A RESOLUTION DISPENSING VVlTH BIDDING PROCEDURES DUE TO
EMERGENCY REPAIRS OF TWO 48-INCH METAL PIPES AND STREET
REPAIRS ON SOUTH "H" STREET, SOUTH OF PLANZ ROAD.
WHEREAS, on Wednesday, August 5, 1998, a large hole was detected on South
"H" Street, south of Planz Road; and
WHEREAS, City crews were immediately dispatched to the area and discovered the
48-inch corrugated metal pipes were rusted/corroded and had collapsed; and
WHEREAS, on Wednesday, August 5, 1998, the Public Works Director was
informed that the repairs could not be fixed by City staff alone; and
WHEREAS, the Public Works Director declared this problem an emergency and the
work to be performed was of urgent necessity for the preservation of life, health or
property; and
WHEREAS, the Public Works Director determined the area of South H Street had
to be closed, south of Planz Road for emergency road repairs caused by a collapsed pipe.
Repairs were completed by Friday evening August 7, 1998, and the street reopened; and
WHEREAS, due to the nature of repairs and the potential liability to the City, arising
from damage to farmers' crops, and the fact the canal water could only be shut off for 30
hours required the use of outside forces to repair collapsed pipe in the time frame allowed
by the Kern Delta Water District; and
WHEREAS, to remedy this emergency, the Public Works Director authorized
construction services on a time-and-materials basis to remove the existing corrugated
pipes and install two 48-inch re-enforced concrete pipes to prevent recurrence of a
collapsed pipe line and to assure the safety of the public traveling on South "H" Street.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and incorporated herein by reference.
2. City Council hereby determines that based on the above recitals the work
performed was of urgent necessity for the preservation of life, health or property, thereby
allowing the dispensing of bidding requirements as set forth in Section 136 of the City
Charter and Section 3.20.060 of the Bakersfield Municipal Code.
