NOTICE OF RIGHT TO APPEAL '

are §ubject toappeal by any i~nterested person adversely affected by the decision of the
CommisSion. NO permit shal! be issued for any use involved in an application until after the final
aCceptance date of appeal.
The appeal shall include the appellant's interest in or relationship tO the subject prOperty, the
decision or actionappealed and shall state specific facts and reasons why the appellant believes
the decision or action of the Commission should not be upheld.
Such appeal must be filed in writing within 10 days from date of hearing, addressed to the City
Council, cio Office of the Cityl Clerk, 1501 Truxtun Avenue, Bakersfield, CA 93301. A $334 non-
refundable filing fee must be .included with filing of the initial appeal for those appeals filed by the
applicant or any person outside the notice area. All appeals filed on land divisions will require a
$334. non-refundable filing fee. If all appeals are withdrawn prior to the City Council hearing, it
will not be conducted and the~ decision of the Planning Commission will stand.
If no appeal is received within the specified time period or if all appeals filed are withdrawn the

If no appeal is received within the specified time period or if all appea!s filed are withdrawn, the
action of the Planning Commission shall become final.

Bakersfield Airpark with related industrial uses; located south of Watts Drive, north of
East White Lane between Madison Street and SOuth Union Avenue. Also included is a
small rectangular, area at the northwest corner of Watts Drive and Madison Street.

Works DePartment dated ,January 2, 2001.
Commissioner Brady asked Ms. Shaw to go through the effect.of her memo.
Ms. Shaw stated that the original intent when the conditions were written were
to-defer constructio~ of Allen Road and Ming Avenue until a later date and the
City would do it as @art of their project, however, when discussing this project'
with the developers,' the developers said they are willing and proposing to do it
themselves. Public!Works wrote the conditions so the developers will do that
and the Public Works Department is giving them more time than they normally'
' w0i. ild to get it constructed and are allowing them the option to construct those
improvementS.
commissioner Brady asked if putting Ming Avenue across the canal was the
problem?' Ms. Shaw said that neither of these tracts has actual access to Allen
.. Road or Ming Avenae. The canal crossing is being constructed through an
agreement that'Castle & Cooke and Coleman Homes has. That will be do'ne
separately. This condition strictly talks about the road improvements.
Commissioner Brady asked if the canal is being crossed now? How does this
effect it? Ms. Shaw; said her understanding on the timing for the canal crossing
is pretty much on the same schedule as what they are proposing for both Allen
and Ming. ~

Commissioner Sprague asked if this ordinance is specific for Bakersfield Airpark uses
or would it apply to other M:.'-I zones with other air strips or air parks in the County? Mr.
Grady said that it is speCifically for the Bakersfield Airpark..

adjacent, grade on the reSidential lots adjacent to the arterial and collectors? Mr.
Movius said "yes."
Commissioner Dhanens asked if it matches what is there already? Mr. Grady said
"yes'." ' ·

PUBLIC 'HEARING- coMPREHENSIVE SIGN PLAN (Northwest Target LLC) (Ward4)
Staff report given recommending approval of the plan.
Commissioner Dhanens asked if it would be possible to provide the Commission-With 8_
1/2 x 1'1 photo copies'of the slides that were shown? Mr. Grady said "yes."
Commissioner.Dhanens asked, if the existing signs are indicated on the 11 x 17 map
entitled "Master Plan" and Where the new signs are. proposed to be? Mr. Grady said
thereare.twO phases and the sign program they are talking about is for Phase 2 west
of Main Plaza Drive.- Commissioner Dhanens asked if the monument signs were shown
on the map? Mr. Eggert ·said they are very small but they can enhance them for
ThurSday's meeting. Commissioner Dhanens asked if the blUe line the applicant had
would be available for ThurSday as well? Mr. Eggert said "yes."
