AN EMERGENCY ORDINANCE AMENDING SECTION
3.16.110 BY ADDING SUBSECTION (C) RELATING
TO POLICE ORGANIZATION IN THE EMPLOYER-
EMPLOYEE RELATIONS ORDINANCE, AND AMENDING
SUBSECTION (±) (1) OF SECTION 3.18.180
RELATIVE TO COMPENSATION FOR HOLIDAY PAY.
WHEREAS, it is necessary to immediately adopt a provision
relative to police department organization in that the below section
was inadvertently left out of the redraft of the employer-employee
ordinance and the police department at the present time is under-
going a proposed organization for employee representation; and
WHEREAS, it is necessary to immediately adopt a provision
to implement the present operation and practice in the police
department relative to compensation for holiday pay.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
That subsection (C) is hereby added to Section 3.16.110
of the Municipal Code of the City of Bakersfield to read as follows:
(C) Police Organization. For the purposes of Section 3508
of the Government Code, police officers of the City of Bakersfield
may form, join, participate in, and be represented by employee
organizations of their own choosing for the purposes of representa-
tion on all matters of employer-employee relations as provided by this
chapter, provided such employee organizations: (1) are composed
solely of such police officers, (2) concern themselves solely
and exclusively with the wages, hours, working conditions, welfare
programs, and advancement of the academic and vocational training
in furtherance of the police profession, and (3) are not sub-
ordinate to any other organization.
SECTION 2.
That subsection (i)(1) of Section 3.18.180 of Chapter
3.18 of Title 3 of the Municipal Code is hereby amended to read
as follows:
(1) Police Department Employees. Eligible police department
employees working on a shift basis shall be paid at the rate of
one and one-half times their regular hourly rate of pay for the
8-hour designated holidays of the current fiscal year,, One pay-
ment for all such holidays shall be made on the first payday in
June of each year. All other eligible police department employees
who do not work on a shift basis shall observe holidays in accord-
ance with subsection (e) of this section.
SECTION 3.
Effective date. This ordinance is an emergency ordinance
and is to become effective immediately upon its adoption.
I HEREBY CERTIFY that the foregoing emergency ordinance
was passed and adopted by the Council of the City of Bakersfield
at a regular meeting thereof held on the 12th day of August, 1974,
