HomeMy WebLinkAboutORD NO 2204ORDINANCE NO. 2204 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADDING CHAPTER 10.34 TO TITLE 10 OF THE MUNICIPAL CODE, PROHIBITING THE REMOVAL OF SHOPPING CARTS FROM THE PREMISES OF BUSINESS ESTABLISHMENTS FURNISHING SAME. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Chapter 10.34 is hereby added to Title 10 of the Municipal Code of the City of Bakersfield as follows: Sections: 10.34.010 10.34.020 10.34.030 10.34.040 10.34.050 Chapter 10.34 SHOPPING CARTS Definitions. Shopping Carts, Removal of, Prohibited. Shopping Carts, Notice, Affixed to Cart. Shopping Carts, Notice, Posted on Premises. Penalty. 10.34.010 Definitions. For the purpose of this Chapter, words and phrases shall be given their customary and usual meanings and shall be interpreted and construed accordingly, unless a different meaning is expressly ascribed thereto. 10.34.020 Shopping Carts, Removal of, Prohibited. Without the prior written consent of the owner, it shall be unlawful for any person to remove, or cause to be removed, any shopping cart which is the property of the business establishment furnishing such carts for its customers' use, from the parking lot or other premises of said business establishment. 10.34.030 Shopping Carts, Notice, Affixed to Cart. Each shopping cart shall have prominently and permanently affixed thereto a notice in substantially the following form: Property of (owner's name) Removal of this cart from these premises without written permission of the owner is prohibited by law. (Bakersfield Municipal Code Chapter 10.34) Maximum penalty $500 - 6 months, or both. 10.34.040 shall be posted by the business establishment lot and shopping carts for its customers' use, conspicuously on the premises and the parking substantially the following form: Removal of shopping carts from these premises prohibited by law. 10.34.050 Shopping Carts, Notice, Posted on Premises. There furnishing a parking prominently and lot, a notice in (Bakersfield Municipal Code Chapter 10.34) Maximum penalty $500 - 6 months, or both. Penalty. Any person violating Section 10.34.020 of this Chapter shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than $500, or by imprisonment in the County jail for a period of not to exceed six (6) months, or by both such fine and imprisonment. SECTION 2. This ordinance shall become effective thirty days from and after the date of its passage. .......... o00 ..........
