SUBJECT: General Information
1. The maps of the three pool size alternates are enclosed.
2. Congratulations to Greg Klimko and the Finance Department! On August 14th, they
were formally recognized for having its written investment policy certified by the
Annual Conference of the Association of PUblic Treasurers of the United States and
Canada (APT US&C). The City was honored at the Annual Conference in
Vancouver, British Columbia.
3. The amendment to the Business License Tax ordinance, authorizing exemption for
the business of "rental real estate" as a passive activity became effective August 30,
2002. A memo with a revised application is attached for reference.
4. The skatepark is closed for a time due to graffiti. General Services is hoping to get
it cleaned up this week, and the Police Department is working on the problem from
their end.
5. Enclosed is a Water Resources staff memorandum on the progress of the Northeast
Bakersfield Water Supply project. The project is on schedule for delivering water in
the Spring of 2003.
6. Four taxi stands were added this week to downtown streets as a result of committee
discussions and meetings with taxi cab stand advocates. Two taxi stands have
been placed in front of O.L.A. Raza, Inc. at 1630 19th Street at that organization's
request (across from Goose Loonies). Two more stands have been placed along N
Street south of the railroad tracks and the back entrance to the Centennial Garden.
These two stands will be reviewed after a trial period to see if the stands are being
well utilized for this purpose.

7. At the Wednesday Council meeting, I mentioned we had requested, but not
received the High School District agenda, saying aquatics was on the agenda. My
error, it was in this office. My lack of information was from being on vacation. The
not yet adopted minutes to their meeting are enclosed.

City of Bakersfield, California's Written Investment Policy Certified by
the Association of Public Treasurers of the United States and Canada
Washington, DC---On August 14, 2002, the City of Bakersfield, California was formally
recognized for having its written investment policy certified by the Association of Public
Treasurers of the United States and Canada (APT US&C). Earlier this year, the City's policy was
reviewed and certified as meeting the standards set forth by APT US&C. The City was honored at
APT US&C's 37th Annual Conference in Vancouver, British Columbia.
Over 300 governments have had their policies certified by the Association since its Investment
Policy Certification Program was developed in 1990. The City of Bakersfield is one of 20
governments in the State of California to have its investment policy certified by APT US&C this
year.
The Program was instituted in an effort to assist state and local governments interested in drafting
or improving upon an existing investment policy. As part oftheProgram, the Association has
created a "Model" investment policy. The Model includes sample language and ratisnale for those
18 sections that the Association deems as critical elements included in the Model: liquidity;
selection and review of suitable investment instruments; internal controls; reporting; portfolio
diversification; custody and safekeeping; selection of investment institution criteria; ethics; and
conflicts of interest.
A written investment policy is only certified when the Association's Investment PolicyPi~view
Team acknowledges that the policy has met all criteria set forth in the Program. Of the policies
received each year for review, only two-thirds of the policies reviewed are accepted on their first
submission. Those not initially approved are encouraged to amend their policies and resubmit for
certification.

Subject: Business License Tax Amendment
The amendment to the Business License Tax ordinance, authorizing exemption for
the business of"rental real estate" as a passive activity in accordance with Internal
Revenue Code Section 469, became effective on August 30, 2002.
On Monday September 9, 2002 the Treasury Division will be sending the first
letters (about 200) to those that rent or lease commercial or residential property
based on information from Kern Data. Enclosed will be a revised business license
application that provides the tax exemption option for passive investment in real
property rental.
As additional information, on Friday September 6, 2002 we will be mailing 5,100
senior citizen refuse refund checks. Most checks are in the amount of $72.00.

For your information. The skatepark is still locked up due to the graffiti. General Services is hoping to get
the graffiti taken off tomorrow. Over the weekend, kids were getting in by prying the fabric and climbing
underneath the fence and prying the gate open. Greg will have to replace serveral rules sign due to graffiti
damange. They are being ordered now. We have been working with the police department on this since

SUBJECT: Northeast Bakersfield Water Supply Project - Construction Progress
The Northeast Bakersfield Water Supply Project is to bring high quality Kern River drinking water to the
citizens of northeast and central Bakersfield, as well as provide the catalyst for orderly development of the dry
foothills on the eastside. The project began with the City constructing a Kern River mm-out structure, located
below the California Living Museum. The entire project, a public-private cooperation between California
Water Service Co. and the City, will include a river pumping station, two adjoining reservoirs, the
purification/filtration plant and distribution pipelines to and from the purification plant. The Cal Water/City
Kern River pumping plant, the City reservoirs, the Cal Water Treatment Plant and the Cal Water pipelines are
under construction at this time.
The Kern River Pumping Plant, located just east of
the reservoirs, is now over 80% complete. A 54" raw
water pipeline already installed extends from the
pumping plant, crosses Alfred Harrell Highway and
follows the bike path southerly until turning east at
Kern River Pumping plant. Kern River turn-out is located behind
the plant near the tree line
Pacific Gas & Electric power substation (under construction)
the PG&E substation (currently being constructed)
until it reaches the Cai Water purification/filtration
plant. The pumping and treatment plant facilities will
be served through this PG&E substation.
A liner installation blanketing the bottom and sides
of the two raw water reservoirs is scheduled has
phase two of the reservoir construction. The liner will

prevent leakage. A pre-bid project tour conference was conducted on September 4, 2002, for all prospective
bidders. The bid opening is scheduled for September 17, 2002. Council award is expected on October 2, 2002.
Installation of the liner should be completed by January 2003.

Northeast Bakersfield Water Supply Project
The California Water Service Co. Bakersfield
Treatment Plant is approximately 40% complete. The
plant is located approximately 11/2 miles north of
Mesa Marin Raceway, just west of Valley Lane.
Construction is on schedule for an April 2003, initial
start-up demonstration of the plant and distribution
system. This will analyze the facilities for any
adjustments prior to officially serving City residents
in May 2003. -
~r~ Million Gallon Clear Water Storage Tank
Cai Water is currently installing almost 7 miles of
~ :t ~,~ transmission and distribution water pipelines that
range in size from 18" to 54" in diameter. That
portion of pipeline along Alfred Harrell Highway has
been completed. The major transmission lines along
Paladino Drive are in the ground and being buried.
Installation of pipeline will continue along Morning
Drive, Panorama Drive, Fairfax Road and Auburn
Street over the next three to four months. Minor
traffic lane disruptions are expected on these streets
Cal Water Treatment Plant buildings during this installation period.

of the Administrative and Support Services Office, Kern High School District,

This complex proposal was turned down several weeks ago because the
contribution sought from Kern High School District was $3.0 million. It is
important to note that this proposal from Mr. Maggard will not solve all of the
District's future needs. Associate Superintendent Scott further reported that
Mike Keese, Director of School Support Services, has been asked by the
District Superintendency to form a committee of swim coaches, athletic
directors, principals and parents to examine both current and anticipated future
needs of the district in this area. "Given the current state budget crises, the need
for the voters to pass Proposition 47, the statewide school bond in November,
the costs to build pools and because the Kern High School District has limited
resources, its important that we enter into the right partnerships. However, I
believe Mr. Maggard's proposal for a contribution, which has a significantly
lower cost to the Kern High School District, is worthy of consideration.
Because of this, we would appreciate direction from the Board of Trustees."
Trustee Wattenbarger responded she was glad to see a possible solution
available. Trustee Thomas asked if dollar figures had been talked about.
Associate Superintendent' Scott reported the dollar amount used two years ago
at Bakersfield College was approximately $350,000, with maintenance language
review to occur after three to five years of the agreement. He also stated that
the District had discussed with Councilman Maggard the possibility of a similar
agreement with the City of Bakersfield. Trustee Batey stated that it is key to
remember that the District would not be the contractor on the construction of
the pool or the owner of the pool, and that the District would only be renting
lanes for a fixed number of years. Superintendent Hatcher agreed with Trustee
Batey's comments, and reported that space would be rented by the Kern High
School District for four months a year for approximately' four hours a day, plus
some special events. Trustee Thomas asked how formal the discussions have
been to this point and if the deal could be stopped at this point. Associate
Superintendent Scott responded that no commitment has been made on behalf
of the Kern High School District as of this date, and that a proposal will be
made to the City of Bakersfield City Council at tomorrow's meeting.
Superintendent Hatcher. reported that a partnership works when it is good for
both parties.
Trustee Starrh expressed his support for the District administration to work out
a proposal that would give students access to more swimming space as long as it
doesn't impact other programs. He asked how many schools would benefit
from the location of the new aquatic complex. Associate Superintendent Scott
reported it would generally accommodate two schools at one time, which allows
for immediate after-school practice sessions, in addition to an excellent location
for valley and division meets. Trustee Wattenbarger also expressed support for
continuing the discussion, and expressed concern that this agreement would not
negate any discussions or partnerships with the North Bakersfield Park and
Recreation District. Associate Superintendent Scott responded this is one pool
that is being discussed. "There is a need for a number of pools in a number of
locations within Bakersfield."
Trustee Hampton thanked Associate Superintendent Scott and Superintendent.
Hatcher for an excellent report and also supported moving ahead with
discussions with the City of Bakersfield.

site.

SUBJECT: Transfer of Median/Streetscape Maintenance
Although it may appear to be a simple matter to transfer the median
maintenance responsibility to another department, it would be both
impractical and inefficient to do so. Due to the success we have achieved
in improving operational efficiency during the past few years, it would also be
very disruptive to our overall maintenance program. One result of the focus
on efficiency is the"sharing" of staff and equipment between streetscape and
park maintenance. To attempt to split these functions at this time would
require the addition of many staff positions and the purchase of the
equipment and supplies needed for the new staff.
Landscape maintenance is supported by skilled staff like the craftworkers
and technical staff such as the chemical applicators and the urban forester.
Because these few positions have a vast and varied responsibility citywide,
it would be practically impossible to allocate their time to meet the needs and
schedules of two separate departments.
Beyond the "simple" mowing and edging, are the other aspects of
maintenance. For example, the irrigation system. These systems require
daily monitoring. Further, because of the design of the medians, the age of
the irrigation systems, as well as vandalism, constant adjustment and repairs
are required. Problems like weed irradication complicate the work
Because a function such as landscape maintenance requires a team of
individuals who each have a different speciality or skill, it is difficult to easily
describe or quantify the problem of separating park maintenance from
streetscape maintenance. For example, although I may be able to state that
there are nine staff "dedicated" to streetscape maintenance, in reality there
are at least thirty individuals who work in the streetscapes in any given week.
In addition to the field staff, are the supervisors and service coordinators who
support all field operations. These individuals have responsibility for both
parks and streetscapes in each of four areas of the city. We do not have any
supervisors or coordinators dedicated to just streetscape maintenance. This
organizational design allows for better coordination, scheduling, and
minimizes wasted effort in our daily operations. In order for the transfer of
streetscape maintenance to be successful by the other department, it would
require supervisiors knowledgeable and experienced in landscape
maintenance, plant and soil sciences, and irrigation systems.
The best way the city can meet its goal of providing quality service while being
fiscally prudent, is to have. Recreation and Parks design and maintain the
medians and streetscapes with the support from the other city departments.

Over the next several weekends, Street Cleaning crews will clean up trash and litter
at the following locations.
1. Coffee Road & Rosedale Highway.
2. Hageman Road, Coffee Road to Calloway Drive.
3. CsHoway Drive, Brimhall Road to Stockdale Highway.
4. Stockdale Highway, Calloway Drive to Allen Road.
Stockdaie Highway and Calloway Drive used to be under the Adopt-A-Highway
Program, but organizations have dropped out of the program.
After these areas are cleaned, the Street Cleaning Supervisor will monitor the areas
periodically and will schedule cleaning operations, as needed.

ouncilmember Couch requests staff move up on the priority list the installation of
a traffic signal at Old River and White Oak.
The intersection of Old River at White Oak was added to the Traffic Engineer's List
of warranted future traffic signal locations on July 31, 2002, after warrants were met
in July 2002. The ranking is number 29 out of 38 un-funded, but warranted, signal
locations based on comparative need for each signal. The Capital Improvements
Program list of signal projects is developed each year for the next year's budget. In
preparing that list, staff will consider several factors in determining which projects to
include in the recommend CIP. Those factors include
· Funding amounts available in the various sources that can be used for traffic
signals; and
· The ranking of specific signal projects based on their warrants.
In past years, our funding for traffic signals has been limited. The new federal

During the preparation of the Capital Improvements Program list, staff will provide
updated funding information to Council along with the ranking by warrants. Other
options, such as traffic channelization, will also be considered to maximize the
number of intersection improvements constructed with those limited funds.
Recommendations as to which signal projects to include in the FY 2003~04 budget
will be brought to Council for final determination.

CODE SECTION 601.1 of the California Plumbing Code States:

administrative authority, EACH plumbing fixture shall be provided with an
adequate supply of portable running water piped thereto in an approved manner,
so arranged as to flush and keep it in a clean and sanitary condition without
danger of backflow or cross-connection. Water closets and urinals shall be
flushed by means of an approved flush tank or flushometer valve.

SUBJECT: Request by Councilmember Couch for response to appeal letter from Stiers
Leisure Vehicles, Inc. concerning reuse of vacant house to home building as an
R.V. dealership.
The appeal was filed by Alexander & Associates on behalf of Stiers Leisure Vehicles.' The letter
is attached to the memorandum. The appeal is based on three main points. One point is that
signatures of the current property owner or authorized representatives have not been obtained
on the application. Another is that signatures of the current property owner or authorized
representative were not obtained on the indemnification agreement and, last, that the CUP may
adversely affect the auto mall tenants.
The last point has a shorter answer and will be responded to first. The City has been and is
supportive of the Auto Mall project. However, that support has not precluded the consideration
of similar uses in existing vacant structures in the general vicinity of the Auto Mall.
Two points were made with reference to required signatures. Both relate to required signatures
on application documents. For typical cases, owners are required to sign the application and
indemnification agreement. Both are meant to protect the City. This case was not typical. The
applicant is in negotiations to buy the property through another owner who is purchasing the
property out of bankruptcy. To accommodate due diligence timelines, the applicant requested,
and was allowed to pursue the CUP application knowing that the' CUP approval could not be
effectuated without a property signature. By ordinance, the applicant would have one year to
implement the rights granted by the CUP or the approval will terminate.
The applicant did correspond with Newmark Retail Financial Advisors concerning pursuit of the
CUP application. A copy of the letter is attached.

I represent Lee FitzGerald of Venture Out who is negotiating with RSM to purchase the
Bakersfield asset for use as an RV Sales and Service outlet. The City of Bakersfield requires a
Conditional Use Permit for this use on this property, and Mr. FitzGerald wishes to apply for it
now even though he has not concluded negotiations with RMS. Applying now allows us to be
calendared for a hearing within our due-diligence period. Should we miss this next application
date, we will not be able achieve a hearing until after the due-diligence period. If we don't
reach agreement with RSM, we will simply drop our attempts to obtain a CUP.
In Bakersfield, the CUP application requires the approval of the property owner of record,
which is still shown to be HCCA Realty Corporation, 3345 Michelson Drive, h'vine, California.
The application also requires that the owner of record indemnify the City of Bakersfield during
the CUP process.

Hi Rhonda-
Vicki asked that I provide you an update on the Council Referral #194 (I think that's the #) re: Mr. Kidwell's
citation et. al. at White and Wilson. It will be done today. One of our officers had taken a photograph of the
intersection and he was gone last week. I now have a copy of that photo and Sgt. Roger Ott is completing
our response. As the photo will show, the road is clearly marked with arrows, the left turn signal points
straight and there was a 30"X30" No Left Turn sign next to it. Due to our records management conversion
the total number of citations and to whom they were written is not available. I have been told by the
officers, that issued the citations, that the court is finding the violators guilty as charged - especially when
the photo is introduced.
