MEMORANDUM

SUBJECT: REFUSE FUND
In preparation for refunding the gate fee amount collected from City residents ]
via property tax bills it was agreed upon that the City would refund only to
assessed parcels that have paid both property tax installments as of June 30,
1989 and then only to the owner of record as of March 1, 1988. However, staff
assumed that the County of Kern would allow the City to change the assessment
amount on unpaid assessments at June 30, 1989. This assumption was based o~ a
similar action recommended and approved by the County for a similar refuse
refund in 1984. After' meeting with the County Auditor-Controller it is clear
that revising the assessment for unpaids is not an option available to the City.
Consequently, a decision must be made as to the.City policy regarding refunds to
unpaid assessments at June 30, 1989. Three possible options are as follows:
Option i - Refund to each parcel assessed with the gate fee regardless if the
tax bill is paid or unpaid. The rationale for this option would be,
that all assessments would'be paid at some time since the assess-
ment is a tax lien on the property. The downside to this option is
that we would be refunding to some residents who have not yet paid
the amount refunded to them.
Option 2' - By resolution set a June 30, 1989 deadline for paying the assess-
ment in order to qualify for a refund. The County of Kern used
this method for refunding amounts in accordance to Measure A
(refund of amounts collected as a contingency to thee oil industry
challenge of Assessors assessments of oil reserves)i.
Option 3 - Parcels that have fully paid tax bills will be refunded ~he gate
fee amount. Unpaid assessments will be processed manually by the
Finance Department as the assessments are paid and if the assessee
requests payment. It is estimated that approximately 3,000 assess-
ments will remain unpaid at June 30, 1989. In theory this would
mean that after July 1, 1989 and five years thereafter citizens
would be requesting refunds from the City in person or by mail.
I have not yet contacted the attorney's office to discuss the legal.ramifica-
tions of our options.
