NOTICE OF RIGHT TO APPEAL Planning Commission decisions on Zone Changes, Parcel Maps and Tentative Subdivision maps are subject to appeal by any person aggrieved. No permit shall be issued for any use involved in an application until after the final acceptance date of appeal. Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City Council, c/o Office of the City Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $334 non-refundable filing fee must be included with filing of the initial appeal for those appeals filed by the applicant or any person outside' the notice area. All appeals filed on land divisions will require a $334 non-refundable filing' fee. If all appeals are withdrawn prior to the City Council hearing, it will not be conducted and the decision of the Planning Commission will stand. If no appeal is received within the specified time period or if all appeals filed are withdrawn, the action of the Planning Commission shall become final. (City-wide) (Ward 3) CAPITAL IMPROVEMENTS PROGRAM BUDGET FY 2000-2005 DETERMINATION BY THE PLANNING COMMISSION OF CONSISTENCY WITH THE GENERAL AND SPECIFIC PLANS. (City of Bakersfield - Public Works Department), RECOMMENDATION: Find consistent with General and Specific Plans GROUP VOTE: PUBLIC HEARINGS - VESTING TENTATIVE TRACT MAPS 6.1) Vesting Tentative Tract Map 5989 (Porter-Robertson) Containing 24 lots 0n 4.7 net acres for single family residential purposes, zoned R-1 (One Family Dwelling). Located on the south side of Cesar Chavez School, at the northeast corner of Chase Avenue and Mesa Marin Drive. (Negative Declaration on file) RECOMMENDATION: APPROVE Group Vote. 6.2) Vesting Tentative Tract Map 5991 (Porter-Robertson) Containing 86 lots on 46.82 acres for single family residential purposes, zoned R-1 (One Family Dwelling) and a modification to exceed the maximum block length. Located 1/4 mile south of Olive Drive on the north side of Hageman Road (extended) approximately 2/3 of a mile west of Highway 99. Located on the southeast corner of Ardmore Avenue and Wheelan Court. (Negative Declaration on file) RECOMMENDATION: APPROVE Group Vote. . PUBLIC HEARINGs -ZONE CHANGES 7.1) Zone'Change P00-0285 (Timeless Architecture) Change in land use zoning from an R-2 (Limited MultiPle Family Dwelling) zone to an R-1 CH (One Family Dwelling-Church) zone on approximately one acre to allow development of church related uses to an existing church located on property adjacent to the south. Located at the southwest corner of El Rio Drive and Quailwood Drive, north of Stockdale Highway. (Negative Declaration on file) RECOMMENDATION: APPROVE Group Vote. 7.2) Revised PCD Zone Change P99-091'1 (Cornerstone Engineering) Change in land use zoning from a PCD (Planned Commercial Development) zone to a Revised PCD (Planned Commercial DevelOpment) zone on 10.1 acres for the Bakersfield Heart Hospital to allow a helicopter landing pad (helistop); revised footprint of the two- story, 40,000 square foot hospital wing; and a three-story, 38,416 square foot medical office building. Located at 3001 Sillect Avenue (south side of Sillect Avenue, east of Buck Owens Blvd.). (Negative Declaration on file) RECOMMENDATION: APPROVE Group Vote. (Exempt from CEQA) RECOMMENDATION: APPROVE Roll Call Vote.. These items will be voted on the Consent Calendar on Thursday, June 1, 2000. 5. CAPITAL IMPROVEMENTS PROGRAM BUDGET FY 2000-2005 DETERMINATION BY THE PLANNING COMMISSION OF CONSISTENCY WITH THE GENERAL AND SPECIFIC PLANS. (City of Bakersfield - Public Works Department) (City-wide) Presentation will be made on Thursday, June 1, 2000, by Ted Wright, Engineer with the pUblic Works Department. PUBLIC HEARINGS - VESTING TENTATIVE TRACT MAPS 6.1) Vesting Tentative Tract Map 5989 (Porter-Robertson) (Ward 3) Commissioner Sprague declared a conflict of interest on this project. Staff report recommending approval was given. There were no Commissioner comments or questions. Item was continued until Thursday, June 1, 2000. 6.2) Vestin_~ Tentative Tract Map 5991 (Porter-Robertson) (ward 4) Staff report recommending approval was given. Commissioner Sprague asked staff to ask the applicant if the underground gas lines running through or adjacent to the property are Iow or high pressure? Commissioner Sprague also asked staff to explain Mohawk's present situation on the Circulation Element and what the deletion would do if the deletion is approved on June 15. Mr. Grady said Mohawk would be deleted as an arterial to Hageman and in the future Mohawk would not be an arterial. Some other local street that would carry traffic may be an arterial but Mohawk would not be. Commissioner Sprague said that he thought in the 2010 General Plan that Mohawk was going to be an arterial from the proposed Kern River Freeway going north off of Rosedale Highway and extending on up to Olive. Mr. Grady said that that is not correct south of Rosedale Highway. The Commission would soon have a project in front of them in connection with an annexation that is requesting a deletion of it as a collector. Minutes, PC, Monday, May 30, 2000 Page 3 6.3) Commissioner Sprague asked if there are provisions in the M-1 zone that runs adjacent to Mohawk Street as set forth in Exhibit 2 for a'buffer zone with 'greenbelt or landscaping in sufficient size to buffer the M-l, M-2 & M-3 to the east of the residential development?' Mr. Grady said there is no requirement to separate that use from residential development other that a 6-foot block wall. To require something different would require the ordinance to be amended. Commissioner Dhanens asked Mr. Grady if staff had seen a draft of the subdivision layout (lot 86) that would extend the residential lots to Mohawk Street if the alignment should be preserved in the upcoming action? Mr. Grady said that he has not seen a design that fills in that space. Mr. Grady said that staff has seen a subdivision that would take the cul-de-sacs through so that they would end with lots at the end of a cul-de-sac that would back up to Mohawk should Mohawk stay in place. Mr. Grady also said there has not been a design that would show what the property would look like if Mohawk disappears. Commissioner Dhanens asked if staff could have a copy of the design available to.the Commission on Thursday? Mr. Grady said staff could provide that. Commissioner Dhanens then asked Ms. Shaw if the sump shown was an existing one for an adjacent tract or a proposed sump for the new subdivision? It is adjacent to Hageman Road at the intersection of Hageman and Charbonne. Ms. Shaw said she thinks it is a proposed sump. Commissioner Dhanens asked if the block length takes into account lots 34 and 35 of Tract Map 5938? Mr. Grady said the block lengths are from intersection to intersection. Commissioner Sprague asked if staff could bring an aerial of the project Thursday night so that the Commission may get an exact location of the project. Item was continued until Thursday, June 1, 2000. Vesting Tentative Tract Map 5996-(Mclntosh and Associates) (Ward 5) Staff report recommending approval was given. Commissioner McGinnis asked staff if they had an opportunity to review the specific plans in regards to the units as far as their size goes? Mr. Grady responded by saying they have not reviewed the specific site plans. Commissioner McGinnis said that in page 2 of the analysis section Patriots Park was mentioned as being within % mile of the project site and he feels this is not an adequate Park site for the project. Joe Gonzales from the Parks Department said that Castle Park Would be the nearest park south' of Ming about one mile from the site. Minutes, PC, Monday, May 30, 2000 Page 4 Commissioner Sprague'said they could also pay in-lieu park fees for not having an adequate park in the area. COmmissioner Sprague asked the Fire Department if there is sufficient radius for a big fire truck to get through the 20-foot alley? Jim Shapazian, Fire Marshal, said that it bears looking at and would have an answer by Thursday. Item was continued until Thursday, June 1, 2000. PUBLIC HEARINGS -ZONE CHANGES 7.1) Zone Change P00-028~ (Timeless Architecture) (Ward 5) staff report recommending approval was given. Commissioner Sprague asked how the property would be accessed? Mr. Grady said that we don't have a proposal yet but the property woUld have the ability to get access from Quailwood or North El Rio. The determination of which one would be granted would be at the time of site plan review. Item was continUed until Thursday, June 1, 2000. 7.2) Revised PCD Zone Chanqe P99-091'1 (Cornerstone Engineering) (Ward 5 Commissioner Dhanens stated that the applicant is requesting a continuance until the June 15, 2000, Planning Commission meeting. Continuance will be voted on Thursday, June 1, 2000. PUBLIC HEARING - AMENDMENT TO ORDINANCE Amendment to the text of Title 16 (Subdivisions Ordinance) of the Bakersfield Municipal Code (City of Bakersfield) (All Wards) Staff report recommending approval was given. There were no Commissioner comments or questions. Item was continued until Thursday, May 4, 2000. Commissioner Sprague asked if the easement was totally on lot 6? Ms. "yes." There were no other Commissioner comments or questions. Item will be voted on the Consent Agenda on Thursday, June 1, 2000. Ms. Shaw told the Commissioners that the notebooks for the CIP were available now and the Commission could look them over before Thursday. 12. DISCUSSION AND ACTION REGARDING POSSIBLE CANCELLATION OF THF NEXT PRE-MEETING. This will be decided on Thursday, June 1, 2000. 13. ADJOURNMENT.
