SUBJECT: General Information
1. The good news was that there is only one Council meeting in July - the bad news
is that it is going to be very long and difficult because of the saved up workload.
2. On Tuesday, July 10th, we spent nearly the full day with HOK going over cost and
program issues for the proposed new stadium. They will make a presentation to
you at the Council meeting on the 18th.
Having made a best effort approach, we can get within a few percentage points of
budget. We will give you alternatives that range from $12.6 to $12.8 million (the
latter being recommended). The budget for this phase of the work has been $12.0.
The overage amount of the $600,000 to $800,000 is available in the Facility
Replacement reserve. The total project budget would then increase from $16.0
million to $16.6 or $16.8 million.
Although we would have liked to have delivered the major piece with no budget
impact, to do so would negatively impact necessary project elements. HOK did an
exceptional job to bring in this number. We think you will also like the revised
design.
3. Expansion of Central Park was one of the ideas to come out of the Downtown
Charrette. Per the enclosed status report from the Development Services Director,
the vacant property north of the park is owned by the Superintendent of Schools
and the Housing Authority. The Housing Authority has approved plans to build its
new headquarters on the northernmost parcel. The Superintendent of Schools in
the process of selling its holdings, part of which the Housing Authority is interested
in acquiring. To give the City time to consider how to proceed on the proposed park
expansion, the Housing Authority Director has agreed to request an 18 month
option on all the property and has offered to work with the City on a compatible
design for development of the property.

4. Assistant City Manager Alan Christensen, Development Services Director Jack
Hardisty, and Assistant Finance Director Nelson Smith depart for a week-long visit
to Ulaanbaatar, Mongolia on July 19th, Their trip is part of a series of exchange
visits between Bakersfield and Ulaanbaatar through the Resource Cities Program
that is being coordinated through ICMA and paid for by USAID.
5. Congratulations to Vice-Mayor Salvaggio on your confirmation as a member of the
California Regional Water Quality Control Board, representing the Central Valley
Region.
6. A recap of the Fire Department's media public education program for the 2nd quarter
of this year is enclosed.

RE: EXPANSION OF CENTRAL PARK
Representatives of the Superintendent of Schools, Housing Authority and I met on
Tuesday, July 3, 2001, to discuss how to work together on the old foundry property north of
Central Park.
The Superintendent of Schools has had a change in plans since the property was first
acquired and is in the process of disposing of it now. The Housing Authority is interested in
ex~pansion of the housing complex it has recently opened on the property, and is about to solicit
bids to build new offices on the northern part of the property. Expansion of Central Park onto
this property as well as south towards the convention center was a prominent design element
for the future downtown in the Charrette, but that concept has not yet been officially adopted by
the City.
We came to a solution that gives us some time to work out what we might do together.
The Housing Authority has agreed to request an eighteen month option on all the property to
maintain singular ownership of the land. This will help us by keeping the land from being
divided by sales to multiple parties. The Housing Authority, as a .part of its proposal will commit
to working with the City on a complementary design for park, housing and commercial
development. The Superintendent of Schools will recommend his board approve the option as
a way of showing progress in 'not only disposing of excess property but also supporting good
civic design and cooperation by the three agencies. The City will introduce the concept of
Central Park expansion for general plan hearing by the Planning Commission in September,
and possible adoption by t-he City Council in November. This would give us the time to talk
about design issues, not only with the Housing Authority, but with other property owners. We
would also need to work on park design (re-design), water availability and funding.

Councilmember Carson requests staff report on the feasibility of continuing work on th4
median on Union Avenue.

Union Avenue is classified as an arterial street and as such has an existing median island
down its center. This median is predominantly asphalt capped south of Ming Avenue,
which is the point where the latest median enhancement project ended. This latest project
was a joint City/County project. It is physically feasible for the median in Union Avenue
south of Ming Avenue to be enhanced with hardscaping and landscaping such as the
recent project consisted of. However, the segment of Union Avenue south of Ming Avenue
to Planz Road (one mile south) is not within the corporate limits of the City, so the County
of Kern may be the best entity to install this segment.
From Planz Road south to South Chester Avenue is within the City and could be installed
by the City. Currently, funds appropriated for median island enhancements are already
allocated to specified street segments throughout the City. Therefore, future funds could
be allocated specifically to this project.

In reference to Council member Maggard's request regarding Ruiz Foods expansion and information
about designated areas of uninterrupted power.
Staff had further discussion with Council member Maggard to get clarification. He indicated an interest in
demonstrating to Ruiz Foods that we were good neighbors by passing on information regarding possible
uninterrupted power sources and/or strategies. He asked that we get the name of the individual from
Long Beach who met with him, Brad Underwood and Mr. Tandy a few weeks ago and discussed some
type of on-site co-generation equipment. That person is Pete Boancic (714/962-7037).
Council member Maggard also wanted the name of the PG&E representative with whom they discussed
designation of uninterrupted sites within the city. Also present at that meeting were Bart Thiltgen, John
Stinson and Alan Daniel. Calls have been placed to determine if there are such areas currently within the
city - it does not appear so, but not everyone has responded.
Council member Maggard is interested in pursuing the feasibility of developing some type of
un-interruptible power source - which could possibly be a tool for Economic Development incentives. It
appears that this type of development is beyond the current knowledge and capacity of this department,
but we are very willing to work on a team with that goal in mind.

COUNCILMEMBER COUCH REQUESTED STAFF CHECK MAITIA'S C.U.P. TO
SEE IF THEY ARE VIOLATING ANY CONDITIONS AND CONTACT REPORTING
PARTY.
Maitia's Cafe occupies the eastern three-quarters of a building (approximately 4,500
square feet) within the Riverlakes Shopping center at the southeast corner of Coffee
Road and Hageman Road. The shopping center is zoned C-2 (Regional Commercial)
which permits the restaurant, outdoor seating area and onsite sales/consumption of
alcohol by right. None of these operations require the issuance of a conditional use
permit.
This building sits at the southwestern corner of the center approximately 25 feet from
the right-of-way of Coffee Road. The outdoor seating area (approximately 330 square
feet in area) is located at the northeastern portion of the building. The complainant's
property at 7808 Carbina Court is approximately 600 feet to the southeast of Maitia's,
being separated by a parking area, undeveloped land, and a six-foot high block wall.
Because Maitia's is somewhat isolated, sound travels a greater distance as it is not '
obstructed except by the block wall. Since the undeveloped land between Maitia's and
the complainant's home is also zoned commercial, it is anticipated that in the future,
additional commercial buildings will be built that will obstruct any direct sound travel.
However, no plans are currently on file with the Planning Department to develop this
land.
The use has been found to be in full compliance with all zoning requirements. Staff has
also contacted Code Enforcement, the Police Department and the State Alcohol
Beverage Control Department (ABC) concerning any ordinance or other related
violations. Code Enforcement found no violations under their authority.
Lieutenant Archie Scott with the Police Department sent a supervising officer to monitor
noise and it was reported that no enforceable violations were observed. Lt. Scott also

personally visited the site on the evening of Saturday, July 7th. He stated that he did
not hear any loud noises while standing near the block wall adjacent to the
complainant's home although there were many people in the outdoor patio. He noted
that the only possible violation could be the amplified music though it was not an issue
during the evenings visited by his personnel. He will continue to have his district patrols
monitor the situation and if violations are observed, they will take appropriate
enforcement action.
ABC stated to staff that they had received copies of the complainant's letters sent to
Councilmember Couch and have assigned an investigator to the complaint. Their
investigation will include site visits and checking the terms and conditions of the permit,
plus any restrictions that may affect alcohol consumption in the patio. They indicated
that excessive noise, if related to the alcohol sales under their license, could result in
additional restrictions, or if severe enough, revocation of their license.
Staff has contacted the manger at Maitia's to make them aware of the neighborhood's
concerns, and that both the Police Department and ABC would be observing their
operations. The Jones' (complaining party) were also contact by staff to inform them of
what was being done by these agencies to help resolve the issue.

"Couch referred the request from a citizen regarding a potential stop sign on Saddle
Drive and River Rock to public works - Traffic. Couch also referred the issue of
speeding and vandalism to the police department for monitoring..."
Council Member Couch's request was assigned to the Operations Division for action. Two
police officers and one police service technician were assigned to provide extra patrol in
the area of Saddle Drive and River Rock. In addition, the SMART trailer was placed on the
street in an effort to inform travelers of their speed and discourage violations.
The area was specifically monitored on July 7 and July 8. Eight violations were observed
including seven for speeding and one off-road vehicle on the roadway. Five of the
speeding violations occurred during morning rush hour traffic, and all violators were cited.
Traffic Sergeant Gary Moore called the reporting citizen's residence on July 9, and left a
message on the answering machine regarding the action taken by the police department.
Sgt. Moore also requested the citizen call him if the problems persist.
No vandalism activities were observed by officers. Staff will continue to monitor the area
as time permits, based on calls for service.

SUBJECT: RAILROAD TRACK REPAIRS

Councilmember Sullivan requests staff investigate the issue of repairs to the railroad
tracks at Pacheco and New Stine and provide a status report.
City staff met with the San Joaquin Valley Railroad (SJVR) personnel and with staff from
State Assemblyman Roy Ashburn's office on May 24, 2001, to discuss the condition of the
SJVR crossings within the City. Pacheco and New Stine are included on the list of
crossings in need of repairs. SJVR stated they would have a contractor get estimates for
the improvements of these crossings.
Public Works staff has recently contacted SJVR and the railroad company has indicated
their original contractor could not provide an estimate for the work because they were too
busy. SJVR has now contacted another contractor to provide a cost estimate for this work.
The estimate should be available later this month and Public Works staff will continue to
work with the railroad company to resolve the funding issue for the reconstruction work to
SJVR crossing tracks, within the City.

ICouncilmember Salvaggio requested a status report regarding the issues of the
Planz Park Playground Equipment Project and the Gwendolyn Street Sewer Project.
Design for Planz Park is scheduled to be completed in January and construction should
be completed in March 2002.
Design for the Gwendolyn Sewer will be completed by July 19th and construction is
scheduled to start by October 5th, and be completed by late November 2001.
