AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD
AMENDING SECTION 13.16.030 OF CHAPTER 13.16 BY ADDING
SUBSECTION (m) THERETO, PROVIDING FOR MODIFICATION OF
THE UNIFORM BUILDING CODE, 1970 EDITION, VOLUME 1,
RELATING TO FLOOD OR MUD SLIDE HAZARDS.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
That subsection (m) is hereby added to Section 13.16.030
of Chapter 13.16 of Title 13 to read as follows:
(m) A new Section 2316 is added to read:
Section 2316. Flood or Mud Slide Hazards. The Building
Director shall review applications for building permits, including
the plans and specifications for the proposed construction, to
determine if the proposed construction is consistent with the need
to minimize flood damage; he shall require: that proposed construc-
tion in flood hazard locations be designed and anchored to prevent
the flotation, collapse or lateral movement of the structure or
portions of the structure due to flooding; the use of construction
materials and utility equipment that are resistant to flood damage;
the use of construction methods and practices that will minimize
flood damage; that the builder provide adequate drainage in order
to reduce exposure to flood hazards; the location of public utilities
and facilities on the site in such a manner as to be elevated and
constructed to minimize or eliminate flood damage. If, in the
opinion of the Building Director, a structure to be used for human
habitation or occupancy is proposed to be located such that it
would be subject to flood hazard or mud slide, to the extent that
it would endanger human life or safety, a permit to construct shall
be denied, unless corrective work satisfactory to the Building
Director can be done to eliminate or sufficiently reduce the hazard.
No structures shall be permitted where prohibited under the City
flood plain ordinance.
The Building Director in formulating his opinion as to
the extent of the hazard may take into consideration such data as
is available from federal, state and local agencies, having
information and knowledge relative to such hazardous conditions.
He may require applicants to furnish geological and/or engineering
studies, reports and recommendations for corrective work sufficient
to establish the safety of the proposed structure, and for which
a qualified registered geologist and/or engineer shall assume full
responsibility.
SECTION 2.
That the City Council does hereby expressly find and
determine that this amendment to the 1970 Edition of the Uniform
Building Code, Volume 1, is reasonably necessary because of local
conditions.
SECTION 3.
That the City Clerk, upon enactment of this ordinance,
shall notify the Department of Housing and Community Development,
Division of Building and Housing Standards, State of California,
of this enactment by sending a copy of the ordinance codified herein,
along with a notice advising such department of the fact of the
enactment of said ordinance and its effective date, and of the
express finding made that such change to the said Uniform Building
Code, Volume 1, adopted by reference, is reasonably necessary in
the City of Bakersfield because of local conditions.
SECTION 4.
This ordinance shall become effective thirty (30) days
from and after the date of its passage.

I HEREBY CERTIFY that after the first reading of the
title of this ordinance and the title of the code amended hereby,
a public hearing was scheduled, noticed and held after which the
foregoing ordinance was passed and adopted by the Council of the
City of Bakersfield at a regular meeting thereof held on the
22nd day of July , 1974, by the following vote:
