A RESOLUTION OF THE COUNCIL ORDERING THE VACATION OF
THE 20 FOOT WIDE SEWER LINE EASEMENT ON THE EAST SIDE OF STINE
ROAD AND SOUTH OF WHITE LANE
WHEREAS, on WEDNESDAY, November 28, 2007, the Council of the City of
Bakersfield, pursuant to the provisions of the "Public Streets, Highways and the Service
Easements Vacation Law," Government Code Sections 8300 et seq, of the Streets and
Highways Code of the State of California, passed and adopted Resolution of Intention
No. 1573 declaring its intention to order the vacation of the 20 foot wide sewer line
easement on the east side of Stine Road and south of White Lane; and
WHEREAS, the Council did fix a time and place for hearing all persons
interested in or objecting to said proposed vacation, which hearing was held on
December 12, 2007, after notices of said hearing were duly published and posted as
required by law; and
WHEREAS, for the above-described project, it was determined that the proposed
vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines
(General Rule) in that there is no possibility that the proposed action could have a
significant effect on the environment; and
WHEREAS, in accordance with Bakersfield Municipal Code Section
2.28,120, the proposed vacation was found to be consistent with the Metropolitan
Bakersfield 2010 General Plan pursuant to Government Code 65402 by the Planning
Director on October 10,2007,
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1, The above recitals are true and correct and are incorporated herein.
2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and
Highways Code of the State of California,
3, The Council orders the vacation of the 20 foot wide sewer line easement on the
east side of Stine Road and south of White Lane, in the City of Bakersfield, County of
Kern, State of California, more particularly described on Exhibits "A" and "B" attached
hereto and made a part hereof.
4. The City Clerk shall certify to the passage of this resolution and shall cause a
certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in
the Office of the County Recorder of the County of Kern, California,

That Sewer Line Easement filed for record on August 21, 1984, in Book 5687, at Page
1024, in the Office of Kern County Recorder, located at the Northwest Quarter of the
Southwest Quarter of Sections 14, Township 30 South, Range 27 East, Mount Diablo
Base and Meridian, in the City of Bakersfield, County of Kern, State of California, more
particularly described as follows:
Commencing at the West Quarter comer of said Section 14; thence South 00000'56"
West, along the West section line of said Section 14, and center line of Stine Road, a
distance of 546.93 feet; thence South 89059'04" East, a distance of 55.00 feet, to the East
right of way line of Stine Road, and the TRUE POINT OF BEGINNING;
Thence (1) Continuing South 89059'04" East, a distance of 20.00 feet;
Thence (2) South 00000'56" West, a distance of 138.44 feet to the South line of Lot 5
of Parcel Map No. 7396 recorded on July 30, 1984, in Book 31 of Maps,
at Page 32, in the Office of Kern County Recorder;
Thence (3) North 89038'51" West, along the said South line of Lot 5, a distance of
20.00 feet to the East right of way line of Stine Road;
Thence (4) North 00000'56" East, along said East right of way line of Stine Road, a
distance of 138.32 feet to the TRUE POINT OF BEGINNING.
