1. Congratulations and welcome to new Councilmember Jeff Green!
2. Congratulations to Jim Foss and the Aramark (Ogden, SMG) crew at the Garden.
The Faith Hill, Tim McGraw booking is a big one.
3. Details will be released later, but continued improvement in finances at the Garden
took place again this year.
4. The stadium tour to Lancaster last Friday was very enlightening. For those of you
who plan to go on the August 19th trip, I think you will find it to be very informative.
On a related note, there is an article enclosed about minor league baseball at The
Diamond Stadium in Lake Elsinore. The author's opinion is that people enjoy
attending minor league baseball at a nice facility, because it provides an overall
experience of affordable, family-oriented entertainment, such as the major leagues
used to.
5. We extend our best wishes to Risk Manager Scott Manzer, who has announced his
resignation, effective on September 12th, to pursue a teaching career. He has served
the City well for over 15 years, and he will be missed.
6. Congratulations to the Recreation and Parks Department. They estimate a crowd of
approximately 1,500 attended last Tuesday's Poco concert in the Rockin' by the River
series.
7. Several months ago, we asked the FAA to reconsider our request for expansion of
the controlled airspace at Meadows Field to include the Municipal Airport. As their
enclosed reply indicates, they are not budging from their decision that the Municipal
Airport does not meet the requirements for controlled airspace. They will be
implementing some safety seminars and other related actions designed to cut down
on pilot violations. We are disappointed but thank Ray Bishop for the ideas and
assistance.

8. The City Attorney's office has prepared the enclosed opinion memo on what
relocation benefits the owners and renters of dwellings will be entitled to, if their
residences are acquired for the City Center (or any other redevelopment) project.
9. Water Resources has provided the enclosed aerial maps that show the adopted
alignment for the Kern River Bike Path, between Lake Ming and Enos Lane. We
should be getting the money through the state to make those extensions a reality.
10. This week's status report on the Development Streamlining Task Force is enclosed.
11. The Southeast Bakersfield PAC met on July 20th. A summary of the meeting, from
EDCD, is enclosed.
12. A response to a Councilmember inquiry is enclosed:

This is to inform you that I received a letter of resignation today from Risk Manager, Scott
Manzer. Scott will be leaving the City to pursue a career in teaching. His last work day will be
September 12, 2000. Scott has worked for the City for over 15 years and was the City's first
Risk Manager. In that position Scott has contributed significantly to the development of the
City's excellent safety programs over the years. I know you join me in wishing him well in his
future endeavors.

Dear Mr. Tandy:
This is in response to your letter of June 16, 2000, requesting that the Federal Aviation
Administration (FAA) reconsider expansion of the controlled airspace at Bakersfield
Meadows Field Airport (BFL) to include the Bakersfield Municipal Airport (L45) and
reclassify the airspace from Class D to Class C.
In our initial response, we described the requirements for implementation of Class C
airspace and explained why BFL does not meet those criteria. Navigable airspace is a
limited national resource, the use of which Congress has charged the FAA to administer
in the public interest as necessary to ensure the safety of aircraft and the efficient
utilization of such airspace. To help us achieve that mandate, regulations exist as to the
design and establishment criteria of the different categories of controlled airspace.
Under existing federal guidelines, the FAA can not arbitrarily establish regulated airspace
in areas that do not meet at least the minimum criteria. We must balance the needs, and
rights, of all aviation customers to access airspace. To that same end, the Code of Federal
Regulations ('i 4 CFR 91) exists to mandate operating rules for pilots in the National
Airspace System.
In your most recent letter on this subject, the City of Bakersfield makes several references
and allegations of violations of 14 CFR 91 by pilots. The FAA takes such allegations
very seriously. It is imperative in an aviation environment as complex as the United
States, that all participants comply with regulations for the safe and efficient operation of
the system. It is inappropriate for the FAA to implement regulated airspace solely to
correct what is perceived to be deliberate regulations violations by pilots.
Personnel at the Fresno Flight Standards District Office (FAT FSDO), having regulatory
and enforcement authority over pilots, are working with the City of Bakersfield on new
signage describing the correct departure procedure at L45 and listing the Bakersfield
approach radio frequency. Also, Bakersfield Airport Traffic
Control Tower and FAT FSDO personnel will be conducting safety seminars
emphasizing the dangerous conditions 'created when pilots at L45 use incorrect
departure or arrival procedures.
With enforcement as the objective, FAT FSDO will periodically conduct surveillance of
aircraft departures at L45. Additionally, as coordinated with your office, FAT FSDO will
provide instruction to the Bakersfield Police Department patrol officers regarding their
role in enforcing the Public Utility Code sections concerning aviation activities.

Reconsideration of Air Safety
Bakersfield Municipal Airport (L-45)
Dear Mr. Withycombe:
We are disappointed in your response, dated May 10,2000, to our recommendation to study
establishing Class C airspace at the Bakersfield Municipal Airport (L-45). To that end, we are
modifying our request and providing more detailed information, hoping for a favorable
reconsideration.
Our request was not made to restrict access to our. airport, but was intended to enlist your
assistance to mitigate an urgent operational safety concern, which is under the sole jurisdiction
of the FAA. Historically., L-45 garners a poor reputation. This is due, in part, to the location of L-
45, which is just outside of the Meadows Field airspace and in proximity to BFL's ILS approach.
· - It is also due to a small number of pilots who push, bend, and break FAR's.'
This recent March was a particularly worrisome period. During a period of only two weeks, four
aircraft in-bound to Meadows Field were forced to take evasive action to avoid aircraft which had
departed our L-45 airport. In at least one incident, the intruding aircraft was operating in
Instrument Meteorological Conditions OMC)as a VFR operator. With the tower controller's
assistance, the America West pilot used TCAS and leveled off, and turned left to secure
separation. In this incident, the America West pilot reported the unidentified aircraft "definitely
flying IMC in the climb." We are thankful for alert BFL controllers! AWP/CCH briefing sheets are
attached.
Our organization is committed to serving the flying public. We have recently completed the
replacement and relocation of existing informational signs at our airport. We are developing a
handout of the departure flight procedures and are involved in a continuing pilot education
program with local FAA Tower personnel that began in early 1998. These efforts exhaust the
remedies available within our authority.

The problem seems to stem from a small group of rogue pilots that frequent L-45, and we are
most fortunate that our alert Meadows Field controllers are currently augmenting separation of
traffic. However, L-45 pilots are not required to have a transponder, and relying on skin paint is
a worrisome proposition.
~s there anything we can do to put structure into this situation? We understand that there are L-45
instances iacross the country where the number of instrument operations and/or passenger count
fall slightly below the guidelines set in FAA Order 7400.2D, and yet, Class C airspace is included
in the local airspace configuration.
Perhaps, iyou could act mere favorably with our request for Class C if it were amended from a
surface ~equest to "Class C from 1500'-3000'". The BFL space could be expanded to
approx~m,ately six miles to create a tube, or corridor, of protection. This request would set aside
or~ly a small segment of airspace, and would protect the ILS to Meadows Field. We hope that
during your re-examination of these problems, you will consider airspace protection as one
element bf a corrective action program.
At the en~ of the day, our safety concerns are paramount, and we would like to ensure a long term
remedy 6f this natural conflict of airspace between Meadows Field and L-45.

"~,SUBJECT: Airspace Problems at Bakersfield Municipal Ak'port
NARRATIVE: Bakersfield ATCT/TR. ACON an ATC Level 7 Terminal Facility is
encountering ongoing problems with aircraft departing and arriving from Bakersfield
Municipal Airport (L45).
L45 is located 6 NM SOutheast of Bakersfield Meadows Field andlays M NM West of
the NILEY LOM (ha Class "E" Airspace) used for the Runway 30P. ILS Approach to
Meadows Field. Over the past six years we have observed aircraf~ departing L45 with a
climbing right turn Southeast bound on V197. These VFK deparuzes generate safety
alerts for aircraf~ inbound on the ILS Approach to Meadows Field.
The Fresno FSDO and Bakersfield ATCT personnel have conducted sever-al safety
seminars at 1.45 wkh special emphasis placed on the relationship of L45 to Meadows
Field and the FAC's overlaying L45. The Problems continue to exdst.
Three resent ~ncidents have occurred as follows:
I. On 3/16/00 an akcraf~ traveling from North of Meadows Field to Bakersfield '
Municipal Airport transkioned across the BFL localizer and became traffic for N881DM
(SBR1) while on an ILS approach to BFL. The unidentified traffic penetrated tie BFL
Class D akspace without communications with the ATCT or TRACON. This intruder
was close enough that the tower, when observing it, 'believed it to be on a right base leg to
BFL. Efforts by the ATCT to call the intruder were unsuccessful. N881DM was
informed of the traffic and advised to climb (while on ILS descent) to avoid conflict with
the intruder. Efforts to identify the intruder aircraft were unsuccessful
· .2. On 3/13/00 the Arrival Radar Controller reported two ~ces ofposs~le FAR
violations that occurred on 3/12/00. Both involved unidentified akcm.ff that appeared to
have depart, ed Bakersfield Municipal Airport (L45). The weather at Bakersfield.
Meadows, as reported at 1656 UTC, showed overcast ceilings at 1,000 (1,500 MSL).
Tops in the vicinity of L45 were reported-at 3000 feet MSL with no breaks.
a. The first insta_ nee occurred between I740 and I74I UTC and involved
Skywest 5288 (SKW5288), an El20. After issuing SKW5288 vectors and clearance for
the ILS approach to Runway 30R, the controller reported traffic two miles west of the
aircraR heading east at 3,100 MSL. The E12Oreported being in instrument
meteorological conditions (IMC) at 3,000 and could not see the traf~c. The controller
issued vectors around the traffic and then re-cleared the arrival for the ILS approacb-
b. The sex:omi event occurred approximately 25 minutes later. A Dash 8,
_ A. irshuttle 6337 (ASH6337), was on the localizer and cleared for the ILS approach. The
controller observed a target four miles ahead of ASH633? squawking 1200, east~und
from L45 at gOO MSL and climbing. The controller advised ASH633? who adjusted their
TCAS equipment to waIch the target. One minute later, al 1 $05 UTC, ASH633? reported
leveling offand turning left to avoid the aircra.~ which broke oul of the clouds to their
right. The Airshuttle pilot clearly stated tha~ the unidentified aircraft defmkcly flew
through IMC in the climb. The pilot of AsH6337 was very.concerned ar, d, intended to
file an NAS report.
Both incidents required evasive maneuvers, once by ATC and once by 'a pilot. Both
incidents occurred when arriving IFP, a/reraf~ were approximately two miles from the
outer marker. Both incidents involved inmader a/rcvafl that are capable of high
pe~ormance climbs and appeared to have departed L45. An audiocassette re-recording of
transmissions pertinenI to the evenIs was made and given to FAT FSDO.
As a results of the above identified incidents, Fresno FSDO Safety Officer (James Henry)
and the ATM Bakemfield ATC met w/th the L45 'akport proprietor (City of Bakersfield)
on Monday March 20, 2000.
From thi.~ m~ting several initiatives were developed:
1. I .,~Jll work with the City of Bakersfield on new signage with the current
departure procedure az L~$ and a sign with Bakersfield Approach Frequency.
2. BFL ATCT & FAT FSDO will conduct a safety seminar with spec/al
emphasis on the problems associated with deparuares and arrivals at L45.
3. The City of Bakersfield will explore the possibil/ty, of providing some
PUC Aviation Training for the City Policy Department and provide presents at L45.
FAT FSDO will provide the trainhag if the Policy Department agrees.
4. FAT FSDO, resources permitting will conduct some surveillance and
'enforcement action at L45.
5. Bakersfield ATCT will work with the City of Bakersfield in the
development of a flyer for pilots at L45. This flyer will provide information on the
arrival mutes to Meadows Field and way's to avoid possible ccrnfectidns.

QUESTION PRESENTED
What relocation benefits will owners and renters of dwellings be entitled to if their
residences are acquired for the City Center Project?
ANSWER
There are several benefits available to owners and renters. The type and amount
of thoSe benefits depend on the status of the resident (owner-occupant or renter), how long
they have resided there and whether they choose to rent or purchase a replacement
dwelling.
DISCUSSION
Relocation Benefits
When the Southeast Bakersfield Redevelopment Project Area was adopted, the City
Council adopted "Rules and Regulations for Implementation of the California Relocation
Assistance Law." Basically, those rules indicate that the Bakersfield Redevelopment
Agency will comply with the State of California's relocation requirements for any project in
which the Agency is involved and which will disPlace persons from their homes. The City
of Bakersfield adopted the State's relocation requirements via Resolution 91-97.
California relocation law sets out various types of relocation benefits. These
benefits are as follows: moving expenses; replacement housing differential; rental
differential; down payment; incidental acquisition expenses and relocatiod assistance
advisory services.

Moving expenses are the costs of moving a household from one location to another.
They can be calculated one of two ways. Displaced persons can elect to have the public
entity hire the movers and pay the actual, reasonable and necessary cost ("actual cost")
or the displaced persons can elect to self-move and receive a set amount of money
depending on the number of rooms that are being moved and whether the landlord or
displacee owns the furniture ("fixed cost").
Replacement Housinq Differential is the difference between the price the public
entity paid for the home and the average selling price of a functionally-comparable dwelling
or the price actually spent to buy a replacement residence, whichever is less. This
payment is limited to no more than $15,000. Under the federal relocation regulations
(which may apply to some properties), the maximum Replacement Housing Differential is
$16,500.
Incidental Acquisition Expenses include interest rate differentials (difference
between interest on loan for current house vs. interest rate for purchase of replacement
house), one-time fees such as legal fees, notary fees, surveys, recorder's charges, lender's
fees, etc. The total amount of Replacement Housing Differential and Incidental Acquisition
Expenses cannot exceed $22,500.
Only owner-occupants who have lived in their homes more than 180
consecutive days prior to the City or the Agency initiating negotiations to purchase
the property are eligible for the Replacement Housing Differential and Incidental
Acquisition Expenses. More than one-half of the residences which may be acquired for
the City Center project are rentals.
Rental Differential is determined by 'subtracting the old rental rate from the
replacement rental rate and multiplying that number by 48 -- the maximum number of
months that the Rental Differential can be paid. This amount cannot exceed $5,250 total.
The attached table outlines the relocation benefits available to occupants and
tenants and indicates who is entitled to which benefits.
Relocation Plan
To assure that all displaced residents have a comparable, decent, safe and sanitary
place to live before they are required to move, redevelopment law requires the
redevelopment agency adopt a relocation plan before the agency may participate in the
project. The relocation plan will contain both an analYsis of the replacement dwelling
needs and an analysis of replacement dwelling resources, among other information, The
relocation plan will be reviewed by the Project Area Committee before the Agency wilt
adopt it.

SUBJECT: KERN RIVER BIKE PATH
Attached is a set of aerial photos showing the existing and proposed Kern River Bike Path
alignment between Lake Ming and Enos Lane. These photos were produced from digitized aerial
photomapping that was flown in March of this year.
The bike path shown on the photos reflect the alignment recommended by Kern COG in the
Bikeway Masterplan dated June 1989 and the "Specific Trails Plan" adopted March 6, 1996 by City
Council Resolution No. 35-96. More recently, the "Southwest Kern River Bike Path Extension"
negative declaration was adopted by the City Council on March 15, 2000. As currently scheduled, the
Morning Drive to Alfred Harrell Highway portion of the bike path is scheduled to go out to bid later this
month as part of the Northeast Bike Path project. If Proposition 12 and 13 funds become available by
October of this year, the southwest extension of the bike path to Enos Lane and the widening of the bike
path between Manor Street and Yokuts Park could be engineered and ready to bid by March, 2001.
When fully completed between the Lake Ming loop and Enos Lane, the Kem River bikeway would
be almost 30 miles in length. It is currently anticipated that all remaining portions of the bike path shown
on the attached photos will be completed by summer 2003.

The Southeast Bakersfield Project Area Committee (PAC) met on July 20th. The agenda covered the
following items:
Chairman Isaiah Crompton called the meeting to order at 6:40 p.m. Seven members were present.
Public Statements were moved to allow the public in attendance to make their comments after the New
Business item on the Amendment to the Redevelopment Plan.
Workshop:
Stephanie Campbell requested a deferral of her presentation on the economic workshop she attended on
behalf of the PAC
Correspondence:
Pursuant to request form Chair Isaiah Crompton, staff discussed cancellation of agricultural lease on
110 acre property the Redevelopment Agency has on South Mt. Vernon Avenue in order to ready
property for potential future industrial development. The Chair was concerned that they were not
informed prior to the lease cancellation, and where the lease monies went for land they own.
Staff discussed potential local race car manufacturing business that met with Vice Mayor Carson, and is
requesting financial assistance to construct a new facility in Gateway Industrial Park. Assistance being
proposed is $50,000 loan using CDBG funds and $20,000 in tax increment generated from the new
construction of the facility. Company would create 21 additional jobs. PAC concerned they are not
involved in the process.
Staff discussed aerial maps being developed by City Planning and Management Information Systems
that could be potentially used as a base to create maps the PAC was interested in, after a presentation
by Mr. Graham Kaye-Eddy to the PAC on the need for maps.

outlining the total CDBG expenditures for Ward 1 & 2 since the beginning of the CDBG program in
1978. Ms. Campbell asked for staff to provide how HUD determines the amount of funds a community
gets in CDBG funding each year.
New Business:
Need to Amend the Southeast Redevelopment Plan
Staff discussed the need to amend the plan to include a multi-use stadium and other public facilities, also
requesting the PAC to think about other facilities that may not be included in the plan that could be
added as well.
At this point Public Statements were allowed to be made by those in attendance.
Public Statements:
Estella Costa - Citizens are concemed over the information being provided to the PAC by City staff.
You should seek independent counsel on the issues. What type of hearing opportunities should be
required. You need to have information to determine if the stadium will benefit the southeast
community. I'm with GBLA, though we would decline reviewing the issues, you should delay any
decision you make until you have all the information you need or request. You will not divide and
conquer us from now on. If the downtown gets a Holiday Inn or stadium, then the southeast should get
something in return. Why do you only have the agendas for us, you should be providing all the
information and full agendas. You should notify the community of these meetings, put the agendas and
information on the web page. You should demand the information from staff, they are there to serve us.
Archie Barefield - How was the stadium left out of the Plan? If you want to put it in now you should
get letters of support from the community, which you're not going to get, because the southeast doesn't
support it. You don't know what your role is, and until you know it you shouldn't be making a
decision on this for the southeast. The City has general fund money, why isn't the southeast ever given
any of it? All they do is take from the southeast.
Ray Malahowski - You need a plan for the area to see how a stadium fits into the larger area. It will
most likely benefit downtown. If you only develop on the fringes of the southeast, nothing will happen
in the center where its needed. The PAC only slows the City down on what they want to do. You need
an ombudsman that can be the go between for you and the City. The City can't serve two masters.
Johnathan Webster - We need clarification from the PAC as to what we can do. You have the power,
you need to exert yourself. Take the time to come to a consensus before you make a decision.
Walter Williams - The southeast is constantly getting raped by the city. Nothing has happened in our
area since 1965. The PAC should have the power to get things done. We want the same things as
southwest gets, grocery stores, gas stations, dry cleaners, etc. You need to get yourself an attorney and
educate yourself as to what you can demand. The City should give us something for putting the

stadium in our community. Until you change Lakeview, nothing will change. The Kenyan House has
fed poor children, provided them an education, the City has done nothing for these children.
Gladys Buckner - We need to be educated on this stuff. The information needs to be given to us to
understand things. Where do we go from here.'?
Gil Anthony - I always believed a Master Plan for southeast was extremely important to develop. You
need this to get your vision together of what you want for the community. The City Center project will
create a spike of development which the area needs. The grocery store will probably go in at Union and
California, which something the community needs as well. But it doesn't have to be outside people
coming in to develop within the community, you should be the ones developing new opportunities in the
community. But you need to be patient with redevelopment because it starts slow but builds over time.
Don't be like the redevelopment plan and PAC in San Fernando that fought over things so much the
Council disbanded the PAC, and gave up forming a redevelopment project area.
Rene Nelson - You need to make sure the public facility portion of the plan is legally defined with the
amendment so its correct this time. Public funds should benefit all the citizens.
Barbara Harris - We're done being patient, we've waited too long, we need things now and will demand
them. This community volunteers their time to improving the area and people all the time. You've
done a huge disservice to this community by not providing for their needs. I hope you bring this input
back to the City Council so they know the thoughts and feelings of the community.
Ricky Bass - The Marketplace shopping center didn't have to be patient, it went in fast. Our families
can't be patient anymore. When you have PAC meetings the community needs to know so we can have
more people here. I'll fight with those that fight with me, we need to shake these cowards around.
PAC Motions:
Motion for PAC to hold community meeting to get citizen input on amendment to the Plan, prior to
taking official position on amendment. (MSC Powell/Owens)
Motion to hire outside independent counsel/consultant to inform and advise the PAC on their rights
under redevelopment law regarding the requested amendment to the Plan. The independent
counsel/consultant to be funded through the Southeast tax increment or any other financial source
available to the City or Agency. (MSC Campbell/Porter)
PAC Member Statements:
MrJ Dean - The PAC was formed because it was required under redevelopment law if you wanted to
use eminent domain. It was never the desire of the City to empower the PAC. We were told if we
didn't go along with the Plan it would kill redevelopment. This amendment is the best thing that could
have happened, we can get the concessions and power we need. I originally voted against the Plan
because it did not have the teeth that put the PAC in power of redevelopment. We are elected officials

and accountable to you. I challenge the citizens group to put pressure on us to do the right thing. We
need a townhall meeting so the community can tell us what they want.
Ms. Campbell - If mailings and costs are going to be incurred to notice the amendment, can staff
investigate holding a PAC election to fill the vacancies that we have on our committee, using the same
mailing to notify the people of new elections.
Mr. Sandifer - It seems the PAC is working on many of the issues I've been involved with over the
years, and I look forward to being a team player with the group.

A written response to Ms Moralez is being prepared by Public Works staff. The Bakersfield
System Study, in progress, will be addressing many of the concerns expressed by Ms
Moralez. East-west corridors are needed for traffic flow now and in the future. The
Bakersfield System Study is expected to be completed by next summer. A copy of the
letter from Ms Moralez will be forwarded to the study consultant. Olive Drive, mentioned
in the letter, is a County facility from Highway 99 to Coffee Road where it enters the City.
The road currently does end about a mile west of Coffee, but is being pushed west with
development construction. It will continue west as shown on the Circulation Plan of the
2010 General Plan. Brimhall does not reduce to one lane eastbound as it nears Coffee
Road, as mentioned in the letter, but widens out for multiple turn lanes. Plans are also in
progress to widen Brimhall to two lanes in the westbound direction from Coffee. The road
is expected to be at full width in a few years as remaining development areas are
completed.

To Whom It May Concern:
I trna writing to your about the traffic situation in this town, mainly 24th Street and Rosedale
Highway. The only way to reduce the flow oftraftlc on it is to create one or two more arteries
to divert the excess traffic. It seems to me that if the city goes ahead and builds a baseball
stadium downtown, then it make sense to detour the traffic headed to the west side of town from
the East side or visa versa from 24th Street & Rosedale Highway.
My proposal would be to have the traffic go from Columbus St or 34th Street through the now
Sam Lynn Ballpark over the Kern River to either Pierce or Sillect or Gilmore. ('You cal~ also
consider interchanging it with. the Golden State Fwy by the old Rancho building). There is
currently a vacant lot for sale by Sill Properties on Siilect St. It also makes sense to widen the
underpass at Oihnore and have Gilmore go all the way through to Fruitvale or even farther.
Gilmore is the only other way to get pass the freeway at this point.
By doing the above traffic coming or going to Bakersfield College, Memorial Hospital and the
numerous other locations of the East Side whose only way to get back to the west side is through
24th or Rosedate Hwy. would now have an alternate route by either taking Columbus or 34th St.
which would Continue over the Kern River to ,an underpass to Gilmore then can go Fruitvale.or
hopefully father otherwise go north to Hageman Rd.
I. would also like to know the status of Olive Drive. Olive Drive should be a major road just
Twenty tough Street is, as it has on and' offramp with Highway 99. Extending andth upgrading
Olive Drive on the '.vest side of the freeway will also help relieve some of the 24 St. traffic
congestion. It did not re'aXe sense to me to build a golf course and to dead end a major road with
an offramp from the freeway. Why the city would deliberately cut ora main artery iS unknown
to me..Please let me 'know if there are any plans for this road.
I have lived in the town all my life and have seen the city/county invest money in numerous
studies regarding traffic problems here. I think good old fashion common sense goes further and
cost a lot less.
The bottom line is we need to get traffic offer24m Street NOW, we cannot wait for a freeway,
also Brimhall needs to be widen, it should have never been reduce to one lane near Coffee.
