HomeMy WebLinkAboutRES NO 249-07 RESOLUTION NO. - 2 4 9- 0 7 A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO EMERGENCY SEWER ABANDONMENT IN McCUTCHEON ROAD BETWEEN MOUNTAIN RIDGE DRIVE AND STINE ROAD, NOT TO EXCEED ONE HUNDRED TEN THOUSAND DOLLARS ($110,000.00). WHEREAS, on Wednesday, October 24,2007, Construction Division staff responded to a call regarding discovery of several unknown sewer manholes on McCutcheon Road between Mountain Ridge Drive and Stine Road; and WHEREAS, it was determined that this was an old abandoned concrete sewer trunk line that had been replaced in 1991 by the Stine Road - McCutcheon Road Interceptor Sewer; and WHEREAS, upon further investigation and inspection with closed circuit television, it was discovered that part of the sewer line had collapsed and other sections were decayed. This empty abandoned sewer line runs under the number one westbound lane of McCutcheon Road currently being constructed; and WHEREAS, the Public Works Director declared this problem extremely serious and the work to be performed was of urgent necessity for the preservation of life, health or property; and WHEREAS, it was determined the best course of action for a repair required the abandoned pipe be permanently stabilized by filling it with a cement-sand slurry in a safe and timely manner; and WHEREAS, to remedy this condition the Public Works Director authorized Teichert Construction Company, on a time and materials not-to-exceed $105,830.00, to perform the required work. The Public Works Director also authorized other expenses required for this emergency, for a total not to exceed $110,000.00. ----------000---------- NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The above recitals are true and correct and incorporated herein by reference. 2. City Council hereby determines that based on the above recitals, the work performed was of urgent necessity for the preservation of life, health or property, thereby allowing the dispensing of bidding requirements as set forth in Section 136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code. 3.
