HomeMy WebLinkAboutRES NO 109-98RESOLUTION NO. _L0__9" 9 8 A RESOLUTION MAKING FINDINGS, APPROVING A NOTICE OF EXEMPTION (GENERAL RULE) AND ADOPTING PROPOSED AMENDMENT TO THE CIRCULATION ELEMENT OF THE METROPOLITAN BAKERSFIELD 201g GENERAL PLAN (CIRCULATION ELEMENT AMENDMENT P98-0175). WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on MONDAY, June 15, 1998, and THURSDAY, June 18, 1998, on a proposed amendment to the Circulation Element of the General Plan, notice of the time and place of hearing having been given at least twenty-one (21) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such proposed amendment to the Circulation Element of Metropolitan Bakersfield 2010 General Plan is as follows: GENERAL PLAN AMENDMENT P98-0t75 The City of Bakersfield Public Works Department has applied to amend the Circulation Element of the Metropolitan Bakersfield 2010 General Plan consisting of a change from arterial to collector for that segment of Panorama Drive located between Haley Street and Union Avenue; and WHEREAS, for the above-described amendment, a determination was made that the proposed amendment is exempt from CEQA under the General Rule - the project does not have the potential for causing a significant effect on the environment (Section 15061 (a) (3) CEQA Guidelines) and, if the project is approved a Notice of Exemption will be filed with the County Clerk of the County of Kern; and WHEREAS, the law and regulations relating to CEQA and City of Bakersfield's CEQA Implementation procedures, have been duly followed by the city staff and the Planning Commission; and WHEREAS, by Resolution No. 63-98 on June 18, 1998, the Planning Commission recommended approval and adoption of this General Plan Amendment and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on WEDNESDAY, August 12, 1998, on the above described proposed amendment to the Circulation Element of the Metropolitan Bakersfield 2010 General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Califomian, a local newspaper of general circulation; and findings: 1. WHEREAS, the Council has considered and hereby makes the following The above recitals, incorporated herein, are true and correct. 2. All required public notices have been given. 3. This project is covered by the General Rule Section 15061 (b)(3) in that there is no possibility that the project may have a significant effect on the environment, and is exempt from the California Environmental Quality Act. 4. A Notice Of Exemption will be filed with the County Clerk when the project is approved. 5. Arterials are six-lane roadways with pavement width of 90 feet. 6. Collectors are four lanes with a pavement width of 68 feet. 7. Panorama Drive between Haley Street and Union Avenue has a pavement width of 78 feet which includes four lanes, a striped median and bicycle lanes. 8. Panorama Drive between Haley Street and Union Avenue with a pavement width of 78 feet does not conform to arterial width standard. 9. The proposed amendment is consistent with the Circulation Element. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The project is exempt from CEQA and the General Rule 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The City Council hereby approves and adopts the proposed amendment to the Circulation Element of the Metropolitan Bakersfield 2010 General Plan, constituting a change from arterial to collector for that segment of Panorama Drive located between Haley Street and Union Avenue as shown on the map marked Exhibit "A", attached hereto and incorporated as though fully set forth. 5. That General Plan Amendment P98-0175, approved herein, be combined with other approved amendments described in separate resolutions, to form a single Circulation Element Amendment. ......... 000 ........
