Group Vote 3.2 Public Hearing Items: 5.2 Approval of Tentative Parcel Map 10617 (Mclntosh & Associates) located on the south side of Ming Avenue (extended), and east of South Allen Road (extended) containing five parcels on 321.44 acres for purposes of creating large lots for future residential and commercial subdivisions, zoned R-1 (One Family Dwelling), R-2 (Limited Multiple Family Dwelling) and C-2 (Commercial) zones and a request to waive certain improvements. Motion made by Commissioner Sprague, seconded by Commissioner Gay, to approve the Consent Agenda Item. Motion carried. . 3.2 Public Hearing Items: Commissioner Tragish stated he had a conflict of interest on Consent Agenda Item 5.2. Commissioner Brady requested that item 5.3 be removed from the Consent Agenda. See ConsentAgenda PUBLIC HEARINGS - Tentative Tract Maps 5.1) Revised Vesting Tentative Tract Map 6043 (Mclntosh & Associates) located between Ming Avenue (extended) and the Kern River Canal, west of Buena Vista Road. (Negative Declaration on file) (Ward 4) Staff report given recommending approval with conditions attached to the resolution and including the memorandum from the Public Works Department. Public portion of the hearing was opened. No one spoke in opposition. Roger Mclntosh,. representing the applicant, said they agree with the conditions and the memorandum from the Public Works Department. PUblic 'portion of the meeting was closed. Commissioner Sprague asked if 18 parking spaces is sufficient for the area. Mr. Movius stated that staff has reviewed the Conditional Use Permit for the Board of Zoning Adjustment and feels that 18 spaces in this particular case is adequate. Commissioner Sprague asked if there are sidewalks on both sides of the street? Ms. Shaw said there would be sidewalks on both sides of the street. Commissioner Sprague asked about access points on Ming. Mr. Walker stated that they- generally have a goal of 200 residents before they require a second access point. They also allow a 5 percent variation for traffic studies and analyses similar to this. Since this - ' was just a change in configuration and there are access points for emergency vehicles, they don't have a big concern about it. Since this is a private street with gated access and plenty of emergency access, traffic concerns are lessened. - Commissioner Sprague asked how a homeowner will know if they have an oil line adjacent to their house or through their backyard? Mr. Mclntosh said there is a condition (Fire Department Condition No. 15.4) that requires a covenant to be recorded over all the lots within 250 feet of the pipelines. CommisSioner Gay said he does not support item 28 and would like to hear from other Commissioners. There was some discussion among the Commissioners, staff and Mr. MClntosh regarding how potential buyers were to find out about the underground pipelines and how they would affect their properties. Ms. Gennaro said the covenant was the best way to go and there is no way to expand the condition. Commissioner Sprague made a motion, seconded by Commissioner Tkac, to approve Vesting Tentative Tract Map 6043 with findings and conditions set forth in the attached resolution Exhibit A and incorporate into it the Fire Department memo of May 3, 2001, and the November 1, 2001, memorandum from Marian Shaw. No one spoke in oppqsition to staff's recommendation. Don Judkins, the developer of the project, stated that he, is present to answer any questions or concerns the Commission may have. They are in agreement with the revised conditions. Public portion of the hearing was closed. Commissioner Brady asked staff if there is a present project underway to connect Old River Road over the railroad tracks? Ms. Shaw saw yes and it would be cOmpleted in two years. There are four' grade crossings that will be done simultaneously. Mountain Vista is also one of them. Commissioner Brady expressed his concern about this project being completed before the grade crossings and the project having to use Pacheco Road for access. He asked if there is a condition of,approval requiring anything to be done to Pacheco to improve and allow access to this area? Ms. Shaw said "no." Commissioner Brady asked how emergency access would be gained during this time? Ralph Huey stated that Station 9 would be the "first in" engine company. Commissioner Brady asked Mr. Huey if he is ok with access on Pacheco during the next few years? Mr. Huey said they are not totally pleased with the overall layout but are satisfied that they can supply emergency services. Commissioner Brady asked if any of the access points onto Old River from this subdivision will be signalized? Ms. Shaw said that there is no requirement at this time to make them signalized but one of them will be a full access intersection that could be signalized in the future. It is far enough away from the next arterial that there would not be a timing problem. Ms. Shaw said the developer could use York or Lancaster as a full access intersection. If"line of sight" was a problem, they could make Bath the full access interseCtion and Lancaster the limited one. Either one of the locations is:sufficiently far enough away from Panama Lane to allow a signalized intersection. Don Judkins showed the Commission traffic flow inside the subdivision. If they had known of the Kern Delta Canal going in, the map would have been designed somewhat differentlyl They would have submitted the "not a part" at the same time. They needed time to adjust the lot sizes as well as the absorption rates for apartments. Kern Delta is going to take 25 percent of the R-2. Mr. Judkins said that they are not going to do a serious subdivision here until they know that the City is ready to do the grade crossings. Pacheco will remain their main access for a number of years. The phasing starts in the south so that Pacheco can remain undisturbed for some time. Commissioner Brady said Pacheco is a hazardous road and he has concerns about a new subdivision adding additional traffic on it. Commissioner Sprague asked about the easements and wanted to know if there is anything flammable along the corridor? Don Judkins said that there are no known underground facilities that they are aware of in those easements. All utilities are above ground to the best of their knowledge. Commissioner Sprague expressed his concern about the railroad parking their locomotives on the tracks and the pollution and noise that might cause the neighborhood. Minutes, PC, November 1, 2001 Page 4 Mr. Judkins said that this is a spur where they move cars out in the morning and bring cars back in the afternoon. He has never seen an engine parked along there. It is very slow speed. The buffer has increased with the additional of the canal. Commissioner Sprague asked staff if any hazardous materials traveled along the line. Mr. Huey said "yes" there are some hazardous materials on just about all the railroad lines going through Bakersfield. Mr. Huey stated that with the added canal, buffering should be adequate and empty cars are normally parked along the spur, not full ones. Commissioner Gay asked if another development contiguOus to or separated from this pr~)ject could elect to abandon Pacheco which would cut this development off from the use of'Pacheco? Ms. Shaw said that Parcel Map 10465 is required to abandon Pacheco with a particular phase of the parcel map that is up against it. However, there is still access at Buena Vista along Pacheco to the west. Commissioner Brady made a motion, seconded by Commissioner Tragish, to approve and adopt the NegatiVe Declaration and approve Vesting Tentative Tract Map 6079 with findings and conditions set forth in the attached resolution Exhibit A and attached October 31, 2001, memo from Marian Shaw to the Planning Commission and the conditions set ' forth therein. Motion passed by the following roll call vote: AYES: Commissioners Brady, Gay, McGinnis, Sprague, Tkac, Tragish, Boyle NOES: None' ABSENT: NOne COMMUNICATIONS Mr. Movius stated that the Commission received a pamphlet courtesy of the City:Manager's Office entitled Bakersfield 2000 - 2001 One Year in Review. It is an overview of city departments and services that they might be interested in looking at later. · COMMISSION COMMENTS Commissioner Boyle asked MS. Gennaro if she could research other cities and counties to see if they require monument markers on individual lots for the purpose of designating oil lines? And, asked if the city has ever looked at requiring an ordinance to require the use of underground tapes for all underground pipelines? And, if not, what would be the procedure for considering such an ordinance? Commissioner Brady stated that the Oil Ordinance Committee has met again and they are looking at some proposed changes and streamlining of the ordinances. They will meet again the fourth Tuesday in November at which time they will be considering those proposed changes and voting on them to make a recommendation to the Commission. Commissioner Sprague said that the Department of Oil and Gas and the industry has been really good to work with in the committee meetings. He also said that regarding the May 3 letter from the Fire Department, they ought to discuss the item on oil lines 'in regarding public utilities code and Bakersfield Municipal Code to possible inclusion of some type or at least discuss the issue when they put the new ordinance back together. Because of Veteran's Day and the size of the next agenda, it was decided there would not be a pre-meeting 9.
