AN ORDINANCE OF THE COUNCIL OF THE CITY
OF BAKERSFIELD REPEALING ORDINANCE NO. 2232
AND APPROVING A FORMAL AGREEMENT RELATING
TO A PUBLIC LEASEBACK, AND THE EXECUTION
THEREOF, BY AND BETWEEN THE CITY OF
BAKERSFIELD AND THE SOUTHEAST BAKERSFIELD
WASTEWATER TREATMENT FACILITIES CONSOLIDA-
TION CORPORATION.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
That Ordinance No. 2232, New Series, is hereby repealed.
SECTION 2.
The Lease and Sublease Agreement by and between the City
of Bakersfield and the Southeast Bakersfield Wastewater Treatment
Facilities Consolidation Corporation, which Agreement is a "public
leaseback" as that term is defined by Government Code Section 54240(b),
is approved. Three copies of said Agreement entitled, "City of
Bakersfield and Southeast Bakersfield Wastewater Treatment Facilities
Consolidation Corporation Lease and Sublease," (hereinafter Agree-
ment) are on file with the City Clerk.
SECTION 3.
The Mayor is hereby authorized to execute and the City
Clerk to attest said Agreement; provided, however, that the "base
rent" required by Section 5 of said Agreement does not exceed the
amount specified in Section 4 hereof.

This ordinance shall be subject to referendum pursuant
to provisions of Sections 22 and 75 of the Charter of the City of
Bakersfield and the provisions of the Election Code of the State
of California, as the same relate to referendum.
SECTION 6.
This ordinance shall become effective thirty days from
and after the date of its passage.

I HEREBY CERTIFY that the foregoing ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 14th day of June, 1976, by the following
