A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD EXTENDING PACIFIC GAS AND
ELECTRIC COMPANY'S FRANCHISES FOR GAS AND
ELECTRICITY
WHEREAS, on January 20, 1958, the City Council, by adoption of Ordinance
Nos. 1166 and 1167 granted to Pacific Gas and Electric Company ("PG&E") franchises
to use, transmit, and distribute gas and electricity within the City of Bakersfield; and
WHEREAS, the term of each franchise was for a period of time not to exceed 50
years; and
and
WHEREAS, said franchises are due to expire on or about February 19, 2008;
WHEREAS, PG&E has requested in writing that the City Council extend the
terms of the existing franchises for a period of 90 days in order to allow the City and
PG&E to finalize and submit to this Council new franchise ordinances.
NOW, THEREFORE, RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and are incorporated herein by
reference.
2. The current PG&E franchise ordinances for gas and electricity (Ordinance
Nos. 1166 and 1167) are hereby extended 90 days to May 19, 2008.

Re: Requested Extension of PG&E's Gas and Electric Franchises
(Ordinance Nos. 1166 NS and 1167 NS)
Dear Mr. Tandy:
By letter dated November 28,2007 Pacific Gas and Electric Company submitted
applications for the renewal of its existing gas and electric franchise agreements with the City of
Bakersfield. The existing franchise agreements were granted for fifty-year terms that are due to
expire on February 19, 2008. Although PG&E has had some initial discussion with City staff
concerning our application, we believe that a short extension of the existing franchises would be
advisable to allow the parties sutlicient time to finalize the proposed form of the ordinances and
to bring the matter before the City Council for formal adoption. Accordingly, I request that the
City grant PG&E a ninety (90) day extension of the existing franchises, with the understanding
that all of the terms and conditions of the franchises will continue during this extension period.
If this proposal is acceptable, I request an appropriate resolution be presented to the City Council
for its consideration. Please contact me should you require any additional information relating
to this request.
