FROM: Alan SUBJECT: General Information 1. On the positive side, despite having only one Council meeting in December, the January 9th meeting will be very easy and quick ! 2. The camera enforcement program for red light violators has hit a number of snags, including an adverse court case which threatens the program, a shift in negotiation posture by the preferred service provider, and' an example of failing economics from Fresno. The program has been delayed, but for very legitimate reasons. A memo from John Stinson is enclosed. 3. Last night's Incubus concert was a complete sell out - a great way for the Garden to start out the new year. 4. There will be some membership changes to the Solid Waste Management Advisory Committee. Attached is the proposed list of nine positions that will be presented to the Board of Supervisors next week. 5. We have received a preliminary list of CalTrans projects for the area in and around Bakersfield to be done in FY 2002. The list is attached for your information, and we will update you' on the status of these projects as progress is made. 6. Per the attached press release from the DBA, their meeting on Tuesday, January 8th will focus on the High Speed Rail project. We plan to have staff in attendance. 7. The Employee Incentive Committee is pleased to present the list of High Five nominees and winners for the fourth quarter of 2001. Congratulations and appreciation to all for a job well done. 8. Attached are two memos from EDCD as updates on the loan status of two local companies: 1. Bakersfield Music Theatre has a five year loan from the City in the amount of $50,000 and has met the terms and conditions of the agreement for the first year. Therefore, 20%, or $10,000, of the loan amount will be forgiven. Honorable Mayor and City Council January 4, 2002 Page 2 2. Victory Circle has a five year loan in the amount of $49,906.19 to be repaid at zero interest at the end of the loan term. They have complied with the terms and conditions of the agreement for the first year relating to employment requirements. 9. Responses to Council requests are enclosed, as follows: Councilmember Couch · Status report on repair of potholes on Camino Media west of Coffee Road, east of the canal; · Information regarding timing of the traffic signal at Camino Media and Old River Road; · Status report on repairs to the railroad crossing at Buena Vista Road and PUC list of locations identified as not being in acceptable repair. Stinso~,~ssistant City Manager SUBJECT: Status of Red-light Enforcement Program Implementation of the Red-light Enforcement program has been delayed due to some unresolved contractual issues with the proposed vendor and recent court decisions and lawsuits involving other cities. This memo is intended to provide an overview of these issues and some possible alternatives. The city conducted an RFP process to solicit vendors to provide the red-light enforcement program. When the program was first discussed, systems using cameras with wet film were used by most cities, with a few using a newer digital camera technology. It was determined by Public Works and Police staffthat due to the benefits of the newer technology the RFP should require digital cameras. Subsequent to the selection of the preferred vendor, staff had concems regarding the financing of the system. Originally the system was to pay for itself on a per citation fee payed to the vendor. As the result of a recent Superior Court ruling which identified problems with the contingent fee structure (payment per citation) and operation of the San Diego red-light camera program, cities and vendors are changing to a flat fee approach which would obligate the city to pay for the system through a monthly fee arrangement. The flat fee proposed by the city's preferred vendor is $12,200 per approach for 16 approaches (4 intersections) for a three-year term. This would result in an annual cost per intersection of $585,600. While this cost would theoretically be offset by citation revenues, it would require an average of 12 citations per intersection per day over a three-year period to break even. Staff is concerned that the revenue would be not be sufficient to pay for the system. Further, should the law change or be challenged as it was in San Diego, we could be required to pay for a very expensive system which isn't generating revenue to pay for itself. , In addition, some other cities, such as Fresno have experienced problems with the implementation of the new digital technology. They have experienced low numbers of citations due to these implementation problems. Should we have the same experience as Fresno, not only would we not meet the goal of stopping red light runners, the economics of the red-light camera program would be adverse to the City. S:UOHN~ed Light Enforcemeat Progr~an Status Memo.wpd Based upon the eun'ent legal and regulatory climate and potential large financial obligations of the red-light camera program, there are several alternatives to consider. These include: a. Reevaluate the use of wet film technology. Staff could prepare an RFP for this type of system. Due to the more established technology and number of systems in place the companies may be able to offer a more financially feasible system to the city. This approach would have to take into consideration the issues raised in the San Diego court cases as to how the program would be financed (per citation vs. flat fee) and administered. b. Evaluate the program again in six months to a year. This would allow for a better evaluation of the technology available and responses to the legal issues raised in the San Diego case (i.e., experience of other cities revising or implementing new programs such as San Diego, Sacramento, Long Beach and Fresno). c. Not proceed with the program at this time. The red-light camera industry is in a state of flux due to recent legal rulings and changes in technology. Due to the level of uncertainty in the industry the best option may be to wait for a period of time to see which red-light camera programs are successful, effective and financially feasible. Kunz, Economic DevelolSment Director SUBJECT: Employment Status for Bakersfield Music Theatre Agreement No. 00-140 between the City of Bakersfield and Bakersfield Civic Light Opera (a/k/a Bakersfield Music Theatre) provided a $50,000 loan to the company for a term of five years. Twenty percent of the loan will be forgiven for each year the company meets all terms and conditions of the agreement. These terms included, · hiring three, and retaining seven, workers from Bakersfield. · of those workers hired at least 51% must be low- and moderate-income individuals. Exercising this forgiveness is h ministerial action and, thus, requires no Council action. The agreement states that the company does not plan on hiring any new employees until Year 3. However, in Year 1, 3.5 FTE (full-time equivalent employees) were hired, and 0.575 FTE, or 16.4%, were low- and moderate-income individuals. Because the company did not expect to make any new hires until Year 3, we will begin monitoring for the 51% level beginning in Year 3. Therefore, Bakersfield Music Theatre has met the terms and conditions required in the agreement and qualifies to have 20%, or $10,000, of the loan amount forgiven for the first year of the agreement. I propose we send a letter to the company which merely reflects the ministerial action of the debt forgiveness. Traffic Engineering had the operation of the traffic signal changed a few months ago to increase the efficiency by allowing two lanes of traffic to make the east to north left turn. This changed the signal timing for the north/south direction by a few seconds while improving the level of service for the intersection as a whole. The engineers will review the operation of the signal to confirm that it is still operating as designed and correct any malfunctions, if found. The San Joaquin Valley Railroad (SJVRR) crossing at Buena Vista Road is one of the seven SJVRR crossings the City previously identified as not being in an acceptable condition as required by the Public Utilities Commission (PUC). The PUC staff requested this past August that the SJVRR complete repairs to these seven crossings in a "timely" manner (see attached letter). As a result of this request, the SJVRR has been working with the City to repair these crossings at the rate of one crossing every 30-60 days. SJVRR 'is currently unable to afford the preferred concrete pad type crqssings, so they are meeting the PUC requirement by installing new wood crossings. However, staff understands that the SJVRR is pursuing other funding sources so that some of the future crossing repairs may be able to be of the concrete pad type. The Stine Road crossing repair was completed in October, and the South H Street crossing repair was completed in December. The White Lane Crossing is scheduled next for repair, and work should begin in 30-60 days on that crossing. The crossings are being repaired based on City staff's determination as to those that are in the worst condition, as well as those crossings that have the largest amounts of daily traffic. Based on the Buena Vista Road crossing's condition and relatively Iow amount of traffic, it will be repaired later in the program, probably late this Summer. cc: Jacques R. Please find enclosed a copy of GO 72-B. Section VII of GO 72-B states, as follows: VII Maintenance of Crossing in Track Area It shall normally be the responsibility of each railroad corporation to maintain the crossing area between lines two (2) feet outside of the rails of each track. When two or more tracks are involved, the railroad shall maintain the area between the tracks where the distance between the center lines of tracks is fifteen (15) feet or less measured at the center line of the road or highway normal to the tracks. The Commission staff requests that SJVR perform the necessary repairs in a timely manner in compliance with GO 72-B and advise Mr. Flores, the City, and the Commission staff when the railroad completes the repairs.
