HomeMy WebLinkAboutORD NO 2218ORDINANCE NO. 2218 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTIONS 17.31.020 AND 17,32.020, ADDING SECTIONS 17.31.026, 17.32.026, AND REPEALING SECTIONS 17.64,030 AND 17.64.040 OF TITLE 17 OF THE MUNICIPAL CODE, CONCERNING ZONING REGULATIONS. BE IT ORDAINED by the Council of the City of Bakers- field as follows: SECTION 1. That Section 17.31.020 of Chapter 17.31 of Title 17 of of the City of Bakersfield is hereby amended Permitted. A. Any use permitted in the C-0, C-1 and C-2 Zones; provided, however, that no building shall be used as a dwelling except accessory buildings which are incidental to the permitted use of the land, and that no building shall have a dwelling unit except when such use as a dwelling unit is incidental to the primary use of the building. B. Any of the following uses: 1. A use which does not produce, cause or emit any fumes, odor, dust, smoke, gas, noise or vibra- tions which ar? or may be detrimental to proper- ties in the nezghborhood or to the welfare of the occupants thereof. 2. Animal hospitals, kennels and veterinaries. 3. Automobile and light truck, two-axle vehicles, parking and storage. 4. Automobile assembling, body and fender works, painting, upholstering, dismantling and used parts storage, when operated or maintained wholly within a building. 5. Automobile parts manufacturer. 6. Bakeries. 7. Battery manufacturer. 8. Boat building. 9. Bottling plant. 10. Building materials storage yards (subject to Section 17.52.180). the Municipal Code to read as follows: 17.31.020 Uses 11. Cabinet or carpenter shop. 12. Carpet, awning, blinds, mattress or upholstery shops, including cleaning and repair. 13. Concrete batch plants, portable, not to exceed two-yard capacity. 14. Contractor's plants and storage yards,~ (Subject to Section 17.52.180). 15. Creameries. 16. Distributing plants. 17. Electric welding and electroplating. 18. Frozen food lockers. 19. Furniture and automobile upholstering operations not confined wholly to a building. 20. Ice and cold storage plants. 21. Laboratories, experimental research and testing. 22. Laundries, cleaning and dyeing plants. 23. Lumber yards (subject to Section 17.52.180). 24. Machine shops (except punch presses of over twenty tons rated capacity, drop hammers and automatic screw machines). 25. Metal container manufacturer. 26. Paint mixing plants (not employing a boiling process). 27. Public utilities service yards, power plants or distributing stations. 28. Rubber fabrication or products made from finished rubber. 29. Sheet metal shops. 30. Stone monument works. 31. Storage spaces for transit and transportation equipment. 32. Tire rebuilding, recapping and retreading plants. 33. Tool rental and equipment. 34. Truck repairing and overhauling shops. 35. Welding, metal fabricating and blacksmith shops. 36. Wholesale businesses, storage buildings and ware- houses. 37. Manufacturer of: a. Arts and crafts. b. Batteries. c. Billboards and advertising structures, electric or neon signs. d. Ceramic products. e. Clothing or garments. f. Cosmetics, perfumes and toiletties, drugs and pharmaceuticals. g. Electronic instruments and devices, radios, televisiong phonographs and business machines. h. Food products (except the rendering or refining of fats or oils). i. Furniture. Musical instruments and toys. k. Prefabricated buildings. 1. Shoes. m. Soap (cold mix only). n. Textiles. Manufacture, compounding, assembling or treatment of articles or merchandise from the following previously prepared materials: bone, cellophane, canvas, cloth, cork, feathers, felt, fibre, fur, glass, hair, horn leather, paper, plastics, precious or semi-precious metals or stones, shell textiles, tobacco, wood, yarns and paint, not employing a boiling process. C. The accessory buildings or structures necessary to such use located on the same lot or parcel of land. SECTION 2. That Section 17.31.026 is hereby added to Chapter 17.31 of Title 17 of the Municipal Code of the City of Bakersfield to read as follows: 17.31.026 Uses permitted subject to Conditional Use Permit. T~ following uses may be permitted subject to a Conditional Use Permit in accordance with the procedures provided for in Chapters 17.60 and 17.64 of this title. 1. Agricultural packing plants (vegetables and fruits). 2. Aircraft and automobile factories (no foundaries). 3. Breweries and distilleries. 4. Clinics, hospitals, sanitariums or other buildings for contagious, mental, drug, or liquor addict cases. 5. Freighting or trucking yards or terminals. 6. Livestock slaughtering and processing wholly within a building. 7. Machine shops including punch presses and automatic screw machines. 8. Residential dwellings. 9. Planing mills. 10. Equestrian establishments, stables, riding academies, schools or amusements. SECTION 3. That Section 17.32.020 of Chapter 17.32 of Title 17 of the Municipal Code of the City of Bakersfield is hereby amended to read as follows: 17.32.020 Uses Permitted. A. Any use permitted in the M-1 Zone; provided, however, that no building shall be used as a dwelling except accessory buildings which are incidental to the permitted use of the land, and that no building shall have a dwelling unit except when such use as a dwelling unit is incidental to the primary use of the building. B. Any of the following uses: 1. Acetylene gas manufacture or storage. 2. Aircraft & automobile factories. 3. Agricultural packing plants (vegetables & fruits). 4. Alcohol and alcoholic beverages manufacture. 5. Ammonia, chlorine and bleaching powder manufacture. 6. Automobile and truck manufacture. 7. Bag cleaning. 8. Blast furnaces. 9. Boiler or tank works. 10. Breweries & distilleries. 11. Brick, tile or terra cotta products manufacture. 12. Building materials manufacture. 13. 14. 15. 16. 17. 18. 19. 20. 21. 22 23 24. 25 26 27 28 29. 30. 31. 32. 33. 34. 35. 36. 37 38 39 40 41 42 Carpet and rug manufacture. Cement and lime manufacturing when the manufacturing plant is equipped capable of collecting at least ninety-seven (97) percent of all particulate matter from kiln gases. Clay product manufacture. Coke ovens· Cotton gins or oil mills. Crematories. Creosote treatment or manufacture. Disinfectant manufacture. Distillation of coal, wood or tar. Dye-stuffs manufacture. Exterminator or insect poison manufacture. Feed, flour and grains mills. Firearms manufacture. Forge plants. Freighting & trucking yards & terminals. Freight classification yards. Glass and glass product manufacture. Grain elevator. Iron, steel, brass or copper foundties or fabrication plants, and heavy weight casting. Lamp black manufacture. Linoleum or oiled products manufacture. Machine shops including punch presses & automatic screw machines. Ore reduction. Paint, oil, shellac, turpentine or varnish manufacture. Paper or pulp manufacture. Petroleum refining and reclaiming plants. Planing mills. Plastic manufacture. Potash works. Railroad roundhouses and repair shops. 43. Rolling mills. 44. Rubber processing and manufacture. 45. Saw mills. 46. Soap manufacture. 47. Sodium Compounds Manufacture. 48. Starch manufacture. 49. Tar roofing or waterproofing or other tax products manufacture. C. The accessory buildings or structures necessary to such use located on the same lot or parcel of land. SECTION 4. That Section 17.32.026 is hereby added to Chapter 17.32 of Title 17 of the Municipal Code of the City of Bakersfield to read as follows: 17.32.026 Uses permitted subiect to Conditional Use Permit. The following uses may be permitted subject to a Conditional Use Permit in accordance with the procedures provided for in Chapters 17.60 and 17.64 of this title. 1. Acid manufacture. 2. Ammunition manufacture. 3. Cement, lime, gypsum or plaster of paris manufac- ture. 4. Chemical manufacture. 5. Curing, tanning and storage of raw hids or skins. 6. Dairies and livestock feeding yards. 7. Distillation of bones. 8. Drop forge industries manufacturing forgings with power hammers. 9. Dumps and refuse disposal areas. 10. Explosives, manufacture or storage. 11. Fat rendering. 12. Feed and fuel yards. 13. Fertilizer manufacture. 14. Garbage, offal or dead animal reduction or dumping. 15. Gas manufacture. 16. Gelatin or size manufacture. 17. Glucose or dextrine manufacture. 18. Glue manufacture. 19. Non-mineral oil extraction plants. 20. Oil extraction plants. 21. Petroleum refining. 22. Poultry and rabbit raising, slaughter. 23. Sewer farms or sewage disposal plants. 24. Smelting of tin, copper, zinc or iron ores. 25. Stockyards and animal slaughter. 26. Scrap metal yards, junk yards. 27. Wineries. SECTION 5. That Section 17.64.030 of Chapter 17.64 of Title 17 of the Municipal Code of the City of Bakersfield is hereby repealed. SECTION 6. That Section 17.64.040 of Chapter 17.64 of Title 17 of the Municipal Code of the City of Bakersfield is hereby repealed. SECTION 7. This ordinance shall become effective thirty days from and after the date of its passage. .......... 000 ..........
