SUBJECT: General Information 1. City Center Update: a) The Government Review Committee of the Chamber overwhelmingly endorsed the project at a session this morning. b) Only one speaker, Dear Cross, appeared at the hearing on the EIR this Thursday. c) Please call me with your comments and suggestions on the DDA. 2. In 1997, the City provided a $200,000 loan to Guy Chaddock and Company for a term of five years. The agreement states that a portion of the loan would be forgiven each year the company meets certain hiring goals. Since the company met their hiring goals in 2000, another 1/5th of the loan ($40,000) will be forgiven. Guy Chaddock and Company moved to Bakersfield from southern California, and employs 322 people, 201 of which are Iow and moderate income individuals. More details are included in the attached memo. 3. A recent article from the Dayton Daily News is enclosed. It discusses the significant revitalization of their downtown area and the impact the new minor league stadium has made. Hank Stickney, who spoke on behalf of the California Baseball League at Wednesday's Council meeting, is the owner of the Dayton Dragons minor league baseball franchise. 4. We are going to place greater emphasis on a couple of things in the City Manager's office. One. is to generate more material for public consumption on the positive things the City does. The second is to thank our employees, on a more visible and frequent basis, for their positive accomplishments. Rhonda Smiley has been assigned those duties, as part of her work load. Amber Lawrence will pick up a portion of Rhonda's current assignments to free up the time. Honorable Mayor and City Council January 19, 2001 Page 2 5. Recreation and Parks will begin some improvements to the circulation pattern at Beach Park this month. They will remove the connector road that bisects the park and replace it with turfed open space. A memo is enclosed with photographs that shOw the existing circulation path and the new circulation after the modifications are completed. 6. Correspondence from Time Warner is enclosed notifying us that their merger with AOL closed on January 11th. There will be no change in the terms of our franchise agreement. 7. We were not successful in our efforts to get a representative on LAFCO. 8. The financial difficulties of "First Night" are unfortunate; as indicated in an earlier memo, that group is a non-profit and is not tied financially to the City. 9. Twenty percent of the loan will be forgiven for each year the company meets all terms and conditions of the agreement. These terms included, · hiring 35 workers from Bakersfield. · of those workers hired in the second to fifth years, at least 51% must be low- and moderate-income individuals. Exercising this forgiveness is a ministerial action and, thus, requires no Council action. Based upon the report submitted to our office from the company, the company has exceeded both conditions noted above. For the fourth year of the agreement, the company employed 201 new hires, and 85.6% of these hires were low- and moderate-income individuals. Currently, this company employs 322. Early projections estimated 85 people would be transferred to Bakersfield, with an additional 35 local hires. Therefore, Guy Chaddock & Company has met the terms and conditions required in the agreement and qualifies to have 20%, or $40,000, of the loan amount forgiven for the fourth year of the agreement. For the past three years, the company has met the terms of the agreement and 20% of the loan amount has been forgiven each year. I propose we send a letter like we did last year, which merely reflects the ministerial action of the debt forgiveness. The improvements include the removal of the connector road that bisects the park, (see attachment), and replacing that area with turfed open space. The removal of this connector road has several benefits. · It will reduce areas of traffic conflict by eliminating two intersections, one of which is not at 90 degrees. · It will allow for the free flow of foot traffic from the soccer field to the playlot and restrooms. · The space left by the removal of the road will be converted into approximately one half acre of open turf area. · · As all streets within the park are one way, it will improve the circulation through the park by eliminating the connector road that park users can mistake for a two way street. The removal of the road will effect the amount of available parking. Approximately 30 parallel parking spaces will be. lost. Their are currently 150 spaces of off street parking, and 240 spaces of on street parking, available within and adjacent to the park. The loss of 30 spaces should not be an immediate problem, however, their is an area north of the existing horseshoe courts, within the overhead power easement, that can accommodate a parking lot large enough to replace those spaces should that become necessary. The cost of the project is minimal. The asphalt and concrete removal and saw cutting will be accomplished by the Streets Division, who have indicated their willingnesS to assist with the project. The material will be recycled. Soil will be imported, minor modifications will be made to the existing irrigation system, and turf will be seeded by City forces. Approximately 200 lineal feet of curb and gutter will be installed by the City annual concrete contractor. ("AOL"), in which each of TWI and AOL would merge with subsidiaries of a newly formed holding company, AOL Time Warner Inc. STINSO~,~SlSTANT CITY MANAGER DATE: January 17, 2001 SUBJECT: Fence at 3154 Audubon Street Council Referral No. WF0018695 (Ward 2) ICouncilmember DeMond requested that staff respond to property owner regarding alleged fence damage by city crews. Staff researched this claim and contacted Mr. Stewart regarding his assertion that city crews damaged his fence on or about July 1, 1999. It was determined that no city crews were working in that area on or about that date. It was further determined that the only work done by city crews in that area was approximately two years prior to the date cited. A claim had previously been submitted by Mr. Stewart's insurance company to the city which was denied due to the lack of timeliness of the claim. A letter was previously sent to the company. Mr. Stewart has subsequently requested that the city reimburse him the $500 deductible. Staff recommends not paying this amount since due to the lateness of the claim, it would be difficult to determine responsibility by the city for damages to the fence. Councilmember DeMond requested that a letter be sent to Mr. Stewart explaining the reasons for denial of the claim. Attached is a letter sent to Mr. Stewart from AIMS the city's third party claims administrator who handled this claim.
