HomeMy WebLinkAboutORD NO 2238ORDINANCE NO. 2238 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE SOUTHEAST CORNER OF CALIFORNIA AVENUE AND THE NORTHWESTERLY EXTENSION OF MARELLA WAY. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield located on the southeast corner of California Avenue and the northwesterly extension of Marella Way; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized; and WHEREAS, the City Council has determined and found that this zoning ordinance is consistent with the General Plan of the City of Bakersfield. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries from an A (Agri- cultural) Zone and an R-1 (One Family Dwelling) Zone to an R-1-CH (One Family Dwelling - Church) Zone of that certain property in the City of Bakersfield located on the southeast corner of California Avenue and the northwesterly extension of Marella Way, being more particularly described as follows: That portion of the northeast quarter of Section Thirty-four and of the northwest quarter of Section Thirty-five, all in Township Twenty-nine South, Range Twenty-seven East, M.D.M., Kern County, California, described as follows: Beginning at the intersection of the south line of California Avenue with the northwest co~er of Tract 3203, as per map thereof recorded December 5, 1968 in the Office of the County Recorder of said Kern County in Book 17 of Maps at pages 28 and 29; thence along the south line of said California Avenue, south 56035'35" west, 666.492 feet to the beginning of a tangent curve, concave southeasterly, of radius of 2,745 feet; thence southwesterly, along said curve, through a central angle of 01 30'15", an arc distance of 72.06 feet to a point; thence south 34054'40" east, 571.90 feet to the beginning of a tangent curve concave northeasterly, of radius of 600.00 feet; thence southeasterly, along said curve, through a central angle of 37°05'19"~ aT a~c distan~eo?f 388.39 feet; thence south 71 59 59 east, 4~.~8 feet to a point on the west line of said Tract No. 3203 and the northwesterly terminus of Marella Way shown thereon; thence along the said west line the following courses and dis- tances: 1) North 18°00'01" east 30.00 feet; thence 2) North 23°12'08" east 3) North 28°28'24" east 4) North 33o24'25" west 5) North 56o35'35" east 6) North 33o24'25" west 7) North 56035'35" east 8) North 33024'25" west point of beginning. 165.109 feet; thence 21.720 feet; thence 202.68 feet; thence 363.246 feet; thence 170.000 feet; thence 20.000 feet; thence 475.00 feet to the EXCEPTING THEREFROM the following described parcel: Beginning at the intersection of the south line of California Avenue with the northwest corner of said Tract No. 3203; thence along the south line of said California Avenue, south 56035'35" west, 170o000 feet; thence south 33o24'25" east, 360.000 feet; thence north 56o35'35" east 170.000 feet; thence north 33024'25" west 360.00 feet to the point of beginning. ..........
