NOTICE OF RIGHT TO APPEAl Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, cio Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $330 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside the notice area. All appeals filed on land divisions will require a $330 non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. The items are recommended for approval by staff. Consisting of 504 lots for single family residential and 1 park lot on 120 acres for property zoned R-1. PUBLIC HEARING - TENTATIVE TRACT VESTING TENTATIVE TRACT 5881 (Martin-Mclntosh) Located on the southeast corner of Stockdale Highway and South Allen Road. Consisting of 209 lots for single family residential and 1 lot for open sPace on 87.88 acres zoned R-1 and OS and a waiver of mineral rights owners' signature in accordance with Bakersfield Municipal Code Section 16.20.060 B.1. (Negative Declaration on file) STAFF RECOMMENDATION: Approve with conditions Group vote PUBLIC HEARING - RELEASE OF COVENANT OF COMMON ACCESS (Rickett, Delmarter and Deifel) Release and removal of a common access easement for property located at the southwest corner of Rio Mirada Drive and Arrow Street. P97-0406 -- CITY OF BAKERSFIELD has proposed an amendment to the Land Use Element of the Bakersfield Metropolitan 2010 General Plan by changing the land use designation from HR to LR on 20 +/- acres for property located on the south side of Fairview Road, about 700 feet west of South Union Avenue. Commissioner Ortiz asked if this was Buccaneer Bay and Staff replied it was to the west at the intersection of River Ranch Drive and Brimhall Road. 6. PUBLIC HEARING - EXTENSION OF TIME - TENTATIVE TRACT 573~ Staff report recommending approval was given. Commissioner Dhanens asked Staff if the applicant was in agreement with this. Staff replied they were. The public hearing portion of this item Will be heard Thursday evening. 7. PUBLIC HEARING - TENTATIVE TRACT 5881 Staff report recommending approval was given. Commissioner Kemper asked Staff what Section E is going to be and how far the nearest community park is from there. Staff stated Phase E is subdividable to fit with this project. The closest community park would be Silver Creek or Deer Peak in Seven Oaks. Commissioner Kemper stated she,was concerned there was not a park in an 80-acre parcel. Commissioner Boyle asked Staff if a gate could be put on the 60 foot wall for access. Staff replied no. Commissioner Boyle asked if there would be a walking trail on this 40 foot wide easement. Staff replied no. Commissioner Boyle asked if the City or Kern River Parkway were going to develop any trail. Staff replied the City has no intent; the Kern River Parkway has expressed no interest. Commissioner Dhanens asked Staff if one egress point to Stockdale Highway was adequate for the number of lots. Staff stated it was. Commissioner Dhanens asked if the bike trail along Stockdale Highway was intended to connect with anything in the future., Staff replied there is no plan to connect this trail to any other trail. Vice-Chairman'Tkac asked Staff where the 40 foot easement begins. Staff replied it starts at the toe of the Cross Valley Canal and runs 40 feet north of it. COmmissioner Boyle requested that this item be put at the end of the agenda on Thursday. Staff agreed.
