SUBJECT: General Information
1. We held the stadium design/build interviews this week. The design
build/Guaranteed Maximum Price (GMP) is a process - not a bid. This stage of the
process went very well - quality designs being submitted. We now have to work
hard on pricing and design issues in an effort to get a quality product for an
acceptable GMP. We hope to have a full presentation to you at the next regular
Council meeting.
The ranking of the committee is that H.O.K. with local partner, Griffith Company,
has the preferred proposal. H.O.K. is the designer of Lancaster and San
Bernardino in the Cai League. In the major leagues, Camden Yard, Coors Field and
many others. Griffith Company does many projects for us each year - bridges,
asphalt, etc.
HNTB with Bernard Brothers Construction would be the back up should negotiations
fail. It would appear that the pricing will be affordable - although we must verify the
program content and go through a value engineering process before I can verify that
with certainty. We will attempt to do that before your next meeting.
2. A change has occurred in the combined City/County meeting on Monday, July 23rd.
The County will now be hosting at the Board Chambers. The City had planned to
host, but the County has more seats and a large crowd is expected for the
URS/highway issue. They will also have large TV monitors in their lobby if there is
an overflow.
3. Raul Rojas will be back with us full time as of July 2®.
4. Attached is a memo from Public Works regarding the status of the Allen Road Trunk
Sewer, Phase II project.
5. Attached is the Weekly Progress Report from Public Works for the week ending July
1,2001.

6. Senator Poochigian's office has indicated that the request for funding trees in
Bakersfield survived the conference committee and is in the state budget. If this
survives, an extra $100,000 will be provided to Bakersfield for trees.
7. EDCD provided a memo regarding the status of the Mt. Elgon Market project. An
appraisal will be initiated by the department, followed by an NEPA environmental
review. A draft project agreement will be available for Council review and action in
September.
8. The "Hispanic Business 500," which is a listing of the largest Hispanic-owned
businesses in the United States, lists two Bakersfield firms in this year's survey. J.
Torres Company ranks #385, and Garcia Roofing ranks #485. Neither company
was included in the 2000 survey.
9. The third public workshop on the Bakersfield Systems Study was held June 19 at
the Convention Center. An estimated 250 people attended to review the five
alternative systems. The comment period ends July 3rd.
10. See the enclosed announcement and schedule on the biggest theater series
Bakersfield has ever had - Les Mis6rables, Ragtime, Cabaret, My Fair Lady and
Riverdance! Thank you Jim Foss, Ed Dorsey and the Garden crew.
11. Congratulations to the lifeguard crew in Recreation and Parks! In an impromptu
audit, all seven lifeguards scored 100% on individual rescue skills and the team as
a whole received the highest possible rating of "exceeds standards." Especially
notable is the fact that over 80% of the staff are first-year lifeguards.

Hi everyone, Good news!
Cai Rossi from Senator Poochigian's office just informed us that his
request for funding trees in Bakersfield survived the Conf. committee
and is in the state budget. If anyone knows the Governor, lobby him not
to cross it out and we will have an extra $100,000 for trees in
Bakersfield!

SUBJECT: Status of Allen Rd. Trunk Sewer, Phase II - Scales Construction
As you know, on May 6, 2001, Scales Construction officially closed their doors and went out of
business. This left the City with numerous stop notices from sub-contractors, material suppliers,
and equipment rental companies who had not been paid by Scales. They also left the Allen Road
Trunk Sewer project incomplete. The City hacl both a Material & Labor bond as well as a
Performance bond in place as security in the~ event of this situation.
Sometime around June 11,2001, the City A'I~torney's office discovered and subsequently
confirmed that the bonding company, Amwest Surety, was being "liquidated" under Nebraska
state law. The effect of this action is that the bonds are void and the City must pursue a claim
against the liquidator to recover any costs. The liquidator has up to two years to resolve claims
under Nebraska law.
In order to complete the sewer project construction, irrespective of the payment issues, City
Attorney and Public Works staff put the remaining work out to bid for the safety of the traveling
public. Bids were opened on June 21 with a low bid of $260,016.05 which was double the cost
estimate. After discussions with contractors, 'Ihe high cost is attributed to the uncertainty of the
situation left by Scales as well as the high per-unit cost to mobilize the large equipment needed
for such a deep sewer in the middle of a signalized intersection.
Staff recommendation is to reject all bids and to include the remaining Allen Road Sewer work in
the Brimhall Road Trunk Sewer Project which is currently in design. This project already ties into
the work at Allen Road and Brimhall Road and there should be considerable savings through
economy-of-scale by including the remaining 'Allen Road Sewer work in the Brimhall Road Sewer
bids.
Regarding the unfinished road conditions, I am having Street Maintenance crews complete the
permanent pavement over the acceptable s~wer pipe and pave three inches of asphalt over the
unacceptable and unfinished sewer line. This will provide complete paving over most of the
remaining Allen Road and a solid "temporary" surfacing at the intersection until the Brimhall
Sewer project can be designed, bid, and awarded in three to four months.
Please note that in three to four months, the temporary pavement in the intersection will be
removed for the remaining sewer work requiring a detour during construction. Once this is
complete however, the entire intersection wil~ be re-paved and not require any work for quite
some time.

This memo will serve as an update-for the Mt. Elgon Market project.
The ,project is acquisition assistance to benefit Mt. Elgon, a community-based
development organization (CBDO). The CBDO was ,incorporated to carry out
neighborhood-revitalization .and community economic development projects'. The Mt.
Etgon mission is to primarily serve Iow income,residents of the southeast area. In May
of 199.8, the Council appro,ved a FY' 1998-99 Action .Plan Project -for disposition Of.city
own ~property at 407 and 4=17 La. keview to 'benefit the Mt..Etgon CB.DO. 'Fhe original
CDBG budget of $2850 .is for escrow related closing costs. Theproperty was originally
proposed to be developed as a non-profit job training arid administrative center. The
CBDO has prel~a~ed a ,revised business plan for the-project and the plan appears to-be
acceptable.
The revised plan identifies the activity as the :Mt. Elgon Farmers~Market Business
-Atliance Project. The .Lak. eview .property.would serve as a site 'for a farmers market
and .business incubator (see vacant site picture beloW). Based on their business plan, I
can incorporate the major business points into a property disposition agreement very
similar to the one the Council approved .for Bethany Services. Since the land is vacant
market value is probably less than $20,000. I will initiate an appraisal, NEPA
environmental review,, and begin drafting a project agreement for CounCil review and
action in September. Because of the .relatively Iow value of the property, we .may wish
to .reduce the restrictive .use .period to-five years.

SUBJECT: Two Bakersfield Firms Among Top 500 Hispanic Businesses in U.S.
Two Bakersfield businesses are included in the "Hispanic Business 500," a listing of the largest
Hispanic-owned businesses in the United States. The list is published in the June issue of
Hispanic Business magazine.
Ranked #385 on the survey is the J. Torres Company, Inc., which is involved with trucking,
environmental, and recycling services. Founded in 1985, the firm employs 40 workers and had
revenues of $8.5 million in 2000.
Garcia Roofing, ranked #485, is in the commercial, residential, and industrial roofing industry.
The firm was founded in 1975, has 60 employees, and had 2000 revenues of $5.8 million.
Neither company was included in last year's 2000 survey.
This is the magazine's 17th annual listing of the 500 largest Hispanic-owned businesses in the
nation.

BAKERSFIELD SYSTEMS STUDY: The third public workshop was held on June 19, at
the Bakersfield Convention Center. An estimated 250 people attended to review the five

KERN RIVER FREEWAY EIR/EIS: On June 18th, copies of the Route 58 (Kern River
alignment) were delivered. The notice from Caltrans, noted that there is a 30 day public
review period. Once the public review is completed, the Federal Highway Administration
will publish a record of decision in the Federal Register.
BAY AREA AND SMOG CHECK I1: There is a movement by several local and regional
agencies to require the SMOG Check II in the Bay Area. The reasoning is that the San
Joaquin Valley is being re-classified to severe ozone status and that part of our poor air
quality comes from the Bay Area.
U.S. DOT SECRETARY SAYS: "Transportation policy is more than public works. .. more
roads, bridges and rail cars. If done well, transportation is moving people and goods
safely, efficiently, dependably and seamlessly. Properly managed, transportation policy
binds people and communities across regional and national boundaries, opening doors
and creating opportunities" (Secretary Mineta, May 29, 2001). (A619)

SUBJECT: Aquatic Operational Audit
Since 1997, the city has been a client of the international aquatic safety and
risk management firm of Jeff Ellis and Associates, Inc (E&A). Part of E&A's
services are random, unannounced safety audits. For the past three years,
staff has performed well enough on these audits to earn one bronze and two
silver national aquatic safety awards.
Although the performance of the lifeguards has met standards each year, we
have never received E&A's highest rating of"exceeds standards" or have all
staff audited earned perfect scores. That all changed yesterday. .~
I am honored to inform you that we received an "exceeds standards" overall
rating, which means staff earned the highest possible scores in each area
evaluated. In addition, each of the seven lifeguards audited earned perfect
scores (i.e. 100) on their individual rescue skills. This performance is even
more impressive when the fact that over 80% of our staff are first-year
lifeguards and management.
Obviously, the lifeguards are to be commended but I must also point out the
work of Sally Ihmels, David Stricker, and Josh Romine who trained and
supervise the aquatics staff. Their outstanding work and leadership led to
performance the auditors witnessed yesterday. Not only does the city benefit
from employees like this, but the citizens of Bakersfield who can enjoy a safe
aquatic experience at our public pools.
A copy of the overall evaluation is attached. Please let me know if you
require additional information.

Councilmember Couch referred correspondence regarding Campus Park
Neighborhood Marker
The Campus Park South sign that is located at White Lane and Pin Oak Park Boulevard
was replaced about a year ago due to a automobile hitting the sign and doing extensive
structural damage to it. The original sign had been repaired 5-6 times over a period of
years. Most of the repairs dealt with trying to replace the tiles. This type of tile and color
is not being manufactured anymore.
The current sign was selected for several reasons. A shorter height sign was necessary
so drivers could easily see oncoming traffic on White Lane and turns could ~3e made more
safely. We wanted to install a sign that was durable so over time it would withstand such
factors as: weather, water, weed eaters, vandalism and automobiles. The cost of this sign
was $1,200 which is about the average for a sign this size. We had researched the cost
of building a sign similar to the original one and that estimate was about $4,500. -.,-hat
would be twice the cost of a new sign being placed in our older parks today.
Staff has received more calls from area residents telling us how nice the sign looks than
those commenting how bad it looks.

hired it's first professional urban forester, Paul Graham. Bakersfield is one of
only a handful of cities in the state that employ a full-time urban forester. Paul
came to us from the University of California - Davis' arboretum and since his
arrival, he has proved to be a valuable resource. Also, prior to Paul's hiring, the
Department of Recreation and Parks finished a complete inventory of all trees
in city-owned parks and right-of-ways.
Earlier this year, the city formed an ad-hoc committee to create a tree
ordinance that establishes policies such as those you described in your letter.
For this task, we included representatives from the county of Kern, North
Bakersfield Recreation and Park District, Superintendent of Schools, and the
Tree Foundation of Kern. Recently, this committee successfully completed
their mission and our new tree ordinance will be considered by the city council
on June 27, 2001.
For your information, this new ordinance establishes a goal of a forty percent
shade canopy in commercial developments and parking lots with a requirement
that thirty percent must be achieved within fifteen years.
