A RESOLUTION OF APPLICATION PROPOSING
PROCEEDINGS FOR ANNEXATION OF TERRITORY TO
THE CITY OF BAKERSFIELD AS ANNEXATION NO. 491
LOCATED ON THE EAST SIDE OF JEWETTAAVENUE,
NORTH OF SNOW ROAD. (WARD 4)
WHEREAS, the City of Bakersfield desires to propose a change of organization, to wit, the
annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 56654
of the Government Code of the State of California; and
WHEREAS, the proposed annexation territory is within and consistent with the City of
Bakersfield Sphere of Influence boundary; and
WHEREAS, the City of Bakersfield agrees to annex the territory located on the east side of
Jewetta Avenue, north of Snow Road; and
WHEREAS, the City has agreed to serve the territory upon annexation; and
WHEREAS, the property owner of the territory has consented to annexation to the City of
Bakersfield; and
WHEREAS, the property owner of the territory has consented to annex the site to the North
of River Sanitary District; and
WHEREAS, the North of River Sanitary District has agreed to annex the territory and serve
the site, upon annexation; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that it
hereby finds and determines as follows:
1. That the City of Bakersfield hereby proposes the annexation to the City of
Bakersfield of the territory in Exhibit "A" and shown on map marked Exhibit "B"
attached hereto and made a part of this resolution as though fully set forth herein,
located on the east side of Jewetta Avenue, north of Snow Road.
2. That a plan for providing services within the affected territory of the proposed
annexation, in accordance with the provisions of Section 56653 of the Government
Code, is marked as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
3. That this proposal for change of organization, to wit, annexation, is made pursuant to
the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, and it is
requested that proceedings be authorized for annexation in accordance therewith.
4. That the reasons for the proposed change of organization are that the owners of the
affected territory desire to receive municipal services from the City of Bakersfield,
and the City desires to receive tax revenues for benefits given and to be given to the
territory proposed to be annexed.

5. That for this proposed annexation territory and the prezoning therefore, the City
prepared an environmental document in accordance with State CEQA guidelines
and will use the environmental document for the proposed prezoning and
annexation.
6. That the laws and regulations relating to the preparation and adoption of the
environmental document as set forth in the California Environmental Quality Act
have been duly followed.
7. That the territory proposed for annexation as described herein has been determined
to be uninhabited pursuant to Section 56046 of the Government Code.
8. That the territory proposed for annexation as described herein has been determined
to have 100% of property owners consenting to annexation.
9. That the territory proposed for annexation as described herein is within the City of
Bakersfield Sphere of Influence Boundary.
10. That the Local Agency Formation Commission waive the protest hearing
proceedings pursuant to Part 4, commencing with Section 57000 of the Cortese-
Knox-Hertzberg Local Government Reorganization Act of 2000.
11. That the names of the officers of the City of Bakersfield who are to be furnished with
copies of the Executive Officer's Report and who are to be given mailed Notice of
Hearing, if any, are:

ANNEXA nON No. 88
That parcel of land being portions of the southwest quarter of Section 6, and of the northwest quarter of
Section 1, Township 29 South, Range 21 East, M.D.M., County of Kern. State of California. more
particularly described as follows:
Beginning at the southwest corner of said Section 6, also being the point of intersection of the centerlines
of Snow Road (Co. Rd. No. 61) and Jewetta Avenue (Co. Rd. No. 61 + 366), said point being a
monumented section corner calculated to be 2,343,601.154 feet North and 6,225,688.684 feet East per
California Coordinate System (N.A.D. 83). Zone 5;
Thence (1) N 00039'24" E along the west line of said section 6, a distance of 1326.85 feet to the
northwest corner of the southwest quarter of the southwest quarter of said Section 6, said point also
being the southwest corner of Parcel 1 of Parcel Map No. 9614 filed in Parcel Map Book 43, page 190;
Thence (2) S 89051'13" E along the north line of the southwest quarter of the southwest quarter of said
section 6. also being the south line of said Parcels 1 and 2 of said Parcel Map 9614, a distance of
1213.04 feet to a point on the west line of the east 15 feet of the southwest quarter of the southwest
quarter of said Section 6, said point also being the west right of way of a 30 foot Private Access
Easement (Isaak Lane) per Grant Deed recorded in Book 6126, Page 2162 of Official Records;
Thence (3) S 01012'06" W along said west line and said right of way, a distance of 1290.84 feet to the
point of intersection of said west line and the north right of way line of said Snow Road;
Thence (4) S 89051'42" E along said north right of way line, a distance of 121.08 feet to a point on the
east right of way line of the Friant-Kern Canal, said line also being the corporate boundary line of the City
of Bakersfield;
Thence along said corporate boundary line the following two courses;
Thence (5) S 00032'32" W along said east right of way line, a distance of 60.00 feet to a point on the
south right of way line of said Snow Road;
Thence (6) N 890 51'42" W along said southerly right of way of Snow Road, a distance of 1981.96 feet to
a point on the centerline of said Jewetta Avenue;
Thence (1) departing from said right of way and corporate boundary N 00039'24" E along the centerline of
said Jewetta Avenue, a distance of 24.00 feet to the point of beginning.

1. What effects, if any, would annexation of this territory have on the existing level of city/district
services (i.e., need for additional emergency service personnel or construction of new facilities,
etc)? The annexation of this territorv will have minimal effect on the near term level or caoabilitv
of the Citv to orovide needed services. Uoon future develooment. additional oolice officers would
oossiblv be recuired to maintain the current level of citv service. The olanned develooment
includinc oublic streets or municioal facilities within the territorv will increase the future
maintenance resoonsibilitv of the Citv but should not affect the existinc level of service.
2. Would city/district require any upgrading or change in facilities to serve affected territory (roads,
fire hydrants, mains, etc.): If so, would city/district or developer be responsible for financing? No.
if anv additional develooment occurs. the develooer orovides and oavs for maior facilities and
dedicates them to the Citv. No uoaradinc or chance in facilities will be recuired in the territorv for
annexation.
3. Indicate and explain existing zoning in affected territory. Countv zoned the territorv A (Exclusive
Acriculture).
4. Indicate and explain proposed prezoning in area. (List effects on present land use that would
occur as a result of annexation such as maintenance of livestock on property, etc.)The Citv has
adooted Ordinance No. 4382 chancinc the Citv orezoninc from A(Acriculture) to E (Estate) on
32.01 Acres and C-1/PCD (Neichborhood Commercial/ Planned Commercial Develooment) on
6.79 Acres.
5. List city/district services that area will directly or indirectly benefit from such as decrease in fire
insurance rate, shorter emergency response time, use of community facilities, etc. Citv Police
should be able to resoond in a more timelv manner than oresent Countv Sheriff services. Parcels
within the incoroorated area are allowed to connect to available North of the River Sanitation
District No. 1 sewer svstem lines. The oresent Citv refuse collection rate is substantiallv lower
than fees countv residents now oav to indeoendent comoanies. No soecial assessments or
charces for street sweeoinc. leaf collection. street Iichtinc enercv costs and fire hvdrants when
located within the Citv's incoroorated area. Citv covernment also orovides increased oolitical
reoresentation for the residents within the coroorate limits.
6. Please provide the following information relative to city/district and county taxes:
List existing tax rate(s) in area. The existinc tax rate in the area ecuals 1.019607% (TRA
009-047) of assessed market value. This reoresents the total orooertv tax rate. When annexed
a desicnated oercentace of the total orooertv tax of the area will accrue to the Citv and remainder
to the Countv for orovidinc health care and social services. (Rate as shown on 2006-2007 Countv
Auditor-Controllers 2006 Lien Date).
1. Would affected area be subject to any bonded indebtedness of the city/district?: If so, explain.
No. the Citv bounded indebtedness has been oaid off and the current tax rate list shows no citv
bonded indebtedness.
8. How will the difference in tax rates affect a property with a market value of $50,000.00?
The orooertv rate will not increase due to annexation and re-assessment will not occur due to
annexation.
9. Is the proposed area subject to a Williamson Act Contract? No. the existinc annexation area is
not subiect to a Williamson Act Contract.
