HomeMy WebLinkAboutORD NO 2242ORDINANCE NO. 2242 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE 1AND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED SOUTH OF MING AVENUE, WEST OF NEW STINE ROAD, NORTH OF PLANZ ROAD AND EAST OF ASHE ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield located south of Ming Avenue, west of New Stine Road, north of Planz Road and east of Ashe Road; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Amending the zoning boundaries from an R-1 (One Family Dwelling) Zone to an R-2-D (Limited Multiple Family Dwelling - Architectural Design) Zone; from an R-2-D (Limited Multiple Family Dwelling) Zone, to an R-1 (One Family Dwelling) Zone; from an R-2-D (Limited Multiple Family Dwelling - Architectural Design) Zone to an R-3-D (Limited Multiple Family Dwelling Architectural Design) Zone; from an R-3-D (Limited Multiple Family Dwelling - Architectural Parcel I: Design) Zone to an R-l.(One Family Dwelling) Zone; and from an R-3-D (Limzted Multzple Family Dwelling - Architectural Design) Zone to an R-2-D (Limited Multiple Family Dwelling - Architectural Design) Zone of those certain properties in the City of Bakersfield lying within Section 10, Township 30 South, Range 27 East, M.D.M., in the City of Bakersfield located south of Ming Avenue, west of New Stine Road, North of Planz Road and East of Ashe Road, being more particularly described as follows: From an R-1 (One Family Dwelling) Zone to an R-2-~ (Limited Multiple Family Dwelling - Architectural Design) Zone: All that portion of the southwest quarter of Section 10, Township 30 South, Range 27 East, M.D.M., being more particularly described as follows: Cormnencing at the southwest corner of said Section 10; thence North 00°03'18" West, on and along the West line of said Section, 990.39 feet to the True Point of Beginning; thence continuing North 00°03' 18" West, on and along said West section line, 620.00 feet; thence North 89o56'42" East, 130.00 feet to the beginning of a tangent curve, concave to the southwest, having a radius of 1160.00 feet; thence southeasterly, on and along said curve, through a central angle of 6°11'10", an arc distance of 125.24 feet; thence South 00°03'18" East, 627.91 feet to a point on a nontangent curve, concave to the southwest, having a radius of 540.00 feet; from which the radial point of said curve bears South 13o19'45" West; thence northwesterly, on and along said curve, through a central angle of 13o23'03", an arc distance of 126.14 feet; thence South 89o56'42" West, 130.00 feet, more or less, to the West line of Section 10 aforedescribed, and the True Point of Beginning.
