As you may know from the recent media reports, CSUB has reached a decision to play their next season games at the Garden. We're very glad to hear they're coming back. 2. The CTC met on April 4th and adopted the 2002 STIP. As also mentioned in the media, their staff recommendation was to delay funding for the Westside Parkway until FY 2006-07. However, there may be some things we can do to get the funds sooner. The enclosed memo from Public Works mentions several of the options we may have available. Included with the memo is a copy of the letter we sent to Kern COG earlier this week with our proposed changes to the 2002 RTIP 3. More good news about Bakersfield as a desirable community to live - the National Association of Home Builders has ranked us as fifth on their "Western Top 10 Most Affordable Housing List". 4. The unveiling ceremony for the entry monument signs has been set for Thursday, May 16th at 10:30 a.m. at the location of the south sign. We will provide you with more details in the next few weeks. 5. We received correspondence this week from Time Warner Cable about their plan to expand the choice of cable broadband internet service providers for local customers. Please refer to the attached letter for additional information. 6. Attached is a status report from Public Works including progress made on street rehabilitation projects in the past two weeks, as well as various other construction projects that are currently underway or scheduled to begin soon. We received a very complimentary letter about Gene Bogart for his recent presentation to the Rotary Club on the Kern River Parkway projects. Thanks to Gene for showcasing our City projects in such an informative and enthusiastic way. 10. FROM: (~/.~f/~AUL ROJAS, PUBLIC WORKS DIRECTOR DATE: PRIL 5, 2002 SUBJECT: 2002 STATE TRANSPORTATION IMPROVEMENT PROGRAM (STIP) On April 4, 2002, the California Transportation Commission (CTC), adopted the 2002 State Transportation Improvement Program (STIP). What this means for the City of Bakersfield is that several large projects in which we have been working on are going to be allowed to move forward. The first project of note is the Fairfax at 178 Interchange project which was successfully changed from a Caltrans construction project to a City construction project. This will provide significant cost savings that will be then placed back into the Region for use on other projects. The most significant action involved the successful conversion of the State Route 58 project (the old Kern River Freeway) into the Westside Parkway. CTC staff had recommended preliminary work be funded in the early years with construction slated for the 06-07 year. City staff was in agreement with CTC's staff recommendation, with the exception of the construction year. We had provided testimony to the CTC to try and bring that money back to the 04-05 year in which it was originally programmed, some four years ago. Due to funding short falls statewide, the CTC was unable to grant the request and kept the money for construction, approximately $136 million, in the 06-07 year. With respect to the $20 million in savings that is to be used for rehabilitation projects, that action will take place with an amendment that is currently being processed at this time. There are several things we can do to ensure those funds become available sooner than the 06-07 year. Those included working with the CTC staff on cash flow issues, engaging our State Legislators to assist us in this effort and looking into the possibility of advancing the funds with local dollars paid back with Federal dollars in the future year those dollars are programmed. In other words, when the rehabilitation money becomes programmed through the amendment process and it is placed in a later year, it is our understanding we can front the money ourselves and get paid back in that later year under the provisions of the (Garvey Bill). Staff is currently researching that possibility. Attached is a spreadsheet outlining the City of Bakersfield's proposed changes to the 2002 Regional Transportation Improvement Program (RTIP) regarding the redistributionof funds for the westside Parkway project. At their March 21,2002 meeting, the Transportation Planning Policy Committee (TPPC) approved the City of Bakersfield's request to reprogram $20,000,000 in right-of-way acquisition savings realized from the down-sizing of the freeway facility from a 300' wide State Route to a 210' wide local parkway. The TPPC further voted that any additional right-of-way savings beyond the $20 million is to go to the other various cities within the Kern Council of Governments (COG) for road rehabilitation projects. Based on City estimates, this additional savings totals $401,000. The desired redistribution of the remaining funds for the project is shown on the shaded portion of the spreadsheet. Please note there may be a small discrepancy between your number and ours with respect to expenditures related to right of way purchased by CalTrans. This discrepancy must be resolved prior the CTC meeting so as to be completely accurate when the final action is taken. As you are aware, a portion of the right-of-way savings were previously redistributed to the construction phase of the project, which is why now both the right-of-way and construction phases of the project are reduced as part of this redistribution. It is requested that this redistribution be placed on the agenda for the Technical Advisory Committeemeeting of April 3, 2002, for ultimate action by the TPPC. The National Association of Home Builders (NAHB) ranks Bakersfield fifth on its Housing Opportunity Index (HOI) in the Western Region for the Fourth Quarter of 2001. In the previous quarter, Bakersfield ranked fourth in the West. The ten communities with the most affordable housing in the Western Region are, 1. Anchorage, Alaska MSA 2. Phoenix-Mesa, Arizona MSA 3. Albuquerque, New Mexico MSA 4. Yuma, Arizona MSA 5. BAKERSFIELD MSA 6. Reno, Nevada MSA 7. Las Vegas, Nevada MSA 8. Olympia, Washington MSA 9. Bremerton, Washington MSA 10. Tucson, Arizona MSA NAHB defines housing affordability as the percentage of homes sold that a family earning the median income can afford to buy. The survey showed that 70.2 percent of Bakersfield's families can afford a median priced home. This compares with Visalia-Tulare-Porterville (63.3 percent), Redding (54.3 percent), Fresno (53.3 percent), and Riverside-San Bernardino (50.8 percent). By contrast, only 37.5 percent of families in Los Angeles-Long Beach can afford to buy a median-priced home there. In San Diego the figure is 22.4 percent and in San Francisco, 8 percent. On NAHB's national rankings, Bakersfield's HOI ranks 98th; last quarter, Bakersfield's national ranking was 97th. Rojas, Raul Date: 4/3/02 3:05PM Subject: Re: Media Subjects The White Lane Reconstruction/Stine Road Intersection Expansion is currently underway, with travel lanes on White Lane between Stine Road and Wilson Road limited to two lanes in each direction. This work is scheduled to be complete in late May/early June. The Brimhall Road Sewer project started last week. This project will extend sewer in Brimhall Road from Allen Road west to Westdale Drive, and will serve some newly developing City residential tracts with sewer as well as allow much of the already developed Westdale neighborhood area to connect to sewer. The northeast bike path also restarted construction operations last week. The paving was delayed last Fall while Cai Water finished up some water line installations in the area of the path. These water pipelines will convey water from the Kern River up to the new water treatment plant. The bikepath paving should be complete in 3-4 weeks. The Mohawk Trunk Sewer is scheduled to receive bids next week. This project will extend sewer east from Coffee Road along the south side of the Equilon Refinery to serve the Double Tree Hotel area. This trunk sewer line will replace a high maintenance sewer line and pump station that currently extends east under State Route 99. Bids were received yesterday for the Kroll Way Bridge, and the project is scheduled for Council Award at the April 10, 2002 meeting. This project will provide another access into Cai State from the Gosford Road area, and is one provision of a master agreement between the University and the City that was entered into in the late 1960's. This project is scheduled to be essentially complete by June 12th. Bids are also to be received next week for the reconstruction/resurfacing of Fairfax Road from College Avenue to Valley View Drive, Wilson Road from Planz Road to Agate Drive, and Virginia Avenue from King Street to the San Joaquin Valley Railroad. Kurtz, Economic Development Director c,, SUBJECT: Employment Status for Harvel Plastics Agreement No. 98-52 between the City of Bakersfield and Harvel Plastics provided a $123,020 loan to the company for a term of five years. Twenty percent of the loan will be forgiven for each year the company met all terms and conditions of the agreement. These terms included, · hiring 56 workers within the first five years, with 16 new jobs in Year 1, 15 new jobs in Year 2, 10 jobs in Year 3; 5 jobs in Year 4; and 10 jobs in Year 5; and · of those workers hired, at least 51% must be low- and moderate-income individuals for each of the first five years of the agreement. Exercising this forgiveness is a ministerial action and, thus, requires no Council action. For the fourth year of the agreement, the company employed three new hires, and 67% of these hires were low- and moderate-income individuals. While the company has not hired as many workers to date as projected, the company offset this deficit by exceeding the 51% level of low- and moderate- income hires. As the table shows, during the first four years of operation, 77% of all hires have been low- and ,:~.-~ ~..:~, ~mplO~mei~t moderate-income individuals. GRADY, PLANNING DIRECTOR DATE: April 1,2002 SUBJECT: DESIGN ORDINANCE Council Referral No. WF0019078 COUNCILMEMBER BENHAM REQUESTED THAT STAFF REVIEW THE DESIGN ORDINANCE PROPOSAL FOR DOWNTOWN SUBMITTED BY PATRICK STEELE AND REPORT BACK TO COUNCIL. On December 12, 2001 Mr. Patrick Steele made a public statement to the City Council that the City consider a design ordinance for downtown. Architectural criteria would require that new buildings be designed consistent with a historical theme using red brick and limiting contrasting building colors to a teal pallette. In addition, he suggested that buildings outside the downtown area be no taller than two stories. The city has used a design review process for new projects since the 1970's. This process was modified in 1982 with the adoption of a site plan review process. Standards were adopted by ordinance which helped to clarify regulations and remove the subjective nature of the design review process. This process was again modified in 1991 to further refine the site plan review procedures and place all of the development criteria within the zoning ordinance. These final changes removed any remaining discretionary components in the review process so that projects would be evaluated for consistency against adopted standards set by the Council. In the downtown area, the discretionary review process remained until 1995 when new zoning districts were specifically developed for the downtown area. Before then, projects not only were reviewed by planning staff, but were also subject to a special downtown review process. This second review process was found to be a deterrent to downtown development because of the subjective nature of the process even though the project met the basic requirements. The new zoning and general plan designation for the downtown area removed this discretionary uncertainty and treated projects downtown no differently than a project outside the area. These two new downtown zones also included a number of design alternatives. Mixed use development (residential/commercial) is permitted by right so that high-rise buildings can accommodate apartments above commercial businesses without additional discretionary hearings. ALAN TANDY, CITY MANAGER April 1, 2002 Page 2 In addition, projects that incorporate enhancements such as sculptured building tops, awnings, open spaces and atriums open to the public, and public art can obtain bonuses to permit additional building area. These design elements are currently encouraged in the ordinance and apply to any developer wishing to take advantage of the bonus. This creates a wide variety of architectural styles and design themes that actually enhances the downtown area. The result of these changes to the site design procedure has improved the city's review process to where the playing field is now the same for all projects. With the standards contained in the ordinance, developers know exactly what is expected and there are no surprises that can adversely affect or discourage the building of a project. Regarding the limiting of building heights outside the downtown area to two- stories, such an ordinance would have negative effects upon development. A major result is that buildings would need more land area as they would be spread outward rather than up. This would in turn result in less efficient use of land as the City growing further away from the core to accommodate the same amount of building area. Nearly all zone districts would have to be amended including residential zones which allow 21/2 story buildings. Significant changes would also have to be made to the General Plan policies and growth forecasts since the major commercial centers identified in the plan could no longer accommodate the dense development originally envisioned. Previous Councils have examined limited building heights, and in the late 1980's, commercial building heights were reduced in the C-1 and C-O zones from six to four stories. The height limit in the C-2 zone is six stories. Industrial zones usually need taller buildings to accommodate towers and large pieces of equipment that may not be able to fit inside a two-story limitation. Downtown building heights were also limited until 1995 when new zoning districts were adopted. Currently, building heights in the downtown area are unrestricted (no height limit). If the Council wishes to pursue re-establishment of a downtown review committee, or establishing additional height limits for buildings outside of downtown, I recommend that the matter be referred to a committee so that parameters can be discussed and established. On March 13, 2002 staff contacted Terry Maxwell, owner of Maxwell's Restaurant located at 1421 17t' Place, regarding the referral from Councilmember Benham, stating that Mr. Maxwell was interested in changing the name of 17t' Place. Mr. Maxwell stated that he wanted to change the name of 17t' Place to "Office Place" or "Office Alley", because his customers reported that they had difficulty locating 17t' Place due to its proximity to 17th Street. He stated that he had talked with Gina Tuttle and Darlene Barthel, the owners of 17~h Place Cottage, located at 1420 17th Place, and that they were in agreement with this name change. Staff contacted Darlene Barthel, owner of 17t' Place Cottage. Ms. Barthel stated that she did not want to change the name of her business and that she would prefer that the street name remain the same. She submitted a letter to this affect which is attached. City Traffic Engineer, Steve Walker, stated that the street name could not be designated as an "alley" because it does not meet the legal definition of an alley. He also stated that there would be some record changes involved, but these changes could be effected if necessary. Examples of these include: official street map, address records, improvement plans, utility plans and records, County Assessor's records, Post Office address file, and building plans. Although the City of Bakersfield has historically had little regard for street naming principals, this particular street name using the designation "Place "does fall within general guidelines. Terry Mathis, Kern C°unty 911 Coordinator stated that due to the fact that there are already two city streets (Office Center and Office Park) and two county streets (Office Court and Office Lane) that utilize the word "Office", she requests that a new street name not include the word "Office". The businesses above are the only two businesses located on 17th Place. For these reasons staff recommends no change to the 17th Place name.
