented
before the Board by Mr. Core. In the discussion of the agreement
it was stated that the price would be established each year based
on current conditions. Dr. Ratty made a motion to.recommend to
Council approval of agreement. Motion passed.
Proposed Weather Modification Agreement~for City .participation
in the 1984~85 cloud seeding operation on the Kern River watershed
was presented before the Board for their consideration. Mr. Caravalho
raised a question regarding problems of liability claims and per~
formance. Mr. Daniel, of the City Attorney's office, said he would
contact Mr. Conant, the attorney who prepared' the agreement,, to have
clauses added pertaining to this. Mr. Daniel said the agreement
also talks about suspension of cloud seeding operations, but never
about total cancellation, he thought this should be clarified.
Dr. Ratty made a motion to approve this agreement starting January 1,
1985, subject to approval of City Attorney's office. Motion passed.
Mr. Core presented, for Board information, a mainline extension
with Tenneco Realty Development Corp. in the amount of $40,264.00
on Parcel Map No. 6722.
A motion was made by Mr. Moore to adjourn to Closed Session. Motion
passed.
Reopened to the public.
There were no staff comments.
It was brought before the Board by Mr. Barton, Chairman, that
there be a change of Chairmanship of the Water Board. Dr. Ratty
made a motion to nominate Mr. Moore as Chairman of the Water Board
and Mr. Barton as vice-Chairman. Motion passed.
The meeting adjourned at l:40p.m.

WELL, PUMF, PIPELINE AND RELATED FACILITIES
In accordance with the provisions of Agreement No. 77-07 W.B. between
the CITY OF BAKERSFIELD and the OLCESE WATER DISTRICT, dated November 9, 1977,
as amended, the OLCESE WATER DISTRICT hereby quitclaims to the CITY OF BAKERS-
FIELD all ownership right, title and interest, including any construction
warranties and guarantees, in that well, pump, pipeline and related facilities,
as depicted on Exhibit "B" attached hereto and identified as well #30/26-16E1,
located, drilled, constructed and installed in September 1981 on property
owned by the CITY OF BAKERSFIELD in the SW 1/4 of the NW 1/4 of Section 16,
Township 30 South, Range 26 East, M.D.B.& M., as shown on the map attached

Dear Mr. Dow:
The Olcese Water District ("Olcese") has received and reviewed your letter of
March 16, 1983, with attachments, regarding the well installed by the District in
the City's 2800 acre Kern River Spreading Area, I have enclosed a revised
document entitled "Quitclaim of Ownership Interest in Well, Pump and Related
Facilities" which the attorney for Olcese has prepared. As you will note, minor
modifications and corrections have been made.
I have also provided a signature line in this letter for execution by the City of
Bakersfield to acknowledge its obligation pursuant to Article IV of Agreement No.
77-07 W.B., as amended, to repay Olcese for the.cost of the well, plus interest
thereon at the annual interest rate of 5.36%, by credit for all Olcese extraction
charges, less OM&R. The amount to be repaid is $77,291.00, and interest thereon
will be calculated from October 29, 1981, the date of payment.
If the revised document and acknowledgment are acceptable to the City, please
have the enclosed copy of this letter executed and returned to me. Olcese will
then execute and furnish you the original executed Quitclaim of Ownership Interest
in Well, Pump and Related Facilities document.

accepted by said District pursuant to order of the Board of

thereof.
