HomeMy WebLinkAboutORD NO 2247ORDINANCE NO. 2247 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD KNOWN AS A PORTION OF THE STINE CANAL THAT LIES ADJACENT TO STINE ROAD, NORTH OF MING AVENUE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion of the Planning Con~nission to change the land use zoning of that certain property in the City of Bakersfield known as a portion of the Stine Canal that lies adjacent to Stine Road, north of Ming Avenue; and WHEREAS, the City Council has determined after due con- sideration of said motion and the recormnendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which properties are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries from an R-1 (One Family Dwelling) Zone to a C-1-D (Limited Commercial-Architectural Design) Zone; and from an R-1 (One Family Dwelling) Zone to a C-2-D (Commercial-Architectural Design) Zone of that certain property known as a portion of the Stine Canal that lies adjacent to Stine Road north of Ming Avenue, being more particularly described as follows: Parcel 1: From an.R71 (One Family Dwelling) Zone to a C-1-D (Limited Commercial-Architectural Design) Zone: Beginning at the SE corner of P~rcel 11 of Parcel Map #88, filed August 11, 1971 in Book 1 of Parcel Maps on Page 185, City of Bakersfield, County of Kern, State of California, said corner being located on the Westerly line of said canal; Thence along said Westerly line of canal N. 07'22"E., a distance of 186.26'; Thence S. 89°46'26"E., a distance of 93.13' the Easterly line of said canal; Thence along said easterly line of canal S. 07'22'~. a distance of 186.26'; Thence N. the Point 15° to 15© 89°46'26'~. a ~±sta~ce of 93.13' to o~ 3egi~§. Parcel II: From an R-1 (One Family Dwelling) Zone to a C-2-D (Con~nercial-Architectural Design) Zone: Beginning ~t the NE corner of P~rcel 12 of Parcel Map #88, flied August 11, 1971 in Book 1 of Parcel Maps on Page 185, City of Bakersfield, County of Kern, State of California, said corner being located on the Westerly line of said canal; Thence S 89°46'26"E. a distance of 93.13' to the Easterly line of said canal; Thence along said Easterly line of canal S. 15© 07'22"W., a distance of 611.362'; Thence continuing along said Easte{ly line of canal S.25~32'32f~. to the South line of said Section 2; Thence along said South line of Section 2 N. 89°23'38'~., a distance of 99.25' to the Westerly line of said canal; Thence Northerly along sa~d Westerly line of canal N. 25°32'32"E., a dzstance of 293.17'; Thence continuing along said Westerly line of canal N. 15°07'22"E., a distance of 579.215' to the Point of Beginning EXCEPTING THEREFROM the R/W within Ming Avenue. .... o0o ..........
